W ITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in at Mattituck, Town of Southold, County of Suffolk and State
of New York, being more particularly bounded and described as follows:
BEGINNING at a concrete monument located on the southerly line of
Park Avenue at the northwesterly corner of the premises about to be
described', which monument is 823 feet easterly from the corner formed
by the intersection of the easterly line of Marratooka Road.and the
southerly line of Park Avenue; running-thence from said point or place
of beginning along the southerly line of Park Avenue the following two
courses and distances: (1) North 86° 57' 00" East 66.25 feet; (2)
North 72° 50' 00" East 6.75 feet to a concrete monument and land now
or formerly of Peter Swahn and Barbara Swahn; running thence along
said last mentioned land South 11n 13' 00" East 577.72 feet to the
high water mark along a wood bulkhead of the Great Peconic Bay;
running thence along the said high water mark and wood bulkhead the
following three courses and distances: (1) South 68° 21' 04" West
66.52 feet; (2) South 00° 55' 25" West 24 feet; (3) North 88° 32' 10"
West 1.87 feet; running thence North 11° 13' 00" West 621.53 feet to
the southerly side of Park Avenue the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of
the first part by deed dated June 17, 2009 and recorded in the Suffolk
County Clerk's Office on June 19, 2009 in Liber 12591.Page 454.
TOGETHER with all right, title' and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
