The condition still applies. Note, however, that the LWRP Consistency Assessment Form submitted for the amended action includes the language "for open water disposal at New London (NLDS)" in the extent of action description. It was confirmed with your office that the language does not appear anywhere In else in the file except generically on the amended plans. Docko, Inc. on behalf of FISHERS ISLAND DEVELOPMENT CORP., c/o FISHERS ISLAND MARINA, LLC requests an Amendment to Wetland Permit #8125 and Coastal Erosion Permit #8125C to increase the quantity of the proposed dredging another +/-200 cubic yards over a +/-3,500 square foot area; the new proposed total dredge quantity to be +/-8,850 cubic yards over a +/-66,500 square foot area. Located: Central Avenue, Fishers Island. SCTM# 10-1-9 The addition of 200 cubic yards of sediment is not significant in relation to the overall total amount to be dredged over the course of the project. However, the action still includes the open water disposal of dredged material and the Local Waterfront Revitalization Program below listed policies do not support such disposal. The action is recommended as INCONSISTENT. 5.3 Protect and enhance quality of coastal waters. C. Protect water quality of coastal waters from adverse impacts associated with excavation, fill, dredging, and disposal of dredged material. Documentation has not been provided identifying the location of an approved open water disposal site (as referenced on the plans). Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
