PROPERTY LOCATION: 8405 Cox Lane, Cutchogue CTM#1000-83-3-8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type ii category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 6, 2009 stating that this application is considered a matter for local determination as there appears to be no significant eounty-wide or inter-community impact. LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not involve features that relate to a regulated natural feature or a bulkhead or other shoreline. SOUTHOLD TOWN PLANNING BOARD: This application was referred to the Planning Board and they issued their comments in a letter dated December 16, 2009 stating recommendation for approval of the variance relief requested on the basis the building is appropriate for the overall use of the site and building itself. PROPERTY FACTSIDESCRIPTION: The subject property is a conforming 43,560 sq. ft. M in the LI zone. It has 195.4 feet of frontage on Cox Lane, 225 feet along the easterly lot line, 191.86 feet along the southern lot line and 224.97 feet along the western lot line. The parcel is improved with a one-story frame building/garage and a one-story temporary green house as shown on a Site Plan prepared by James J. Deerkoski, Licensed PE, dated November 10, 2009. BASIS OF APPLICATION: Request for Variances from Code Section 280-63, based on an application for building permit and the Building Inspector's March 13, 2009, updated September 14, 2009 Notice of Disapproval concerning proposed one story construction behind existing building on existing contractor's yard, after removal of existing temporary green house. New construction is proposed at: (1) less than the code required side yard setback of 20 feet, (2) less than the code required rear yard setback of 70 feet. RELIEF REQUESTED: The applicant proposes to construct a one-sto uildin attached tocthe existing on -s-story building for use as a contractor's yard. App scan is requesting a single side yard setback of 10 feet w ere 0Teet is required and a rear yard setback of 41.5 feet where 70 feet is required. CrM: 1000-83-3-8 at 8405 Cox La., Clichogue FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on Feb. 25 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the applicant will be using the property for a contractor's yard, which is a permitted use within this zone, and the placement of the building at the proposed setbacks will allow for the more orderly flow of traffic arriving and leaving the property. 2. Town Law 6267-1613)(b)(2). The benefit sought by the applicant, cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is proposing to attach a 6000 sq It building to an existing 1263 sq. It, building, the board finds that it would not be feasible for the applicant to remove the existing building in order to construct the proposed structure. 3. Town Law 6267-b(3Hb)(3). The variances granted herein are substantial. Granting a rear yard setback of 41.5 feet represents nearly a 60% reduction of the code required 70 feet rear yard setback. Granting the side yard setback of 10 feet represents a 50% reduction of the code required 20 feet side yard setback. However; the Board finds that the granting of the requested setbacks are justified considering that the adjacent parcels are larger, have much more intensive uses and will not be in anyway impacted by the proximity of the proposed building. 4. Town Law 6267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this LI Zonino District will have an adverse impact on the physical or environmental conditions in the neighborhood. The new building will allow for the storage of supplies and equipment inside, out of view, and protected from the elements thereby enhancing the view of the property for the street. Granting of the requested variances will allow large tracks to turn around freely on the property and not on the public roadway. 5. Town Law 6267-b(3)(b)(5). The difficulty has not been self-created. This lot is relatively small when compared to other developed lots in the area. The applicant needs the extra room the granting of this variance will provide to allow equipment and large trucks space to move freely about the property. 6. Town Law 6267.b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a Contractor's Yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio , seconded by Member and duly carried, to .GRANT the variance as applied for. and shown on the Site Plan, dated November 10, 2009, and prepared by James J. Deerkoski, P.E. Conditions: Remove the existing temporary building prior to issuance of the Certificate of.Occupancy.
