Box 39 Laurel, NY 11948 Re: Application #14738-03639/00001 Diller Property, 60 Peconic Bay Boulevard, Laurel, NY S.C.T.M. #1000-145-2-1.2 Dear Mr. Diller: Based on the information you have submitted, the Department of Environmental Conservation (DEC) has determined that the property landward of the pre-existing (prior to 8/20/77) bulkhead which is more than 100 feet in length, as shown on the survey prepared by Alden W. Young on June 17,1947 and confirmed on Tidal Wetlands Map #704-536 and infrared aerial photograph #258 is beyond Article 25 (Tidal Wetlands Act) jurisdiction. Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no permit is required. Be advised, however, that no construction, sedimentation, or disturbance of any kind. may take place seaward of the tidal wetlands jurisdictional boundary, as Indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Heslin. 15 Tiffany Place, Apt PH6 Brooklyn, NY 11231 Mr. Heslin proposes the construction of a single family dwelling as depicted in the attached site plan, prepared by RES4 Architecture and dated 4/16/13. The building footprint has been extended to the north and a first floor-level deck and associated access stairs have been added on the sea- ward side. The five conditions of the ZBA's original findings, however, are still met by the pro- posed structure if the stairs to grade from the seaward deck are exempt from inclusion in the set- back calculations.
