Main Rd. & Youngs Ave.) 41 41 CPT Telephone: 631 765-1938 Southold, NY 11971 Fax: 631 765-3136 00UNIV LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: December 6, 2013 Re: Proposed Wetland Permit for SAL VARANO SCTM#1000-86-7-4.3 SAL VARANO requests an Amendment to Wetland Permit #8060 for the as-built 3'x5' landing leading to a 3'x12.6' set of stairs to a 10'x16' platform with a second set of 3'x8' stairs that continue down to a 3'x5' landing which transitions to a 3'x16' walkway leading to a cantilevered 4'x4' platform with associated 3'x6' stairs to beach. Located: 6600 Indian Neck Lane, Peconic. SCTM# 86-7-4.3 It is my recommendation that the proposed action is INCONSISTENT with LWRP the below listed policies and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The as-built structures are located within the VE flood zone (velocity hazard zone). Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The structures described were not constructed pursuant Board of Trustee review or a Chapter 276 Wetland Permit. Note that the platform measures 160 square feet. Platforms associated with stairs may not be larger than 100 square feet &LPlatforms. [Amended 10-11-2005 by L.L. No. 17-2005; 10-9-2012 by L.L. No. 12-2012] Lal Platforms associated with stairs may not be larger than 100 square feet. [Amended 1-29-2013 by L.L. No. 1-2013] In the event that the action is approved in full or part, it is recommended that the Board require high density planting of native vegetation between the bulkheads. The area between the upper and lower bulkheads should be designated a landscaped buffer or nonturf, vegetated buffer in any decision and subsequent permits. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Located: 6600 Indian Neck Lane, Peconic. SCTM# 86-74.3 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action Is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. It is recommended that a splash pad (constructed of natural materials and located landward of the bulkhead where necessary) be integrated within the design. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. 41 - - TERMS AND CONDITIONS The Permittee Sal Varano, residine at 6600 Indian Neck Lane. Peconic. New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I . That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances wan-ant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9.
