TERMS AND CONDITIONS
The Permittee, Arthur&Juliane Gruneisel residing at 2875 Pine Tree Road,Cutchogue,New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
l. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and?the said Permittee wHl,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the,Board of '
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board ata later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to r,
maintain the structure or project involved,to provide evidence to anyone concerned that tt"r
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board. t "

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 16, 2013 and again on Wednesday, November 13, 2013
regarding the above matter:
WHEREAS, En-Consultants on behalf of ARTHUR & JULIANE GRUNEISEL applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated September 30, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6, 6.1, 6.2, 9 & 9.4 of the
Local Waterfront Revitalization Program to the greatest extent possible through the
imposition of the following Best Management Practice requirements: the use of open-
grate decking on the dock; dock configuration changed into an "L" shape; and removal
of proposed tie-off piles; and

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 16, 2013 and again on November 13, 2013, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of ARTHUR &
JULIANE GRUNEISEL to construct an elevated 4'x44' fixed timber catwalk equipped
with (2) sets of 4'x4' timber steps on landward end to allow for passage along shoreline;
a 3'x14' hinged ramp; and a 6'x20' float (with a 4'x2' ramp pad on inboard side of float)
secured by (2) pairs of 8" dolphin pilings; with the condition of the use of open-grate
decking on dock, and as depicted on the site plan prepared by En-Consultants, last
dated November 15, 2013, and stamped approved on December 6, 2013.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Dear Mr. King:
Pursuant to our discussions during the public hearing held on the captioned application last
month, please find attached three (3) copies of a project plan prepared by En-Consultants, last
dated October 25, 2013, which has been revised according to the following project description:
"Construct a fixed timber dock, consisting of a 4' x 44' fixed elevated catwalk (with (2)
sets of 4' x 4' steps at its landward end for access along shore); a 3' x 14' hinged ramp;
and a 6' x 20' float (plus a 4' x 2' ramp pad on the inboard side of the float) secured by
(2) pairs of 8" dolphin pilings, all as depicted on the project plan prepared by En-
Consultants, last dated October 25, 2013."
As modified, the dock's overall intrusion into the waterway seaward of apparent low water has
been reduced by approximately I1 feet such that the dock plus a boat with a 12' beam would
occupy roughly 34 feet of the creek,roughly one fourth of the width of the waterway at low tide.
I trust the Board will find this revised plan consistent with our discussions at the October hearing
and can vote favorably upon the amended application at your November meeting.

Amanda, as discussed today, please find attached 1) plan view,2) enlarged plan view, and 3) profile view of the
proposed dock revised in accordance with my discussions with the Board during last month's public
hearing. Specifically,the dock has been reconfigured as an "L" shaped dock that will extend 11 fewer feet into Little
Creek; the tie-off pilings have been removed;dolphin piles are proposed to secure the float;and due to the change to an
"L" shape,a 4' x 2' "ramp pad" extension has been added to the inboard side of the float. This revised configuration has
also been staked out for the Trustees'field inspections.
If the Trustees feel that this revised plan can meet with their approval, I will finalize the plans with notes,title block, etc.,
and forward hard copies to you before the end of this week in time for next week's public hearing.

En-Consultants on behalf of ARTHUR & JULIANE GRUNEISEL requests a Wetland Permit to

landward end to allow for passage along shoreline; a 3'x14' hinged ramp; and a 6'x20' float secured by
(3) 8" diameter pilings; and install (2) 8" diameter tie-off piles off south side of float. Located: 2875 Pine

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that proposed actions are
INCONSISTENT with the denoted following LWRP Policy Standards as outlined below and therefore is
INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including
Significant Coastal Fish and Wildlife Habitats and wetlands.
6.1 Protect and restore ecological quality throughout the Town of Southold.
6.2 Protect vulnerable fish, wildlife, and plant species, and rare ecological communities.
The action is proposed to be located within a New York Department of Significant Coastal Fish
and Wildlife Habitat area. The construction of dock structures in these areas results in the loss
of littoral and marine habitats.
Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public
resources of the Town of Southold.
9.4 Assure public access to public trust lands and navigable waters.
E. Provide access to, and reasonable recreational use of, navigable waters and public trust
lands under water.
1. Provide for free and unobstructed public use of all navigable waters below the line of mean
high water for navigation, recreation, and other public trust purposes, including the incidental
rights of public anchoring.
Piers, docking facilities, and catwalks must not result in an unnecessary interference
with use of public trust lands. Alternatives to long piers or docks include use of dinghies
to reach moored boats and mooring in nearby marinas. Dredging solely to
accommodate the draft of larger boats is not a recommended alternative.
The use of the waterway is public; the proposed action is private, noncommercial and will not
preserve "public" access or public recreational activities.

The project consists of construction of a fixed timber dock similar in design,scope,and seaward intrusion to numerous
similar docks located along the same and opposite shorelines and therefore will not cause any fragmentation of ecological
communities.The fixed catwalk will be located in a historically trodden path that is presently devoid of wetlands
vegetation,and so placement of the elevated catwalk should allow for marsh vegetation to recover underneath it. The
dock will be located in the portion of property that was permitted by the Trustees to be dredged out in the late 1960s
(Trustee permits 437&478)and will be situated well within the allowable seaward intrusion into Little Creek of 1/3 the
width of the waterway at mean lower low water. And the deck will be constructed with untreated decking. Therefore,the
project has been designed to minimize any potential physical loss,degradation,or functional loss of ecological
components and will have no adverse impacts on the adjacent tidal wetlands or waters of the Town. It should also be
noted that on June 19,2013 the Board of Trustees transferred Wetland Permit No.495 to the applicants,authorizing
installation of a 8'x 14'floating dock,and so the proposal contained herein is intended to replace that approval.

LWRP Policy 6:
The project consists of construction of a fixed timber dock similar in design, scope, and seaward intrusion
to numerous similar docks located along the same and opposite shorelines and therefore will not cause
any fragmentation of ecological communities. The fixed catwalk will be located in a historically trodden
path that is presently devoid of wetlands vegetation,and so placement of the elevated catwalk should
allow for marsh vegetation to recover underneath it. The dock will be located in the portion of property
that was permitted by the Trustees to be dredged out in the late 1960s(Trustee permits 437 &478)will be
situated well within the allowable seaward intrusion into Little Creek of 1/3 the width of the waterway
during low tide, and the deck will be constructed with untreated decking. Therefore,the project has been
designed to minimize and potential physical loss, degradation,or functional loss of ecological
components and will thus be consistent with Policy 6 and the statutory and regulatory requirements of the
New York State Tidal Wetlands Act and Chapter 275 of the Town Code. (The project requires
modification of the existing Trustees permit authorizing installation of an 8' x 14' floating dock).
