(631) 765-1809 • Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION ZBA FILE: 6666 MEETING OF JULY 25, 2013 NAME OF APPLICANT: Raise, LLC SCTM: 1000-52-5-58.2 PROPERTY LOCATION: 67875 Main Road (aka CR 25) (corner Albertson Lane), Greenport, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code § A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 8, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. There are no natural features for L WRP review. PROPERTY FACTS/DESCRIPTION The property is 45,634 square feet in size and zoned in a Light Industrial District. It has 260.00 feet of frontage on Main Road (C.R.25), 277.17 feet along Albertson Lane, 155.00 feet on the northern property line and 184.03 feet on the southwestern property line as shown on the survey dated October 22, 2012, last revised July 8, 2013 prepared by Nathan Taft Corwin, III, LS. A chain link fence surrounds the property. The entrance to the property is located on Albertson Lane, and a chain link gate controls the entrance to the property. On the property is a 3,200 square foot metal building. The vast majority of the property is covered by asphalt pavement and is used for storage of Construction equipment, materials, and containers. There is an industrial electric meter and transformer on the north side of property behind the building. The neighboring properties are also zoned Light Industrial districts and the properties are being used for industrial use. One of the neighboring properties is an uninhabited swamp. The property has green vegetation shading in front of the chain link fence making the property less visible from the street. BASIS OF APPLICATION: Request for Variance(s) from § 280-64A and Article XV Code § 280-63 and the Building Inspector's May 13, 2013 Notice of Disapproval based on an application for building permit for additions and alterations to an existing commercial building, at 1) less than the code required minimum front yard setback of 100 feet from the Right of Way, 2) less than the code required minimum rear yard setback of 60 feet. RELIEF REOUESTED: The applicant proposes to construct an office addition to the existing metal commercial building requiring variances for a front yard setback of 57.8 feet where the code requires a 100 foot front yard setback and a rear yard setback of 51.3 feet where the code requires a rear yard setback of 60 feet. because the Page 2 of 3 - July 25, 2013 ZBA#6666' Ratso, LLC SCTM41000-52-5-581 proposed construction on this 45,634 square foot parcel is in the LI Zone, with two front yards is not permitted pursuant to Article XV, § 280-64 A., which states, "Structures shall be set back at least 100 feet from the "Right of Way." The application requires site plan approval by the Southold Town planning board. ADDITIONAL INFORMATION: The property has previously been granted relief from the code in ZBA appeal number 4934 dated April 19, 2001 which allowed the occupant relief from the code to build the existing structure at a rear yard setback of 52 feet. According to testimony the applicant needs relief from the code in order to effectively run his business and needs the additional office space so that office staff and mechanical crews can work more efficiently and so that the flow of traffic and heavy machinery is not impeded. Currently office staff cannot always work inside the building at the same time as the mechanical crews. The property has limited space to store and use large trucks and other machines. The applicant can only place the office in the proposed location because it is the only place that will not impede the flow of traffic and efficient running of his business. The Planning Board, in a letter dated July 9, 2013, approved the site plan drawn by Nancy Dwyer dated April 18, 2013 and supports the requested variances. The Planning Board stated, "that the subject parcel is zoned Light Industrial (LI) and is located in Greenport where the proposed light industrial use is consistent with the Town Code and the Town's comprehensive plan. The Planning Board supports the requested variances and states that the existing 3,200 square foot building will be partially screened by vegetated buffers which should mitigate any visual impact from the street." FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 11, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because there is an existing industrial structure on the property and the neighboring properties also have industrial uses. There are a few residential homes across the street from the property, but there is evergreen vegetation screening making it difficult for them to see the property. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the property is on a corner lot with front yards on Albertson Lane as well as the Main Road. The property has a building envelope that is small and substantially limits the Light Industrial use of the property.
