James Rich: I call to order this November 4, 2013 Southold Town Planning Board
Public Meeting. Our first order of business is to set Monday, December 16, 2013 at
4:30 p.m. at the Southold Town Hall, Main Road, Southold as the time and place for
the next regular Planning Board Meeting.

amended site plan is proposed to include an existing 12,072 sq. ft. multi-use warehouse
with 25 parking stalls including 1 ADA on 1.3 acres in the LI Zoning District. The
property is located at 12820 Oregon Road, Cutchogue. SCTM#1000-83-3-4.6
James Rich: WHEREAS, on October 4, 2013, the applicant submitted an amended
application for site plan review; and
WHEREAS, on February 15, 2013, the agent for the applicant, Martin Sendlewski,
submitted an application for site plan review; and
WHEREAS, in conjunction with the proposed subdivision, this amended site plan is
proposed to include an existing 12,072 sq. ft. multi-use warehouse with 25 parking

SUBDIVISIONS - FINAL DETERMINATIONS
Rand/Bight Road, LLC - This proposed Lot Line Change will transfer 0.15 acres from
SCTM#1000-14-02-11.4 & 11.6 to SCTM#1000-14-02-11.5. Lot 11.5 will increase from
1.14 acres to 1.30 acres. Lot 11.4 will decrease from 1.0 acre to 0.92 acres, and Lot
11.6 will decrease from 0.99 acres to 0.92 acres, all located in the R-40 Zoning District.
The property is located at 1085 Bight Road, on the w/s/o Bight Road approximately 11'
s/o Petty's Drive, Orient.
Martin Sidor: WHEREAS, this proposed Lot Line Change will transfer 0.15 acres from
SCTM#1000-14-02-11.4 & 11.6 to SCTM#1000-14-02-11.5. Lot 11.5 will increase from
1.14 acres to 1.30 acres. Lot 11.4 will decrease from 1 acre to 0.92 acres, and Lot
11.6 will decrease from 0.99 acres to 0.92 acres located in the R-40 Zoning District, and
WHEREAS, on June 20, 2013, a Lot Line Modification Application was submitted; and
WHEREAS, on July 15, 2013, the Planning Board, at their Work Session, reviewed the
application and found it complete with items to be submitted immediately; and
WHEREAS, on July 18, 2013, referrals were sent out to all applicable agencies; and
WHEREAS, on July 26, 2013, the agent submitted draft deeds as requested by the
Planning Board; and
WHEREAS, on August 12, 2013, the Suffolk County Planning Commission responded
to the referral stating that "the application is considered a matter of local determination;"
and
WHEREAS, on August 21, 2013, the Orient Fire District responded to the referral
stating: "The district does not foresee any problems resulting from this change, or any
other concerns regarding the application;" and
WHEREAS, on August 22, 2013, the Local Waterfront Revitalization Coordinator found
the application exempt from the Local Waterfront Revitalization Program; and
WHEREAS, on September 9, 2013, the Planning Board set the public hearing; and
WHEREAS, on October 7, 2013, the Planning Board held and closed the public
hearing; and

WHEREAS, on October 21, 2013, the Planning Board, at their Work Session, reviewed
and accepted all referrals received from agencies; and
WHEREAS, the Southold Town Planning Board, pursuant to Town Code §240-56,
Waivers of Certain Provisions, may waive certain elements of the subdivision review if
in its judgment they are not requisite in the interest of the public health, safety and
general welfare. After reviewing the information submitted for this application, the
Planning Board has determined that it is eligible for a waiver of the Environmental
Resources Site Analysis Plan (ERSAP), the Primary and Secondary Conservation Area
Plan, the public hearing, and the Sketch Plan and Preliminary Plat steps of the
subdivision process for the following reasons:
1. No new lots are being created;
2. No changes will occur as a result of this lot line change that would adversely
affect the character of the neighborhood; and
WHEREAS, the Planning Board performed an uncoordinated review of this Unlisted
Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental
Quality Review Act (SEQRA); and
WHEREAS, pursuant to the Lot Line Modification Policy set by the Planning Board in
February 2011, this application is eligible for decision from the Planning Board prior to
receiving approval by the Suffolk County Department of Health Services (SCDHS) as it
meets the following criterion set forth in that policy:
• Where no new development potential will be created in the parcel to which the
land is transferred; and
WHEREAS, on October 21, 2013, the Planning Board, at their Work Session,
determined that the proposed action meets all the necessary requirements of Town
Code §240-57 for a Lot Line Modification; be it therefore
RESOLVED, that the Planning Board, pursuant to SEQRA, hereby makes a
determination of non-significance for the proposed Lot Line Modification and grants a
Negative Declaration;

