Located: 7080 Great Peconic Bay Boulevard, Laurel. SCTM# 126-11-7 The action to reconstruct the existing 69' long timber retaining wall with 12' return using vinyl sheathing was recommended as CONSISTENT in November, 2013. The structures we constructed pursuant to an existing permit (6045) issued in 2004. The proposal actions to repair existing 12' wide x 67' long lower decking landward of the retaining wall; repair existing 6'x8' beach shower are recommended as INCONSISTENT with LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The 12' wide x 67' long lower decking landward of the retaining wall and existing 6'x8' beach shower were constructed without Board of Trustee review or a Wetlands Permit In the event that the actions are approved it is recommended that the Board determine: 1. If the 12' x 67' structure meets the definition of a deck. Chapter 275 defines a deck as a structure and/or platform without a roof that is either freestanding or attached to a building supported by pillars and/or posts constructed of various materials. If the structure is a deck/platform then it is not permissible in this location. Pursuant to section 275-11 platforms may not exceed 200 square feet and must be landward of the top of bluff. Note the top of bluff/bank has not been determined. 2. The location and function of the drainage of the existing shower. Further, it is recommended that the Board establish the vegetation between the upper and lower as a nonturf, vegetated buffer. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Based upon the inform ion provided on the LWRP Consistency Assessment Form submitted to this department, as well as he records available to me, it is my recommendation that the proposed actions are CONSISTENT wit the LWRP. Pursuant to Chapter 8, the Board of Trustees shall consider this recommendation in preparing its written determination egarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3.
