Present were: Peter Young, Chairman Jack McGreevy, Member John Stein, Member William McDermott, Member Doug Hardy, Member Lauren Standish, Secretary CALL TO ORDER The meeting was called to order at 4:40 PM by Chairman Peter Young REPORTS Chairman Peter Young met with the AP Biology teacher, Jeannie Ruland, from Mattituck High School, and several of her students to discuss the student vacancies on the CAC. He provided them with the mission statement and engaged in general conversation about projects for the CAC. The students will submit a synopsis of a proposed project most likely in the New Year and attend a meeting in the near future to be considered for appointment by the Town Board. Jack McGreevy attended the meeting of the Board of Trustees held on Wed., November 13, 2013. The workload presented to the Board of Trustees was well-received by the Board and well- accepted by the contractors. APPROVAL OF MINUTES Moved by John Stein, seconded by Jack McGreevy, to Approve the Minutes of November 6, 2013. 2 DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the applications of SANDRA PAWSON SINCLAIR to restore the storm-damaged bluff face via cut and fill (with the inclusion of 722 cy. of fill obtained from on site, and install a 16' tall, 13' wide and 195' long rock revetment to protect the toe of the bluff from future storm damage and erosion. Construct a set of beach access stairs from the top of the bluff over the revetment and down to the beach. Located: 29827 Main Road, Orient. SCTM#14-2-1.8 Inspected by: John Stein, Peter Young, William McDermott Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by William McDermott, it was RESOLVED to SUPPORT the applications of PARVIZ LALEZARI to restore the storm-damaged bluff face via cut and fill with the inclusion of 481 cy. of fill obtained from the regrading of the bluff, and install a 17' tall, 10' wide, 115' long rock revetment to protect the toe of the bluff from future storm damage and erosion. Construct a set of beach access stairs from the top of the bluff over the revetment and down to the beach. Located: 1390 Demarest Road, Orient. SCTM#13-2-7.7 Inspected by: John Stein, Peter Young, William McDermott The CAC Supports the applications with the installation of gutters and drywells on the dwelling to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to SUPPORT the application of RICHARD AND JOANN SAVARESE to raise existing house, remove and reconstruct foundation, and rebuild the existing deck and stoop. Finished floor height to be raised from elevation 9.8' to elevation 14'. Located: 2575 Old Orchard Rd., East Marion. SCTM#37-6-7.1 Inspected by: John Stein, Peter Young, William McDermott Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of MINNIGAN FAMILY TRUST C/O JOHN MINNIGAN AND JOANNE LAPP, TRUSTEES to legalize existing 68.5' vinyl retaining wall with 6.7' and 5.4' returns, which are located partially on property owned by the Old Orchard Homeowner's Assoc, Inc. and which were constructed in place of a previously existing timber retaining wall and returns at the time the adjacent bulkhead owned by OOHA was reconstructed pursuant to Wetland Permit #7464 and CEHA Permit #7464C. 3 Located: 580 South Lane, East Marion. SCTM#38-6-9 Inspected by: John Stein, Peter Young, William McDermott The CAC does Not Support the application because the application is inadequate for the intended structures as these structures cannot be legalized on property the applicant doesn't own. There should be a joint application with the homeowners association. In addition, the area between the upper and lower bulkheads should be non-turf and specified on the plan. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of GASTON FAMILY, LLC to construct approx. 85 If. of vinyl bulkhead in place of existing storm damaged concrete seawall; remove existing storm damaged concrete return and construct +/-15' vinyl return along inside of property line; and backfill/renourish storm eroded area landward of bulkhead with approx. 25 cy. of clean sandy fill to be trucked in from an approved upland source. Located: 1875 Bayview Ave., Southold. SCTM#52-5-5 Inspected by: John Stein, Peter Young, William McDermott The CAC does Not Support the application and recommends a unified revetment plan with the adjacent property owners in a manner that would protect the marsh and all wetland vegetation. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of CHARLES AND STEPHANIE McEVILY to stabilize, renourish, and revegetate embankment eroded during storm as follows: construct approx. 97 If. of wood terrace retaining wall along toe of embankment and construct approx. 3 additional terraces on face of embankment with lengths of approx. 