ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being at Bayview, near Southold, in the Town of Southold, County of Suffolk and State of New York, known and
designated as Lots No. 119 and 120 on a certain map entitled "Map of Goose Neck, situate at Bayview, Town of
Southold, Suffolk County, N.Y., owned by G.W. Smith & Sons," made by Otto W. Van Tuyl, Licensed Surveyor,
Greenport, N.Y. and filed in the Office of the Clerk of Suffolk County on November 22, 1948, as and by File No.
1663.
Together with the right to use, for all reasonable purposes in common with others, subject to such reasonable rules
and regulations with respect to the use thereof as the party of the first part may from time to time put into effect,
that portion of Lots 37, 38 and 39 on said map, known as the beach property, it being the intention of the party of
the first part to grant to the party of the second part the same rights that it has heretofore granted to other grantees
of lots on said map.
Being the same premises described in the deed dated 11/20/2012 and recorded 1127/2012 in Liber 12715 at Page
38 and in the deed dated 11/0312008 and recorded 12/16/2008 in Liber 12575 at Page 50 and in deed dated
01/17/1997 and recorded 10102/1997 in Liber 11855 at Page 114.
Said premises is known and designated as District 1000 Section 076.00, Block 02.00, Lot 030.001
Said premises being known as 825 Smith Drive South, Southold, New York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center line thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if to read "parties" whenever the sense of this indenture so requires.