APPROVAL EXTENSIONS
Twin Forks Landscape Contracting - This site plan is for the construction of a 6,000
sq. ft. addition to an existing 1,263 sq. ft. building having a total of 7,263 sq. ft. of
building for a contractor's yard on a one-acre parcel in the Light Industrial Zoning
District. The property is located at 8405 Cox Lane, ±560' southeast of Oregon Road,
Cutchogue. SCTM#1000-83-3-8
William Cremers: WHEREAS, this approved site plan is for the construction of a 6,000
sq. ft. addition to an existing 1,263 sq. ft. building having a total of 7,263 sq. ft. of
building for a contractor's yard on a one-acre parcel in the Light Industrial Zoning
District; and
WHEREAS, at a Work Session held on February 6, 2012, the Planning Board accepted
the application for review; and
WHEREAS, on March 12, 2012, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, performed a coordinated review of this
Unlisted Action and, as lead agency, made a determination of non-significance and
grants a Negative Declaration; and
WHEREAS, on March 12, 2012, the Southold Town Planning Board granted approval
on the site plan entitled "Twin Forks Landscape Contracting", prepared by James J.
Deerkoski, on November 10, 2009; and
WHEREAS, on September 12, 2013, the site plan approval expired; and
WHEREAS, on October 21, 2013, the owner and applicant, William J. Fabb, submitted
a request for an Extension of Site Plan Approval; and
WHEREAS, at their October 21, 2013 Work Session, the Planning Board reviewed the
original site plan approval in light of any new Town Code requirements and found that
the site plan remains in compliance; be it therefore,
RESOLVED, that the Southold Town Planning Board grants an Extension of Site
Plan Approval from September 12, 2013 to September 12, 2014 on the site plan
entitled "Twin Forks Landscape Contracting" prepared by James J. Deerkoski on
November 10, 2009.

BOND DETERMINATIONS- Accept Bond Estimate
Aries Estates - This proposal is for a standard subdivision of an 11.4-acre parcel into
two lots where Lot 1 equals 5.7 acres, including 3.3 acres of open space, and Lot 2
equals 5.7 acres, including 3.2 acres of open space, in the R-80 Zoning District. The
property is located approximately 334.1' to the east of Stars Road in East Marion.

District; and
WHEREAS, on October 11, 2013, the Office of the Town Engineer submitted a Draft
Bond Estimate for Aries Estates/Shawn Tully in the amount of $34,520; be it therefore
RESOLVED, that the Southold Town Planning Board hereby accepts the Draft Bond
Estimate for Aries Estates/Shawn Tully in the amount of $34,520 and recommends
the same to the Southold Town Board.

SITE PLAN DETERMINATIONS
Joint Industry Board of the Electrical Industry Pavilion - This amended site plan is
for the proposed construction of a 30'x 50' (1,500 sq. ft.) pavilion with no walls and
drainage on 16.6 acres in the RR Zoning District. The property is located at 3800 Duck
Pond Road, ±450' northeast of Duck Pond Rd & Vista Place, Cutchogue. SCTM#1000-
83-2-17.3
James Rich: WHEREAS, this amended site plan is for the proposed construction of a
30'x 50' (1,500 sq. ft.) pavilion with no walls and drainage on 16.6 acres in the RR
Zoning District, Cutchogue; and
WHEREAS, on July 18, 2013, the agent for the applicant, Jeffrey Butler, submitted an
application for site plan review; and
WHEREAS, on August 19, 2013, the Planning Board accepted the application for
review; and
WHEREAS, on August 21, 2013, the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the application to the required agencies for their comments;
and
WHEREAS, on August 22, 2013, the Southold Town Architectural Review Committee
reviewed the proposed project and approved of its design as submitted; and
WHEREAS, this application proposes less than 5,000 sq. ft. of new or renovated floor
area and is therefore exempt from review by the Suffolk County Planning Commission
(SCPC); and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review (SEAR) 6 NYCRR, Part 617.5, has determined that the proposed action
is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5 (c)
(7) "construction or expansion of a primary or accessory/appurtenant, non-residential
structure or facility involving less than 4,000 sq. ft. of gross floor area and not
involving a change in zoning or a use variance and consistent with local land use
controls, but not radio communication or microwave transmission facilities" therefore,
not subject to SEQRA review; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131 B (5), has the discretion to vary or waive the parking requirements for Site
Plan Applications where doing so would not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the Site Plan Requirements chapter of the Town Code. The Planning Board

