(attorney for Itzkowitz/Meltzer-7:30 p.m. appt) Commencement: • The meeting began at 7:11 p.m. with five LPC members present. Adoption of Meeting Minutes: • Acceptance of LPC meeting minutes from November 26, 2013 HOLD Land Preservation Applications and Inquiries: • SCTM #1000-73.-1-1; 73.-2-4 (THE VINES) Review application and status Melissa presented landowner's application and proposed Conservation Subdivision Plan as prepared by Howard Young, Surveyor. LPC prepared comments to be addressed with Planning and landowner. LPC not in favor of proposed design with preserve land within individual residential lots, nor location of lots 2 & 3. LPC supports further clustering of lots and building area. Melissa to review LPC comments with Planning. • SCTM #1000-55.-2-10.1 (MOFFAT FARM NORTH, LLC) Review new application Melissa Spiro, Land Preservation Coordinator, reported to LPC on her meeting between some of the landowners and their agent, Tom McCarthy, and the LPC application received as a result of the outcome of said meeting. LPC responded approvingly to proposed plan for Town's purchase of farmland development rights. This project has been awarded a Federal grant. MOTION made by Eric Keil, seconded by Allan Connell, to direct Melissa Spiro to commission an appraisal for the purchase of a development rights easement on the Moffat Farm North, LLC property (SCTM #1000-55.-2-10). Landowners propose reserve up to a 5± acre reserve area, and LPC will allow for the future subdivision of the Reserve Area from the farm. Appraisal will be prepared in accordance with Federal grant standards. Motion carried: 6/0 • SCTM #1000-106.-9-2.3 (COOPER AgPDD) Status update Draft easement template is being drafted for Cooper AgPDD by LPC attorney Lisa Kombrink in accordance with LPC's comments. Template will be scheduled for discussion at next LPC meeting. • SCTM #1000-14.-2-1.4 (TNC / Whitcom Marsh) Update re: status of TNC transfer of preserved property to Town This preserved property is located in Orient and fee title held by The Nature Conservancy. TNC wishes to donate this land to the Town and documents for the title transfer have been received. Public hearing needs to be set. Applications & Inquiries for Uses or Structures on Preserved Property: • SCTM #1000-108.4-1.4 (SHOWALTER proposal/Town PDR known as Pindar Vineyards, LLC) Review application - request for horse stalls NRCS approved Pasture Management Plan submitted by Chris & Joanne Showalter (new property landowners of farmland f/k/a Pindar Vineyards, LLC) was reviewed by LPC. MOTION made by John Sepenoski, seconded by Eric Keil, to approve the use request of Chris & Joanne Showalter for boarding, breeding, raising and training of approximately 30 horses in accordance with the November 21, 2013 Horse Farm Grazing and Pasture Management Plan, and the proposed improvements which include a 4 stall barn/stable, courtyard, paddocks (some with run- in sheds), grass training area, electric & water trenching to improvements and paddock areas, and a manure dump trailer site. Formal LPC approval letter to be sent to landowner with copies to Planning Board and Building Department. Motion carried: 5/0/1 (Allan Connell recused himself from LPC vote due to work related association with USDA-NRCS) • SCTM #1000-1-2.-4-6.1 (ITZKOWITZ / MELTZER; f/k/a Batuello PDR, property owner Ruttura) Review application - request for equipment storage barn and horse stalls Applicant requested appointment: 7:30 p.m. appointment Gail Wickham, Esq. met with Committee members to discuss her clients'- Joel Itzkowitz and Isabelle Meltzer - Application to Request for Ag Structure Placement on Town Preserved Lands. Application from Itzkowitz/Meltzer is made with permission from the current property owner, Ruttura. Request is for 48'x48' barn with up to 8 stalls to raise and train horses with a few stalls being used for boarding purposes. Landowners approval will include the right to construct in phases. Access to the barn and unpaved parking area will be by a dirt or gravel farm road. Any utilities needed will be provided to the barn area by underground trenching. Manure will be properly disposed of. MOTION made by Eric Keil, seconded by Maureen Cullinane, to approve the proposed construction of a barn, 48'x48', to be used for agricultural equipment storage and up to 8 stalls for the training, raising and boarding of horses with an approval to include within this structure a farm management office, bathroom utilities, or other related agricultural uses of the building that may be needed in the future for the viability of this farm. This approval is subject to the revocation of a prior Land Preservation Committee approval for construction of a horse barn (never constructed) granted to former property owners, Cliff & Regan Batuello by LPC approval letter dated May 5, 2005, once acquisition of fee title to the property is completed by Joel Itzkowitz and Isabelle Meltzer. Formal LPC approval letter to be sent to landowner with copies to Planning Board, Building Department, and Gail Wickham, Esq. Deerkoski monitoring report requires additional review.
