It has come to my attention Mr. Kosmynka wants to have. use of a third story on his''newly constructed building adjacent..to MFT' s property. MFT does not• object 'to the third-'story use. However, the .Board should be aware Mr. Kosmynka at -the time of construction excavated his property to lower it so the height of the building would not exceed 35 feet at the foundation knowing full well he wasgoing to use three stories of interior space. When the project was commenced, the level of Mr. Kosmynka land and that of MFT' s was pretty much at the same . elevation. When the excavation began, seeing that he. was lowering his property, MFT did some spot drainage ditches along .its southerly boundary' line to prevent any runoff from MFT' s- property to the Kosmynka property which was being lowered in elevation. When the construction was finished, rather than remove the extra soil due to his extensive excavation, Mr. Kosmynka created on his northerly boundary line a large berm. Portions of the berm run from 18 to 24 inches high along MFT' s property line which is fenced. Rather than place a barrier on his . property line, ' instead'he' used used- MFT' s,- fence as a barrier.. - The results are obvious in that the berm caused'- several fence posts and the;., . fence 60" lean.l J Mr. Kosmynka has been requested to 'straighten and repair the damaged fence and posts, remove the berm or create a backstop along his property line so the soil would not press against. MFT ' s fence. Although he has been requested to address this situation, nothing has happened. You should also be aware Mr. Kosmynka in the course of his construction violated the .required Planning Board's "Covenants and Restrictions which were required for approval of the industrial park subdivision. Mr. Kosmynka created a .driveway across the landscape buffer .from the westerly portion of his property to Depot Vane. He. removed trees and other vegetation to have access during the construction. When the building was completed 'he left a gate which is obviously going to be used in the future for access . He did not replace any of the trees he had removed, .but merely planted grass to camouflage his activities . Again,. he was requested to replace the trees and remove the gate, but. has not done so. . To repeat, MFT has no objection to Mr. Kosmynka having access to Depot Lane across the landscape buffer. If the Town of Southold allows this access to continue, then MFT when its current tenant vacates the property- and a building is built, -MFT .will be able to have access to Depot Lane as well as other property owners along Depot Lane. At their Work Session held on June 2, 2014, the Planning Board reviewed the Approved Amended Site Plan with regard to your request to the Board to allow the construction of a fire gate and emergency access through the established 50' wide buffer from Depot Lane: Based on the site inspection made by the Southold Town Fire Marshall and the subsequent discussion by the Board, the following was determined: 1. Pursuant to the Covenants and Restrictions for the North Fork Industrial Park Article IV. Use of Property: Section 1(d), the Planning Board consents to alter the landscaping of the buffer with the installation of a 15' wide stable base emergency access point at the southwest corner of the subject parcel that must support 2!70,000 lbs. The emergency access location shall be seeded after providing the minimum base so that the buffer remains intact. The Planning Board will formalize this consent in a resolution scheduled for their Public Meeting July 7, 2014. Additionally, the Planning Department will be providing you with draft language for a Covenant and Restriction to be filed with the Suffolk County Clerk's Office ensuring that this area of the buffer will be planted with a minimum of two (2) 5' - 6' evergreens and one (1) 2Y2" - 3" caliper shade tree from the Town's list of approved trees upon a finding that the emergency access through the subdivision buffer is no longer necessary due to cross emergency access being available through adjacent sites once they are developed. 3. The emergency access shall not be used as a construction entrance to Depot Lane or for any purpose other than in an emergency for emergency vehicle access. 4. The installation of a retaining wall along a portion of the northwest property line has been permitted by the Planning Board. Please submit a section detail of the proposed retaining wall to be documented in the file. Name of Action: Proposed Site Plan for North Fork Self Storage#2 SCTM#: 1000-96-1-1.2 Zone: LI Location: 115 Commerce Drive, Cutchogue SEQR Status: Type I ( ) Unlisted (X) Conditioned Negative Declaration: Yes ( ) No (X) Description of Action: This site plan is for the construction of a 24,505 sq. ft. storage building, including a 1,473, sq. ft. office, and a 1,473 sq. ft. apartment for security on a 47,166 sq. ft. parcel in the Light Industrial Zoning District located on the west side of Commerce Drive, approximately 475 feet south from Corporate Road, in Cutchogue. Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed. The determination was based upon the following: SEQRA Negative Declaration Page Two December 16, 2013 The parcel is located within the major subdivision of The North Fork Industrial Park created in January of 2005. The parcels to the north, south and east are zoned Light Industrial (LI). The parcel to the west (across Depot Lane) is zoned Agriculture Conservation (AC). Public water is supplied to the area by a Suffolk County Water Authority water main located on Commerce Drive. The proposed use includes a storage building, office and accessory apartment. Potable water is not proposed for the storage building. It is expected that an agreement between the Applicant and the Suffolk County Water Authority will be reached to supply public water to the site. The proposal is expected to use 367.68 gallons of water per day (g.p.d.). Sanitary disposal for the office and accessory apartment uses will be managed by on-site underground sewage leaching systems. Sanitary disposal is not proposed for the storage use. