TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
1 the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
t�\ eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply

ALL that certain plot, piece or parcel of land, situate, lying and
being at East Cutchogue, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the southerly side of Eugene's Road distant
the following three (3) courses and distances from the corner formed
C by the intersection of the easterly side of Main Road with the
southerly ;side of Eugene's Road: ( 1 ) South 68 degrees 42 minutes 40
seconds East,' 371. 86 'feet; (2) South 74 degrees 05 minutes 40 seconds
East, 274. 81 feet; (3 ) South 63 degrees 11 minutes 20 'seconds East,
459. 68 feet to the point of beginning, said point also being where
the northeast corner of lands now or formerly of H. F. Allan
intersects the s'outhe'rly side of Eugene 's Road ; running thence South
63 degrees 11 minutes 20 second's East along the southerly side of
Eugene 's Road 40 feet; running thence South 69 degrees 06 minutes 40
seconds East still along the southerly side of Eugene 's Road 108 feet
to the westerly ',side of lands now or formerly of Stephen Mitacchione;
running thence South '20 degrees 53 'minutes 20 seconds West along said
lands of Mitacch',ione 197. 90 feet to the high water mark of Eugene 's
Creek; running thence North 55 degrees 58 minutes 20 seconds West
along the high water mark of Eugene 's Creek 148. 30 feet; running
thence North 87 degrees 53 minutes 20 seconds West still along the
high water mark of Eugene 's Creek 22. 80 feet to the easterly side of
lands now or formerly of H. F. Allan; running thence North 26 degrees
48 minutes 40 seconds East along said lands 176. 62 feet to the point
or place of BEGINNING.
SUBJECT TO a Water Easement over the northeasterly portion of the
subject premises as described in Easement dated June 6, 1978 and
recorded in the Office of the Clerk of the County of Suffolk on July
10, 1978 in Liber 8457 of Conveyances at Page 434.
BEING AND INTENDED to be premises conveyed to the party of the first
part by deed from Steve Mitacchione and Josephine I. Mitacchione, ux,
dated June 6, 1978 and recorded in the Office of the Clerk of the
County of Suffolk on July 10, 1978, in Liber 8457 of Conveyances at
Page 434.
