About 56 years ago, my uncle All Zalinski kept his small boat in the same creek. The creek was beautiful. My uncle's dock was a little cat walk on locust posts. There was still a natural beach with fiddler crabs and eel grass. Now the creek is all bulkheads. The fragile wetland is no longer healthy. There is already too much development on this estuary. Please give nature a chance to heal. Please, do not say "Yes we have to give the property owner something." They already have overdeveloped. Please say no. Thank you. Southold, NY 11971 f T Dear Southold Town Board of Trustees; My name is Anna Barisic. I am 87 years old and I have been living in my home located 6405 New Suffolk Road, New Suffolk New York 11956 since 1971. When I moved to my home, the property behind me was a small marina as it is now, however the building on the property was nothing more than a small guard shack with an indoor parking spot. I remember the old guard who worked there then. I have been widowed since 1985 and do not have a thorough understanding of how the building permitting or property development process works. However I know a growing problem when I see one. Several years later Mr. Michael Withers purchased the property and slowly renovated it over time adding more and more additions until it is what it is today, a large luxurious home which is about three times the size of the original structure. Over the years I have noticed that as this house has grown so has the amount of flooding I have been having in the area of my property from the southeast corner toward the middle of my property adjacent to Mr. Withers property. I did not mention anything because it happened after his house had already been renovated, and before I knew anything about runoff, drywells, groundwater leeching and 1 0 0 things like that. The property along the marina which he owns has always been marshy and wet. I have a friend who spent her childhood summers here in New Suffolk named Fran Pesci who is my age and she remembers running through that property as a child and sinking in the mud like you do near any creek in this area. I am writing to you today because I was notified that Mr. Withers wants to put another very big extension on the property. In addition to blocking my view further I am afraid that if this addition is allowed to be built then my yard will be flooded even worse than it is now, and much more often. Mr. Withers house is already very large and has caused me to suffer problems with water on and around my property. I believe it will cause my property value to go down in value, and it is already affecting the quality of life on my property. My son and two young grandchildren are visiting me and this flooding has been problematic, and I suspect unsanitary since my grandchildren like to play in that part of the yard. Once about three years ago the water came up so high during a rainstorm that it caused a flood in my basement. I never had water in the house before that incident. If this addition goes in then I fear that water in my basement will occur more regularly. I am absolutely against the granting of the permit to increase their house anymore and I do not understand how just requiring drywells to catch the rainwater runoff is sufficient to justify this extension of a building so close to the water. From what I understand, drywells must eventually leech out into the ground they are sitting in. How can this happen when the water table is nearly at the surface all the time? In addition, the plans say that this addition is for an office or studio. Why does an office or studio need a separate bathroom and kitchen? Obviously this is going to be a rental unit with a great view of the creek. This is going to require additional cesspools and more water and waste going into the already saturated 2 ground. This home is occupied by two mature adults. Unless there is a commercial motive behind this extension then I cannot understand why they need such a big place to live. If there is a commercial motive behind this extension then it is not legal in this area. This house is already causing an adverse effect to the marina as its last extension was constructed in 1998, when the laws requiring drywells were not so extensive. If the runoff on my side is so extensive then the runoff on the side of Schoolhouse Creek, which is just a few feet away from his house, must be equally extensive and damaging to the ecology of the waterway. If by some miracle the property does have drywells then please be on notice that they are not working, as even the smallest rainfall causes water to head my way. PROPERTY FACTS/DESCRIPTION• The property is a waterfront property in a Marine II district. It is an irregular shape. The property has 256.67 feet of bulkhead frontage on School House Creek. The property has 75 feet of frontage on New Suffolk Road and is bordered by another piece of property which is 75 feet wide and then continues for an additional 30 feet on New Suffolk Road. On the north side the property goes 125 feet east and then goes 125 feet north. Next the property goes 215.63 feet east. The property then goes 120 feet south and then 85.09 feet west until it hits the bulkhead. The south side of the property runs 234.56 feet from the road until it hits School House Creek. In the middle of the property is a developed lot which has 75 feet of frontage on New Suffolk Road and 155 feet on the south and north sides of the lot and 75 feet on the east side of the lot. On the property there is a 2 story frame house, an accessory frame garage and an accessory frame shed. There are also five floating wood docks and one long wood dock on School House Creek. The existing structure is 20.2 feet away from the bulkhead at its closest point. All is shown on a survey by Nathan Corwin Taft Licensed Land Surveyor dated March 14, 2013. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116(B) based on an application for building permit and the Building inspector's June 13, 2013 Notice of Disapproval concerning a permit to construct additions and alterations to an existing single family dwelling at 1) proposed construction at less than the code required bulkhead setback of 75 feet. ADDITIONAL INFORMATION: The existing accessory shed on the property has a certificate of occupancy to be in its existing location. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 5,2013 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: I. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the proposed addition is characteristic of other residential properties in the neighborhood in both scale and design. It will not be seen from the street. This property is a unique lot in that it is a Marine II property with accompanying boat docks. Many of the houses in this neighborhood are older and are within 75 feet from a bulkhead. The proposed addition will not be less conforming to the code than the existing structure already is. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The entire structure is located within 75 feet of the bulkhead and would need a variance for any proposed addition. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 53%relief from the code. However, the proposed addition is a one-story addition located behind the house at the furthest distance from the bulkhead as possible. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the proposed construction must retain all water on site via new drywells and must comply with all best management practices for storm water runoff during construction. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