has found that this application is eligible for a waiver of parking requirements because
there is no need to provide for parking - the proposed pavilion is for the use of the
guests of the hotel on site and will not be open to the public. Fifty-five (55) parking
stalls including three (3) ADA exist on site; and
WHEREAS, on September 20, 2013, the Southold Town Fire Inspector reviewed and
determined that there was adequate fire protection and emergency access for the site;
and
WHEREAS, on September 20, 2013, the Cutchogue Fire District determined there was
adequate fire protection for the site and all necessary equipment and apparatus will be
able to safely maneuver on site; and
WHEREAS, on September 24, 2013, the Southold Town Engineer reviewed the above-
referenced application and determined that the Storm Water Management Control Plan
meets the minimum requirements of Chapter 236 for Storm Water Management; and
WHEREAS, on October 7, 2013, a public hearing was held and closed; and
WHEREAS, as stated on the public hearing record by Jeffrey T. Butler, agent, the open
air structure will be used in conjunction with the existing uses on site including the
swimming pool area for sitting outdoors in the shade and will not increase the number
of the people that visit the site; and
WHEREAS, on October 18, 2013, the Town of Southold LWRP Coordinator reviewed
the above-referenced project and has recommended the proposed project be found
consistent with Southold Town LWRP policies; and
WHEREAS, on October 25, 2013, the Southold Town Chief Building Inspector reviewed
and certified the proposed pavilion as a permitted use in the Resort Residential Zoning
District; and
WHEREAS, on November 4, 2013, the Southold Town Planning Board determined that
all applicable requirements of the Site Plan Regulations, Article XXIV, §280 - Site Plan
Approval of the Town of Southold, have been met; be it therefore,
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold Local Waterfront
Revitalization Program;

William Cremers: WHEREAS, on November 10, 2009, William Kelly, agent to the
applicant, submitted an application for site plan review; and
WHEREAS, on December 8, 2009, the Planning Board reviewed the application and
determined it incomplete, requiring further information and revisions to the site plan;
and
WHEREAS, on November 27, 2012, William Kelly, agent to the applicant, submitted a
revised application for site plan review; and
WHEREAS, on December 19, 2012, the Planning Board reviewed the application and
determined it incomplete, requiring further information and revisions to the site plan;
and
WHEREAS, on January 23, 2013, William Kelly, agent to the applicant, submitted a
revised application for site plan review proposing a 6,000 sq. ft. building where the
original application was for a 2,520 sq. ft. building; and
WHEREAS, on January 30, 2013, the Planning Board received the information required
to make the application complete and accepted the application for review; and
WHEREAS, on February 22, 2013, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and
WHEREAS, the Planning Board performed a coordinated review of this Unlisted Action
pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality
Review Act (SEQRA); and
WHEREAS, on March 1, 2013, the Southold Town Fire Inspector reviewed and
determined that there was adequate fire protection and emergency access for the site;
and
WHEREAS, on March 1, 2013, the Cutchogue Fire District determined there was
adequate fire protection for the site; and
WHEREAS, on March 8, 2013, the Southold Town Architectural Review Committee

above-referenced project and has determined the proposed project to be consistent
with Southold Town LWRP policies; and
WHEREAS, on April 18, 2013, the Southold Town Engineer reviewed the above-
referenced application and required additional information regarding the proposed
drainage schematic pursuant to Chapter 236 for Storm Water Management; and
WHEREAS, on May 7, 2013, the Planning Board, pursuant to the State Environmental
Quality Review Act §617.6, established itself as lead agency for this Unlisted Action;
and
WHEREAS, on May 30, 2013, the applicant submitted a copy of the site plan approved
and stamped by the Suffolk County Department of Health Services (SCDHS) on May
17, 2012 for "Warehouse and Office Space @ 239 gpd" under Reference Number C10-
09-0008; and
WHEREAS, on June 3, 2013, the Planning Board, pursuant to SEQRA, made a
determination of non-significance for the proposed action and granted a Negative
Declaration; and
WHEREAS, on July 11, 2013, William Kelly, agent to the applicant, submitted another
revised application for site plan review proposing to reduce the size of the building from
6,000 sq. ft. to 5,820 sq. ft.; and
WHEREAS, on August 23, 2013, the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the revised application to the Town Engineer and Chief
Building Inspector for their comments; and
WHEREAS, on September 19, 2013, the Southold Town Engineer reviewed the above-
referenced application and determined that the proposed drainage meets the minimum
requirements of Chapter 236 for Storm Water Management; and
WHEREAS, on November 4, 2013, the Southold Town Planning Board determined that
all applicable requirements of the Site Plan Regulations, Article XXIV, §280 - Site Plan
Approval of the Town of Southold, have been met; and
WHEREAS, on November 1, 2013, the Southold Town Chief Building Inspector
reviewed and certified the proposed Contractor's Yard as a permitted use in the Light
Industrial Zoning District; be it therefore,

RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold Local Waterfront
Revitalization Program;

