All that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being at
Mattituck, Town of Southold, County of Suffolk and State of New
York, more particularly bounded and described as follows :
BEGINNING at a point in the easterly line of a 50 ' right of way
which point is is the following 2 courses and distances as measured
along the northerly and easterly lines of said right of way from the
westerly line of Cox Neck Road at the southeast corner of land of
Joseph P. Wanat and Eleanor Wanat;
1 . South 74 33 ' 40" West 258. 16 feet;
2. North 000 59 ' 40" West 164.41 feet;
RUNNING THENCE from the point of beginning North 000 59 ' 40" West
100.00 feet along the easterly line of said right of way to a
point;
RUNNING THENCE North 89° 00 ' 20" East 125 .00 feet to a point and the
northwest corner of land of Theodore R. Wells, Jr. and Rita Wells;
RUNNING THENCE South 00° 59 ' 40" East 100.00 feet along last
mentioned land to a point and the northwest corner of land of Joseph

Neck Road:

BEGINNING.
RESERVING unto the sellers , their heirs and assigns, an easement for
ingress and egress and for public utility purposes in, over and
along said easement area and the right to grant easements over the
aforesaid easement area to others for ingress and egress and public
utility purposes.
The parcel hereby conveyed shall merge with premises of the grantee
contiguous thereto on the east and the 2 parcels shall thereupon be
deemed to be 1 parcel for purposes of the zoning ordinance of the
Town of Southold, so that under the present provisions of the zoning
ordinance of the Town of Southold only 1 residence, together with
accessory structures, may be constructed and maintained upon the
said 2 parcels which are being merged into 1 parcel. This
requirement of this covenant and restriction shall remain effective
only so 'long as the Town of Southold requires said 2 parcels to
