REAL ESTATE EASEMENT AGREEMENT
This agreement is made on January 14, 2013, by and between John
Pitman and Susan Pitman, residing at 1100 Ruch Lane, Southold,
New York (the "Grantors"), and Patricia walker, residing at 1020
Ruch Lane, Southold, New York (the "Grantee").
In consideration of the mutual promises hereinafter set forth,
and no additional consideration ($0.00), the Grantors hereby
grant a perpetual easement to the Grantee for the following
purposes: The septic system currently serving 1020 Ruch Lane,
Southold, New York (the "Grantee's Property") is partially
located on the property of 1100 Ruch Lane, Southold, New York
(the "Grantors' Property"). The Grantee is hereby granted an
easement, by the Grantors to have access and use of the
Grantors' Property containing the septic system as needed for
maintenance and repair. The Grantee will be responsible for the
expenses of repair, maintenance and landscaping. That portion
of the septic system which exists on the Grantors' Property and
is necessary for maintenance and repair on the Grantors'
Property is referred to herein as the "Easement Area". The
Easement Area is more particularly described on Schedule A
attached hereto. Access by the Grantee to the Easement Area
does not require prior notification to the Grantor, as emergency
work may be necessary.
The easement is perpetual and may be transferred with the sale
of either property. However, in the event the septic system
serving the Grantee's Property is moved to a new location off
the Grantors' Property, the easement shall be terminated.
The Grantors also retain the right to enjoy the use of the land
subject to the terms of the easement, but may not build or
disturb the Easement Area in any way that will disrupt or
interfere with the septic system.
The Grantee shall at all times keep the Easement Area free and
open for the benefit of the Grantors. Any structure on the
Easement Area, such as a fence, may be removed by the Grantee
for proper access, but will be replaced at their expense.
The Grantors will not be held liable for any claims resulting
from the use, maintenance, repair or replacement of the septic
system of the Easement Area. It is the Grantee's responsibility
that any workers are covered by worker's compensation and

DESCRIPTION OF EASEMENT AREA
All that certain piece and parcel of land situated in
the Town of Southhold, Suffolk County, New York, beginning at a
point which is 50 feet west of Ruch Lane along the southerly
line of lands of Walker and the northerly line of lands of
Pitman, thence South 10 feet into lands of Pitman to a point,
thence west through lands of Pitman a distance of 50 feet to a
point, thence north through lands of Pitman a distance of 10
feet to the southerly line of lands of Walker and the northerly
line of lands of Pitman, thence east a distance of 50 feet along
the southerly line of lands of Walker and the northerly line of
lands of Pitman to the point or place of beginning.
