Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: JOHN & ELVIRA ALOIA 8145 NASSAU POINT ROAD, CUTCHOGUE SCTM# 118-4-9 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 13, 2013 regarding the above matter: WHEREAS, En-Consultants on behalf of JOHN & ELVIRA ALOIA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 17, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to construct approximately 99 linear feet of vinyl bulkhead in-place of existing timber bulkhead; backfill with approximately 15 cubic yards clean sand fill to be trucked in from an approved upland source remove; replace steps at bottom of existing stairway down embankment; and remove and reattach existing +/-3'x7' steps to beach to new bulkhead be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to remove and replace existing +/-16'x24' on-grade wood deck and +/-13'x20' on-grade masonry patio, both adjacent to bulkhead be found Inconsistent with the LWRP, and, 2 • • WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policies 4.1 & 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: the removal of the on-grade masonry patio; the use of open-grate capping on bulkhead; replace deck using 3/8" spacing between deck boards; and slope to be restored to match neighbor's slope to the north using native vegetation; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 13, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of JOHN & ELVIRA ALOIA to construct approximately 99 linear feet of vinyl bulkhead in-place of existing timber bulkhead; backfill with approximately 15 cubic yards clean sand fill to be trucked in from an approved upland source; remove and replace existing +/-16'x24' on- grade wood deck adjacent to bulkhead; remove and replace steps at bottom of existing stairway down embankment; and remove and reattach existing +/-3'x7' steps to beach to new bulkhead; with the conditions the slope be restored to match angle of neighbor's slope to the north and re-vegetate using native vegetation; the use of open-grate capping on bulkhead; replace deck using 3/8" spacing between deck boards; and the removal of +/-13'x20' on-grade masonry patio; and as depicted on the site plan prepared by En-Consultants, last dated November 15, 2013, and stamped approved on December 6, 2013. Cutchogue, NY 11935 RE: DR. JOHN & VERA ALOIA 8145 NASSAU POINT RD., CUTCHOGUE. SCTM#118-4-9 Dear Ms. Steelman: The Southold Town Board of Trustees reviewed the site plan prepared by Nancy L. Steelman, R.A. dated January 14, 2008 and determined the construction of a garage to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal to is CONSISTENT with the LWRP. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The majority of the portion and the patio and deck are located in the FEMA flood zone VE (Coastal flood with velocity hazard (wave action); base flood elevations determined) and does not meet this policy.
