Domino 'QS Fax(631) 765-6641 4 co BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD November 13, 2013 Mr. Anthony Napolitano 200 Cleaves Point Road East Marion, NY 11939 RE: ANTHONY NAPOLITANO 200 CLEAVES POINT ROAD, EAST MARION SCTM# 38-2-33 Dear Mr. Napolitano: The Board of Town Trustees took the following action during its regular meetings held on Wednesday, November 13, 2013 regarding the above matter: WHEREAS, ANTHONY NAPOLITANO applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated September 20, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application for the existing +/-90' wood bulkhead with associated +/-4.5'x4.3' platform and 32" wide stairs to beach was found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application for existing 5'2"x10'6"x11'10"x12'10"x14" high planter box at eastern edge of property to be planted with native vegetation; existing 10'x11'-12" square block patio non-turf permeable area; existing 12' wide x 60' long area of 3/8" crushed bluestone non-turf permeable area used as a bocce court; and for an area approximately 5'x11'x9'x11' of 12" square patio blocks with an electrical outlet on a post, a water spigot and one pole light was found to be Inconsistent with the LWRP, and, z 0 • WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of permit on structures, and WHEREAS, Public Hearings were held by the Town Trustees with respect to said application on November 13, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of ANTHONY NAPOLITANO for the existing +/-90' wood bulkhead with associated +/-4.5'x4.3' platform and 32" wide stairs to beach; for existing 5'2"x10'6"x1110"x1210"04" high planter box at eastern edge of property to be planted with native vegetation; existing 10'x11'-12" square block patio non-turf permeable area; existing 12' wide x 60' long area of 3/8" crushed bluestone non-turf permeable area used as a bocce court; and for an area approximately 5'x11'x9'x11' of 12" square patio blocks with an electrical outlet on a post, a water spigot and one pole light; with the condition the proposed lighting must be "Dark Sky" compliant; and as depicted on the project plan prepared by Anthony Napolitano, received on September 20, 2013, and stamped approved on November 13, 2013. My first and most serious objection is the lamppost Mr. Napolitano plans to erect. The Napolitano's and I have disagreed about his use of night lighting for years. He presently leaves three lights burning all night on his property that spill over onto and light up my property. In the past,we have taken this problem to the Zoning Department. We agreed to settle the matter when he agreed to recess the light over his porch so it would not be broadcast onto my property. He had a recessed light for a short time, but then replaced it with a lantern structure that broadcasts the light in all directions including at me. He refuses to install lights that direct the beams downward on his property. If you allow him to put up a light on the bulkhead,it will be another light on all night lighting up my property as well as his. I strongly believe in a Dark Skies philosophy of minimizing the impact of lighting,but he does not.There are presently no other lights on our bulkhead. Please do not approve the light. It is unnecessary and will be another source of light torture to me. I also object to the already erected raised flower bed which is now an eyesore. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the LWRP.