25, 14 and 30 If., where the exact number of terrace and terrace lengths shall be determined by contractor at time of project implementation based on then current slopes and vegetative condition of embankment; renourish embankment by backfilling terraces with approx. 10 cy. of clean sandy fill to be trucked in from and approved upland source; and revegetate all terraced and disturbed portions of embankment with native vegetation e.g., Cape American beach grass, switchgrass, Virginia rose, and or northern bayberry; and remove and replace +/-51' wood tie retaining wall and install new +/-26' wood tie retaining wall, both along landward edge of top of embankment. SCTM#52-5-6 Inspected by: John Stein, Peter Young, William McDermott The CAC does Not Support the application and recommends a unified revetment plan with the adjacent property owners in a manner that would protect the marsh and all wetland vegetation. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by John Stein, it was 4 RESOLVED to NOT SUPPORT the application of ANDREW AND KAREN WILLS to stabilize, renourish and revegetate embankment eroded during storm as follows: construct (2) 93 If. wood tie terrace retaining walls, one along toe of embankment and one on embankment face, each with (2) 5' returns; renourish embankment by backfilling terrace retaining walls with approx. 15 cy. clean sandy fill to be trucked in from an approved upland source; and revegetate 10' wide embankment (to be maintained as a non-turf buffer) with native vegetation, e.g. Cape American beach grass, switchgrass, Virginia rose, and or northern bayberry. Located: 1675 Bayview Ave., Southold. FLAHERTY to construct an addition to an existing residence with renovations and reconstruction of portions of the existing residence with an addition of a subsurface drainage system for rain water run-off for the residence and existing driveway. Located: 470 Inlet Way, Southold. SCTM#92-1-8 Inspected by: Doug Hardy The CAC Supports the application with the Condition the roof drains from all structures are directed into drywells and the new structure should be FEMA compliant. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of NASSAU POINT PROPERTY OWNERS ASSOC. to construct 17'-6" of new vinyl bulkhead and 4' wide X 6' long beach access stairs to connect to neighboring properties due to damage from storm. Located: Bayview Rd. Nassau Point Rd., Cutchogue. SCTM#104-13- Inspected by: Doug Hardy The CAC Supports the application using best management practices on the beach stairs. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of 850 PRESIDENT, LLC to construct a 30'X 59' single family dwelling. Located: 7165 New Suffolk Road, New Suffolk. SCTM#117-5-31 Inspected by: Doug Hardy 5 The CAC Supports the application with the Condition the dwelling is compliant with FEMA and the sanitary system complies with Health Dept. requirements. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JC MILLER MANAGEMENT to remove and replace 77 If. of deteriorated timber bulkhead with new vinyl bulkhead and 2' wide timber top cap, and provide 10' non-turf buffer landward of bulkhead. Located: 5675 Old Mill Rd., Mattituck. SCTM#106-6-2 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the application of JOAN SHANNON to reconstruct the existing 69' retaining wall, reconstruct the existing 12' return attached to the retaining wall, damaged lower decking which is 12' wide and 67' long at its longest point, and the 8'X 6' beach shower will also be repaired. Plant Cape American beach grass on all uncovered ground seaward of the bluff crest, and an 8' wide access way to the bulkhead. Located: 7080 Peconic Bay Blvd., Laurel. SCTM#126-11-7 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMITS Moved by Doug Hardy, seconded by William McDermott, it was RESOLVED to SUPPORT the application of SAL VARANO to Amend Wetland Permit #8060 to include the repair of the pre-existing stairs and deck damaged by storm. Located: 6600 Indian Neck Lane, Peconic. SCTM#86-7-4.3 Inspected by: Doug Hardy Vote of Council: Ayes: All Motion Carried FISHERS ISLAND MARINA to Amend Wetland Permit #8125 and 8125C to increase the quantity of dredging, 200 cy. over 3,500 sf. The new total dredge quantity and area is 8,850 cy. over 66,500 sf. Located: Central Ave., West Cove, Fishers Island. SCTM#10-1-9 The CAC did not make an inspection, therefore no recommendation was made. 6 John Stein will attend the next regular meeting of the Board of Trustees scheduled for Wed., December 11, 2013 at 5:30 PM. The next meeting of the Conservation Advisory Council has been set for Wed., January 15, 2014 at 4:30 PM at Down's Farm Preserve.
