Requires Immediate Attention: frothing at this time IL Board and (Office Policies, Practices, and Activities: Review of Code Section 280-13(B 13) At the Special Meeting on December 19, 2013, the Board. discussed Section 280- 13(B)(13) of the Town code with regard to proposed additions to as built accessory structures that qualify for conversion to an accessory apartment by Special Exception of the Board of Appeals (based upon date of CO or Pre-CO). Currently the code dries not permit enlargements of such structures, but rather only their conversion in whole or in part. The ZBA brought this issue to the attention of the Town Board on Jan., 2, 2013 and again on April 18. 2013, where a memorandum from the ZBA was distributed that outlined the history of the accessory apartments in accessory structures created to date, and identified potential conflicts among changing the code to permit additions?enlargements, the likelihood of creating undesirable non- conformance, and the existing code on, accessory structures. After some discussion, the Town Hoard referred the inatter to the Housing Advisory Commission and I provided Phillip Beltz with a copy of the ZBA's memorandtnn. I will be following up Nvith the HAC and reporting back to the ZBA' in early 2014 with a request to appear before the Town Board_ as,/if the Members of the Board of Appeals determine it to be appropriate.