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. Therefore, the allowable nitrogen bearing flow for the overall 1.08 acre site is 650 g.p.d. The sanitary design flow is computed using SCDHS manual Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. The manual establishes the design flow as follows: Office Space 06gpd x 1128 s.f. 67.68 .d. Accesso A artment 300ged x 1 unit 300 .d_ The proposed application would require 367.68 g.p.d. and, therefore, would conform with Article VI of the Suffolk County Sanitary Code. The proposal includes 24,505 s.f. of buildings and 20,242 s.f. of asphalt for a total area of 44,747 s.f. of impervious area. Run-off is proposed to be contained on site via ten sub-surface dry-wells located under the asphalt area. Calculations for a 2' rainfall have been provided and the drainage system has been designed to accommodate such a rainfall. 2 SEQRA Negative Declaration Page Three December 16, 2013 Topographic elevations on-site range from 40.81 NGVD to 46.33 NGVD. A test hole was established to 17'; groundwater was not encountered. Therefore, the depth to groundwater is not expected to constrain the installation of septic systems on the lot. Further, the proposed action will not adversely affect groundwater quantity or quality provided properly functioning drainage and septic systems are designed and installed. The parcel is cleared, vacant and currently used to store vehicles. No significant removal or destruction of large quantities of vegetation would occur as a result of this action. Correspondingly, no substantial interference with the movement of resident or migratory wildlife species nor impacts to a significant habitat will occur. The Suffolk County Soil Survey (1975) identifies parcel soils as Haven Loam (HaA) and Plymouth Loamy Sand (1316). Haven Loam soils are indicative of outwash plains, level and have slight erosion potential. The soil is well suited for all crops. The soil Plymouth Loamy Sand (PIB) is indicative of outwash plains and is fairly well suited for crops. The potential of erosion is slight. A minimal loss of agricultural soils will result if the action is approved The New York State Parks, Recreation and Historic Preservation National Register Listing Internet Application (2008) indicates that the parcel is not located within known historical or archeological areas, coupled with the historic agricultural use on the parcel the occurrence of historical or archeological resources on site is low. The proposed action is not expected to impair the character or quality of important known historical or archaeological resources. The parcel is vacant; no architectural impacts will occur. The parcel is located 160+ feet north of County Route 48, a New York Scenic Byway. To mitigate impacts to the view shed from the expected build out, the Planning Board required a 1 00' vegetative buffer on parcels abutting County Route 48 and a 50' vegetative buffer on parcels abutting Depot Lane as a condition of approval of the subdivision. The buffer has been encroached upon, however, the proposed action includes a plan to re-vegetate the area with native plant species. Additionally, the proposal includes a 4' vegetative buffer, including a row of evergreen trees, along the east and west property lines. Therefore, visual impediments to the view-shed will be partially minimized through the vegetative buffers. Due to the location of the lot within the subdivision, proposed use, and existing vegetative buffers, the impacts to County Route 48, the aesthetics of the community or neighborhood character will be minimized through screening. 3 SEQRA Negative Declaration Page Four December 16, 2013 Based on the above information, no substantial adverse changes in existing air quality, surface water quality or quantity, traffic or noise levels; solid waste production or potential for erosion are expected to occur if the proposed action is implemented as planned. No major change in the use of either the quantity or type of energy is expected to occur. No creation of a hazard to human health is expected to occur. The proposed action will not cause a substantial change in the use, or intensity of use, of land including agricultural, open space or recreational resources, or in its capacity to support existing uses. Based upon such, no significant adverse impacts to the environment are expected to occur should the project be implemented as planned. III: Analysis The Amended site plan was approved in December 2013, is currently under construction and will expire after eighteen (18) months on June 17, 2015. 1. Large landscaping bins of concrete block (see photos) exist on the adjacent parcel to the northwest on or close to the property line in the area where a 24' wide fire access gate was approved for this site plan. a. Mr. Kosmynka stated that he understands the importance of having such fire access to the rear of his building and proposes that the fire gate access be relocated to the southern corner of the lot where there exists a gap in the 50' landscaped buffer (required when this industrial park was originally subdivided). Photographs are available that show this gap in the existing buffer as well as an existing "crash gate" that is located on the adjacent parcel to the northwest with access through the 50' wide buffer. Southold Fire Marshall: Bob Fisher, also a commissioner for the Cutchogue Fire District, made a visit to the site and determined that 15' wide access capable of supporting >_70,000lbs. through the 50' buffer is necessary for this site not only for access to the building but also to serve as an emergency exit for emergency apparatus within this parcel that is proposed to be completely fenced in. No landscaping should have to be removed in order to provide a 15' wide access way. Staff: The North Fork Industrial Park subdivision was approved January 25, 2005. It appears that a retaining wall of±4' is necessary along a portion of the northwest property line to accommodate for a grade change between the subject parcel and the adjacent parcel to the northwest. Mr. Kosmynka is considering a concrete block retaining wall, to be gradually stepped to a height of approximately 4' and approximately 2' wide at the top of the wall to accommodate for landscaping as approved. 2.
