Being and intended to be the same premises conveyed to the party of the first part by deed recorded in

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of Suffolk and
State of New York, being more fully described as Lot No. 8 (Eight) on a certain map entitled "Paradise by the Way" filed
in the Office of the Clerk of the County of'Suffolk on November 4, 1976 as Map No. 6463 prepared by Young and
Young, Surveyors; said lot being more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Kimberly Lane where the same is intersected by the division line between
Lots 7 and 8 as shown on the aforesaid map, said point or place of beginning, being distant 1,198.75 feet southerly as
measured along the easterly side of Kimberly Lane, from the southerly end of a curve having a radius of 25.00 feet and a
length of 39.27 feet which said curve connects the southerly side of Pine Neck Road with the easterly side of Kimberly
Lane;
RUNNING THENCE from said point or place of beginning along said division line last mentioned North 84 degrees 22
minutes 20 seconds East, 361.97 feet to Southold Bay;
RUNNING THENCE along Southold Bay the following 3 tie line courses and distances:
1) South 09 degrees 32 minutes 36 seconds West, 73.38 feet;
2) South 07 degrees 05 minutes 59 seconds East, 42.07 feet;
3) South 08 degrees 56 minutes 37 seconds West, 38.38 feet to the division line between Lots 8 and 9;
RUNNING THENCE along said division line South 84 degrees 22 minutes 20 seconds West, 282.44 feet to the easterly

THENCE along the easterly side of Kimberly Lane the following 3 courses and distances:
1) Northerly along the arc of a curve bearing to the left having a radius of 60.00 feet a distance of 91.06 feet;
2) Northerly along the arc of a curve bearing to the right having a radius of 25.00 feet a distance of 21.68 feet;
