WITNESSETH :
WHEREAS, DECLARANTS are the owners of certain real property located at 1675 Bayview Avenue,
Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax Map as District
1000, Section 52, Block 5, Lot 8.1, which is more particularly bounded and described as set forth in Schedule
"A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANTS therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities;and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that the approximately 10' wide embankment to be restored landward of and adjacent to
the proposed wood tie terrace retaining wall (to be placed along the toe of the embankment) is to be maintained
as a"nonturf buffer,"
NOW,THEREFORE,the DECLARANTS do hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities,the approximately 10'
wide restored embankment area landward of and adjacent to the proposed wood tie terrace
retaining wall (to be located along the toe of the restored embankment) on the subject premises
shall be maintained as a"nonturf buffer"as defined by Chapter 275 of the Town Code; and
2) These covenants shall run with the land and shall be binding on the DECLARANTS, their heirs,
assigns, purchasers, or successors in interest and may be modified only upon resolution of the
Board of Trustees.

respect to the above referenced application concerning the re-vegetation of the ten foot
wide embankment,to be established and subsequently maintained as a non-turf buffer

December 11, 2013.
The covenants and restrictions document must be executed and filed with the County
pursuant to §275-10(K) of the Southold Town Code. Please note that a copy of this

IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee Andrew& Karen Wills residing at 1675 Bayview Avenue, Southold,New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 11, 2013 regarding the above matter:
WHEREAS, En-Consultants on behalf of ANDREW & KAREN WILLS applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated December 11, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the term "terrace walls" are
identified as retaining walls on the site plan prepared by En-Consultants, last dated
November 7, 2013; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 11, 2013, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of ANDREW& KAREN
WILLS to construct two (2) +/-93 linear foot wood tie terrace retaining walls, one along
toe of embankment (landward of tidal wetlands) and one on embankment face, each
with two (2) +/-5' returns; re-nourish embankment by backfilling terrace retaining walls
with approximately 15 cubic yards clean sandy fill to be trucked in from an approved
upland source; re-vegetate +/-10' wide embankment with native vegetation, e.g., Cape
American beach grass, switchgrass, Virginia rose, and or northern bayberry which is to

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the

wetlands) and one on embankment face, each with tow (2) +/-5' returns; re-nourish embankment by

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. The
action does not meet the below policy.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
It is recommended that the Board correctly identify the erosion control structures on the
site plan dated 11/7/13. The term "terrace wall" is not an identified erosion control
structure in Chapter 275. The structures are either a retaining wall or bulkhead
depending on location. In this case the bank slope, AHW and location of high marsh
must also be considered in determining the correct structure.
Pursuant to § 275-11, if the structure is determined to be anew bulkhead then it must be
designed as a low sill bulkhead. Additionally, a 10' non-turf buffer is required. A 10' non-
turf buffer is proposed.
In the event that the action is approved, it is recommended that the Board requires that
the existing tidal wetland vegetation be undisturbed to the greatest extent practicable
during the construction of the erosion control structure.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The subject property is one of two adjacent properties located between neighboring properties on either side of them
whose shorelines are fully hardened by full scale seawalls. The subject property is thus vulnerable to absorbing erosive
energy during severe storms. As a result,the embankment has suffered increased erosion during the severe storm cycle of
the past several years,culminating with the avulsive erosion of the embankment during Hurricane Sandy in October 2013,
thus necessitating the proposed project designed to stabilize and restore the embankment. Specifically,two+/-93 Lf.
wood tie terrace retaining walls would be constructed,one along the toe of the embankment(landward of tidal wetlands)
and one on the embankment face. The embankment would then be renourished by backfilling the terrace walls with clean
sandy fill and revegetating the+/-10'wide embankment with native vegetation. Therefore,the project will serve to
stabilize and restore the embankment and ensure the long term maintenance of the embankment vegetation that serves not
only as the natural protective feature for the property against flooding and erosion but also as an indigenous vegetative
buffer between the developed upland and the adjacent tidal wetlands.

POLICY 4.
The subject property is one of two adjacent properties located between neighboring properties on
either side of them whose shorelines are fully hardened by full scale seawalls. The subject
property is thus vulnerable to absorbing erosive energy during severe storms. As a result,the
embankment has suffered increased erosion during the severe storm cycle of the past several
years, culminating with the avulsive erosion of the embankment during Hurricane Sandy in
October 2013, thus necessitating the proposed project designed to stabilize and restore the
embankment. The project is consistent with Policy 4 because it seeks to employ a
vegetative/non-structural approach to restoring, maintaining, and enhancing the eroding
vegetative embankment that serves as the natural protective feature for the subject property using
hard stabilization components, i.e., the proposed wood tie terrace retaining walls,to the
minimum extent necessary to increase the likelihood of the success of the proposed
renourishment and revegetation of the embankment. Without the proposed terracing,the width
and slope of the embankment cannot be successfully reestablished, as the unretained
renourishment material would be lost and slough into the adjacent tidal wetlands and the
plantings would fail. Because the most seaward terrace wall is proposed along the embankment
toe and landward of tidal wetlands, the project will in no way impede upon public trust lands or
access thereto.
The project has been designed to be cons*with Policy 6 in that the most seaward terra&ll is proposed along the embankment toe
and landward of tidal wetlands so as to avoid any kind of permanent impact on or altering of the vegetated tidal wetlands. Moreover,the
project inherently seeks to preserve,restore,and enhance the vegetated embankment that serves as the natural protective feature for the
property against flooding and erosion but also serves as an indigenous vegetative buffer between the developed upland and the adjacent
tidal wetlands and surface waters,thus providing habitat and serving as a sink for runoff and associated contaminants adjacent to
wetlands.
