(631) 765-1809 • Fax (631) 765-9064 /y==»»{{C`O° Sout old Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 19, 2013 ZBA FILE # 6706 NAME OF APPLICANT: Timothy McManus S.C.T.M. # 1000-118-04-005 PROPERTY LOCATION: 7725 Nassau Point Road (adj. to Little Peconic Bay), Cutchogue, NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 15, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 26, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTSMESCRIPTION: The property is an improved non-conforming 39,131 square foot parcel located in the R40 Zone district. It has 100.1 feet of bulkhead frontage on Little Peconic Bay. The bulkhead is a two tiered bulk head system. The property runs 393.31 feet on Southern property line, 100.15 frontage on Nassau Point Road, and 389.42 feet on the Northern property line. It contains a single family dwelling and an accessory beach house with substantial storm damage. All is shown on a site plan by Thomas C. Samuels, Architect dated 4- 6-12 and last revised 10-8-13. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116 (B) and the Building Inspector's October 18, 2013 Notice of Disapproval based on an application for building permit for renovation of a cabana/shower and construct new decking, at; 1) less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variance to renovate an existing cabana and construct a new attached deck that was damaged due to a storm. The applicant proposes the deck at 0 feet from the bulkhead where the code requires 75 feet Page 2 of 3 - December 19, 2013 ZBA#6706 - McManus SCTM# 1000- 1184-5 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on December 16, 2013 submitted a plan to relocate the structure out of the VE flood zone so that it is entirely in the X flood Zone, thereby increasing the cabana setback to the bulkhead and bringing the plan into more conformity with the codes. The applicant also agreed to create an outside entrance to the shower area and eliminate any access to the shower from the interior of the cabana. ADDITIONAL INFORMATION: The existing beach cabana has a Pre Existing Certificate of Occupancy No. x- 25215 dated September 2, 1997. Testimony was taken that the shower area inside the subject cabana existed at the time the certificate of occupancy was issued. This accessory cabana and attached deck were severely damaged during super storm Sandy. Photographs as well as visual inspection show that the building is in disrepair. James J. Deerkoski a Licensed Professional Engineer stated in a letter dated September 26 2013 that 58% of the original structure is salvageable. Based on his review of the architectural plans and a site inspection James J. Deerkoski writes; "Based upon the inspection, the floor and the east wall must be replaced." James J. Deerkoski makes the following specific calculations in his letter: 1. The contractor should be able to renovate the structure retaining the roof, rear wall (west) and side walls, which is 58% of the structure. 2.) If the contractor is unable to retain one of the side walls, then 50% of the original structure would remain. 3.) If the contractor is unable to retain both side walls, then 42% of the structure would remain." (see letter by James J. Deerkoski dated September 26, 2013). In addition to the architectural plans and letter by the engineer, a visual site inspection by the Zoning Board Members revealed that the subject accessory cabana is sitting below the level of the water-front bulkhead and the level of fill installed between the water front bulkhead and the landward bulkhead. Testimony was taken that the structure would need to be raised up to the level of the reconstructed deck and that if that was not structurally possible due to the severity of the damage, then a step down from the reconstructed deck to the renovated cabana would be required. The applicant stated that the structure is for seasonal use and that it will not be heated. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The structure is legally established and pre- dates zoning. It is being moved out of its partial placement in the VE Flood Zone and completely into the X Flood Zone. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject deck existed at a 0 (zero) foot setback from the bulkhead prior to being demolished by storm damage and the applicant cannot reconstruct it without a variance since the code requires all structures to be setback a minimum of 75 feet from a bulkhead. 3. Town Law 5267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the proposed reconstructed attached deck and renovated accessory cabana have been in their non-conforming locations since before town zoning and were legally established with the issuance of a CO. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Page 3 of 3 - December 19, 2013 ZBA#6706 - McManus SCTM#1000-118-4-5 applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install a lifting station in order to dispose of waste. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory cabana with attached deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dames, seconded by Member Schneider, and duly carried, to DENY as applied for, and GRANT ALTERNATIVE RELIEF as follows: The beach structure must be renovated so that it is entirely in the Zone X flood zone and not in VE flood zone as shown on the AMENDED survey dated March, 27, 2012 last revised December 6, 2013 prepared by Nathan Taft Corwin, III, LS., and floor plan titled Existing Cabana dated 8/17/12 sheet No. 4, stamped received by the ZBA December 16, 2013 to show modification to the shower access. CONDITIONS: 1.) The applicant shall install a waste lifting station as per architectural/site plans. 2.) The applicant shall install leaders and gutter on the accessory cabana to handle storm water runoff. 3.) The accessory cabana shall be for seasonal use and shall not be heated. 4.) The shower shall be accessed only from the exterior of the accessory cabana Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Vote of the Board.
