THIS AGREEMENT made this d y ot'Oeiobe 2013, between FRANCES
KELLY, residing at 3825 Wickham Avenue. Mattituck, New York 11952 (hereinafter
referred to as KELLY), and.101-IN LOUIS GIORDANO AND VIVIAN GIORDANO
as co-Trustees of THE GIORDANO FAMILY TRUST dated 12127191. residing at 3775
Wickham Avenue. Mattituck. New York 11952, (hereinafter referred to as GIORDANO).
WITNESSETH:
WHEREAS, KELLY is the owner of the real property known as 3825 Wickham
Avenue, Mattituck. New York (Suffolk County Tax Map No. 1000-107.00-09.00-
005.000) more fully described on annexed Schedule A, and GIORDANO is the owner of
the real property known as 3775 Wickham Avenue. Mattituck, New York (Suffolk
County tax Map No. 1000-107.00-09.00-006.000) more fully described on annexed
Schedule B, adjoining the KELLY premises on the southwest. and
WHEREAS, the parties hereto desire to fix and definitely establish the boundary
line between their properties;
WITNESSETH that in consideration of the premises and of the sum of one dollar
by each of the parties hereto in hand paid to the other. receipt whereof is hereby
acknowledged, said parties hereto for themselves, their heirs, executors, administrators
and assigns, covenant and agree that the said boundary line between the premises
aforesaid be and the same hereby is established as follows:
Beginning at a monument on the northerly side
of Wickham Avenue, distant South 45 degrees
01 minutes 00 seconds West 50 feet from a monument
at the southeasterly corner of the KELLY premises.
and from said point of beginning running: North 53
degrees 06 minutes 00 seconds West a distance of
280.77 feet more or less, and through a monument
to the high water mark of Long Creek.
KELLY hereby remises. releases and quitclaims unto GIORDANO. their heirs
and assigns forever, all of her right, title and interest in and to any land lying to the West
of the said boundary line so established, and GIORDANO hereby remises, releases and
quitclaims unto KELLY. her heirs and assigns forever. all of its right, title and interest in
and to any land lying to the East of said boundary line so established.
The parties each agree that they will not terminate or cut off the existing common
use of the driveways on the two respective properties prior to November 1. 2018. such
use having existed by permission of both parties.
It is mutually covenanted and agreed by and between the parties hereto that this
agreement shall run with the land and bind the respective heirs. executors. administrators
and assigns of each of the parties hereto.
IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and
seals the day and year first above written.

being a distance of 476.00 feet, more or less, measured in a northerly direction along the westerly
side of Wickham Avenue (Old Middle Road) from the intersection formed by the northerly side of
Conklin Road with the westerly side of Wickham Avenue (Old Middle Road);
RUNNING THENCE North 53 degrees 06 minutes 00 seconds West along land now or formerly of
