SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 4, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Parcel is improved with a one and two story home, accessory in ground swimming pool and two accessory storage sheds. It is located in the R40 zone district and contains 23,145 sq. ft. Parcel has three front yards, with 82.19 feet of frontage on S.R. 25, 298.18 feet on Cedar Lane, 77.55 feet on Cedar Lane to the south and 286.91 feet along the western property line as shown on the survey dated October 20, 2013 prepared by John Metzger, LLS. BASIS OF APPLICATION: Request for Variances from Article III Code Section 280-15 and the Building Inspector's September 5, 2013 Notice of Disapproval based on an application for building permit for "as Built" in- ground swimming pool and `as Built' shed, at; 1) in-ground swimming pool in location other than code required rear yard, 2) accessory shed in location other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances for an as built in-ground swimming pool with raised patio located in the front yard and not in the location granted under ZBA#2128 and the building permit and "as built" accessory shed in the front yard. ADDITIONAL INFORMATION: This property was the subject of two ZBA variance hearings. The first on January 12, 1972 file 41491 granted front and rear yard setbacks for the dwelling. The second on May 2, 1976 file #2128 granted the location of an in-ground swimming pool in the front yard on the south side of the dwelling and in-line with the dwelling. Applicant was issued building permit #8606Z to install the swimming pool, however it Page 2 of 3 - December 19, 2013 ZBAN6703 - Papastefanou SCTM41000-31-6-30 was placed in the wrong location and a raised patio was constructed around it along with the accessory shed that houses the pool equipment. At the hearing the owner indicated that he would agree to remove the shed and replace it with a sound deadening cabinet to house the pool equipment. It was also noted at the hearing that the second shed on the subject property is in a non-conforming front yard location. The applicant stated he would relocate the shed to the south side of the dwelling, in the architectural rear yard and within the boundaries of the pool fence, so it would be in a more conforming location, albeit still technically a front yard. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)M. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The swimming pool was constructed in the wrong location and has been there since 1976 without any negative impacts. The accessory shed can be reduced in size and become more conforming. The pool area is visually enclosed by landscaping and most of the property is surrounded by lavender fields rather than dwellings. 2. Town Law 4267-150)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject property has three front yards and a very narrow and non-functional rear yard making conforming locations for accessory structures virtually impossible. The swimming pool is existing and would be a costly hardship to relocate. The sheds on the property by alternative relief can be relocated and reduced in size to be more conforming to the code. 3. Town Law. 267-b(3)(b)(3) The variances requested therein are mathematically significant representing a 100% relief from present code requirements. The applicant was granted a variance for the front yard location of the swimming pool. However, it was placed in the wrong location by error. The shed will be reduced to a conforming small sound deadening structure and the other shed will be re-located to a more conforming location. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-15(3)(6)(5). The difficulty has been self-created. It was the applicant's responsibility to oversee that the placement of the swimming pool was done in accordance to the variance that was granted. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate is the minimum action necessary to enable the applicant to enjoy the benefit of the existing in-ground swimming pool with raised patio and the reduced shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance as applied for the in-ground swimming pool with raised patio and DENY as applied for the shed, and GRANT ALTERNATIVE RELIEF as noted below: The shed closest to Cedar Lane shall be replaced with a sound deadening structure to cover the pool equipment, not to exceed four feet in height above grade. The 8.2X8.3 shed on the western property line shall be relocated to the south side of the dwelling, within the area fenced in for the swimming pool. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board: Ayes. The proposed 10'x 10' shed is approved in the proposed location as hand drawn on the submitted survey. However, since the intent of the Board's decision was to move the as built 8' x 8' shed to a more conforming location, and since the applicant cannot do so without the shed falling apart, the 8' x 8' shed must be demolished and removed from the subject property. The owner has contacted the shed company and the following is proposed: 1. The pool equipment enclosure will be 4' x 4' x 6' (with a shed roof - dog house design). 2. The 8' x 8' shed can not be moved without falling apart. As was discussed at the hearing, there is no garage and a storage shed is needed. The owner wishes to replace the storage shed with a 100' x 100' shed, located on the south side of the house, inside the fence. in the location of the "play set" which is being removed. Enclosed is the survey with the proposed location of the shed, on the south side of the house. There is a large tree located inside the fence,on the south which would prevent the placement of the shed closer to Cedar Lane (Southerly Right of Way). Since neither structure requires a building permit, but must conform to the ZBA decision, we respectfully request that the structures be reviewed for compliance prior to the owner purchasing the structures. Name of Owner: Steve & Edith Papastefanou ZBA File # RECEIVED REASONS FOR APPEAL (additional sheets may be used with Preparer's sienature): O C T 2 2 2013 AREA VARIANCE REASONS: BOARD OF APPEALS (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: (3) The amount of relief requested is not substantial because: Appeal no 2128 5/20/76 was to construct an accessory in-ground pool in a "front yard" (a copy of the appeal and transcript are attached. In the transcript of the hearing the ZBA recognized that this property contains 3 front yards, the lot is long and narrow, and the swimming pool can only be located in a "front yard". The neighbors in 1976 appeared to oppose placement of the pool on the Main Road, north side of the property. However, the pool company, who was representing the owner agreed to place the pool "on the south side of the house and place a fence which was no less than 5 feet". This was recommended and supported by the neighbors. No survey was required by the building department for the house or pool. The pool is screened from all of the property lines by the Zoning Board approved fence. The pool company obtained the building permit and handled the permit process. We suspect that when the pool company began construction of the pool directly behind the house they found the cesspool. The pool was shifted away from the cesspool, closer to the right-of-way. Cedar Lane is a private dirt road and identified as a "right-of-way". The pool company had complied with the Town's procedures and in 1976 a relocation of the pool, due to the cesspool, would have been approved as a de minimis change without paperwork. The pool continued to comply with the ZBA condition that it be located south of the house. The patio around the pool and the pool were constructed at the same time in 1976. The in-ground pool was constructed "at grade" with a cement patio. The northerly side of the patio begins at grade but the yard slopes down to the south requiring a retaining wall for the patio and pool to remain level at grade. The patio and retaining wall were constructed in 1976 with the pool. The patio was resurfaced with brick pavers more than 10 years ago. According to the notice of disapproval for the 1976 variance, Section 100-30 C and 100-32 were appealed. The ordinance required the accessory structure in the "rear yard" and 3' from any property lines. Having received the variance for the location of the pool "on the south side of the house", the set back of the pool could be as close as 3' from "any lot line". Therefor the shifting of the pool to avoid the cesspool was permitted and no additional variances were required. A copy of the 1976 Zoning Ordinance is herein attached. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The property is fully developed, is screened with mature vegetation, the pool, patio and shed are not visible from any street. The surrounding community has developed with the existing pool, patio and shed. The neighborhood and the owners believed that they had cols for the pool. The shed contains the pool equipment as well as additional storage, a shed generally does not need a permit if it is less than 100 sq. ft., but because this property has three "front yards" the shed requires a variance. Gardener's Bay Estates is pre- existing nonconforming subdivision. The parcel has three front yards (Main Road and two property lines on Cedar Lane) The house was constructed in 1972 and the pool and patio was constructed after variances issued in 1976. The property has remained as it is today since 1976. The existing cement patios was "refaced" with thin cut brick which does not require a building permit.
