Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: ARTHUR & JULIANE GRUNEISEL 2875 PINE TREE ROAD, CUTCHOGUE SCTM# 104-3-7 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 16, 2013 and again on Wednesday, November 13, 2013 regarding the above matter: WHEREAS, En-Consultants on behalf of ARTHUR & JULIANE GRUNEISEL applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 30, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6, 6.1, 6.2, 9 & 9.4 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the use of open- grate decking on the dock; dock configuration changed into an "L" shape; and removal of proposed tie-off piles; and 2 0 • WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 16, 2013 and again on November 13, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of ARTHUR & JULIANE GRUNEISEL to construct an elevated 4'x44' fixed timber catwalk equipped with (2) sets of 4'x4' timber steps on landward end to allow for passage along shoreline; a 3'x14' hinged ramp; and a 6'x20' float (with a 4'x2' ramp pad on inboard side of float) secured by (2) pairs of 8" dolphin pilings; with the condition of the use of open-grate decking on dock, and as depicted on the site plan prepared by En-Consultants, last dated November 15, 2013, and stamped approved on December 6, 2013. As modified, the dock's overall intrusion into the waterway seaward of apparent low water has been reduced by approximately I1 feet such that the dock plus a boat with a 12' beam would occupy roughly 34 feet of the creek,roughly one fourth of the width of the waterway at low tide. I trust the Board will find this revised plan consistent with our discussions at the October hearing and can vote favorably upon the amended application at your November meeting. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 1. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navigation, recreation, and other public trust purposes, including the incidental rights of public anchoring. Piers, docking facilities, and catwalks must not result in an unnecessary interference with use of public trust lands. Alternatives to long piers or docks include use of dinghies to reach moored boats and mooring in nearby marinas. Dredging solely to accommodate the draft of larger boats is not a recommended alternative. The fixed catwalk will be located in a historically trodden path that is presently devoid of wetlands vegetation,and so placement of the elevated catwalk should allow for marsh vegetation to recover underneath it. The dock will be located in the portion of property that was permitted by the Trustees to be dredged out in the late 1960s(Trustee permits 437 &478)will be situated well within the allowable seaward intrusion into Little Creek of 1/3 the width of the waterway during low tide, and the deck will be constructed with untreated decking. Therefore,the project has been designed to minimize and potential physical loss, degradation,or functional loss of ecological components and will thus be consistent with Policy 6 and the statutory and regulatory requirements of the New York State Tidal Wetlands Act and Chapter 275 of the Town Code.