Board grants Approval with three (3) conditions to the site plan entitled "Corazzini
Property" dated October 28, 2008, last revised October 9, 2013, prepared by S.L.
Maresca Associates, and authorizes the Chairman to endorse the site plan including
the following three plans:
1) Site-1
2) Site-2
3) Site-3
Conditions: Prior to the issuance of a Certificate of Occupancy, the applicant shall
1. Remove all RCA material from the area beyond the subject property line and allow the
area to re-vegetate naturally.
2. Mark the property line in this area using concrete blocks to prevent encroachment in the
future.
3. Plantings, including trees, shrubs and other plants (landscaping), as shown on the
approved site plan, shall be planted in a growing condition according to accepted
horticultural practices and they shall be maintained in a healthy growing condition. In
the event that a planting dies or is otherwise destroyed or removed, it shall be replaced
by the property owner within six (6) months or during the next planting season for that
particular plant material.

PUBLIC HEARINGS
4:31 p.m. - Sacred Heart Church & Valerioti - This proposed Lot Line Change will
transfer 0.48 acres from SCTM#1000-96-5-10 to SCTM#1 000-96-5-12. 1. Lot 12.1 will
increase from 35.03 acres to 35.51 acres and Lot 10 will decrease from 1.74 acres to
1.26 acres located in the AC Zoning District. The property is located at 3400 & 4200
Depot Lane, on the southwest side of Depot Lane approximately 1,468 feet to the
northwest of Route 48, Cutchogue.

to address the Board on the Sacred Heart Church and Valerioti application. I have a
question: is this northwest of Route 48?
William Goggins, 13235 Main Road, Mattituck, attorney for the applicant: This property
is south of Route 48. It's south of the railroad tracks on the east side of the road.
What's going on is a Lot Line Change for the purpose of taking care of some issues at
the cemetery. What had happened was they had laid some cemetery plots right on the
property line, so that was causing problems with the people visiting the faithful departed
and having golf balls and stuff on the neighboring property. So, in order to fix that
problem, we decided to ask the Planning Board for a Lot Line Change pushing the
property on one side about 6' to the west and another part of the property more towards
the north as set forth in the plan.
James Rich: Thank you. Would anyone from the audience like to address the Board?
William Goggins: There is one issue that the Board may not be aware of. We had
posted the property. However, my office sent out a certified mailing but did not ask for
a return receipt. So, although we did the mailing, it was not return receipt requested.
So, in order for this to be jurisdictionally proper, I think we need to adjourn it to the next
public hearing and have us properly mail the notices out to the adjoining property
owners as required by the Town Code.
James Rich: In that case, I recommend that we keep the hearing open until next month
to give you time to take care of that administrative issue.
William Goggins: Thank you.

Zoning District, will increase from 0.8 acres to 0.9 acres and Lot 15. 1, located in the HB
Zoning District, will decrease from 0.6 acres to 0.5 acres. The property is located at 690
Traveler Street, on the n/s/o Traveler Street approximately 127' w/o Beckwith Avenue in
Southold.

Charles Cuddy, attorney for the applicant: Good evening. As you indicated, both these
lots meet the Zoning Code. What this does is allow the library to have an access to a
driveway from Traveler Street into its existing parking which now comes off Main Road.

1,473 sq. ft. apartment for security on a 47,166 sq. ft. parcel in the Light Industrial
Zoning District located at 115 Commerce Drive, on the w/s/o Commerce Drive,
approximately 475' s/o Corporate Road in Cutchogue. SCTM#1000-96-1-1.2
James Rich: Is there anyone wishing to address the Planning Board on this
application?
Russell McCall. I am across the street from the storage facility: I have a question:
Is this larger than the one that was previously approved for this site? What was the
footprint before?
Martin Kosmvnka, applicant: I think the overall square footage was reduced by 8,000.
The rear setback all stays the same. One of the biggest changes was the elimination of
the outside doors. Off the top of my head I think it's a couple thousand square feet. It
wasn't much, that's for sure. But it wasn't encroaching any more to the rear of Depot
Lane.
Russell McCall: This is probably as attractive an industrial site probably can be with all
those trees in front as buffer it's great. But I'm concerned that more and more ground
is being covered up by buildings. As you probably know, I'm interested in preservation
of our space out here, which I'm sure you are also. Every time we make a building a
little bigger than we thought we were going to make or covering a little more property,
it's gone forever. So I would hope that (inaudible)
Martin Kosmvnka, applicant: Just too add to that, there are absolutely no trees coming
down. It's already pre-existing, the (inaudible) is already there, the drainage is in place.
As I explained, the buffer zone is in place-we're not adding-if anything I'm adding
three more trees. They would have been done already except they told me it was too
dry out the front to dig up. I'll have them before the site gets done.
