SIMON, residing at 379 Wood Lane, Peconic, New York, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten ($10.00) dollars paid by the party of the second part,does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate. Cron, ISG L North 2 degrees 53 minutes 50 seconds West 298.26 feet to the high water 3 line of Richmond Creek; thence along the high water line of Richmond Creek in a westerly direction, the tie line of which bears South 59 degrees 33 minutes 10 seconds West 244.87 feet to land of F. Kull Estate; thence along said lands last mentioned, South 5 degrees 06 minutes 10 seconds East 211.32 feet to other lands of R. Cron; thence along said lands last mentioned, North 79 degrees 57 minutes 50 seconds East 210.59 feet to the point or place of BEGINNING TOGETHER with the right to use (in common with others) of a right of way 12 feet in width extending from Indian Neck Road northerly along the easterly line of land now or formerly of the party of the first part herein to land now or formerly of J. Hughes. TOGETHER with and SUBJECT to an easement for a right of way for ingress and egress 30 feet in width over the premises adjoining the above described premises* TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. ELIZABETH $ ON - 011333K306 SCHEDULE A on the east and thence southerly to and from Indian Neck Road, northerly line of which is the following course and distance, 't the o wit: North 79 degrees 57 minutes 50 seconds East .:07. 53 feet; and the easterly line of which is the following course and distance, to wit: South 5 degrees 00 minutes 10 seconds West 424.34 feet. SUBJECT to covenants and restrictions as set forth in Schedule A annexed hereto. BEING AND INTENDED TO BE the same premises as conveyed by Richard J.Cron to Robert K. Simon and Elizabeth Ann Simon, his wife, by deed dated February 23, 1974 and recorded in Suffolk County Clerk's Office on March 4, 1974 in Liber 7597 of deeds at Page 548 . The following covenants and restrictions are to be included in the deed of conveyance: • (1) That no flats, stores, double houses, nor apartment houses shall be built or placed upon said real property or any part thereof; that each and every residence house built or placed upon said property shall be of a height no greater than two story with basement and attic; the ground floor area of the main floor structure, exclusive of one story open porches and garages, shall be not less than 1200 sq. ft. in the case of a one story structure, nor less than 1000 sq. ft. in the case of a one and one-half or two story structure. (2) No trailer, basement, tent, shack, garage, barn or other outbuilding erected on the tract shall at any time be used as a residence temporarily or permanently, or shall any structure of a temporary character be used asa residence. (3) No dwelling or structure shall be erected or placed nearer than 40 feet to any front lot line or road line. (4) No residence shall be erected until the plans and specifications with the proposed site therefor have been submitted to and approved by the seller, and a written permit issued therefor. (5) No manufacturing or commercial enterprise, or enterprise of any kind for profit shall be maintained upon, in front of or in connection with the site hereby conveyed, nor shall said site in any way be used by other than strictly residential purposes. This shall not be construed, however, as forbidding the practice of medicine or dentistry. (6) No poultry, cattle, hogs, or other animals, except household pets may be kept. All such domestic animals shall be confined exclusively to the owner's property. (7) No house trailers, module homes, campers, or any other unlicensed vehicle shall be kept in the rear yard of the premises. (8) No lot shall be maintained or used as a dumping ground for rubbish, trash, garbage, or other waste. Any of the foregoing shall be kept in closed sanitary containers, which containers shall be kept out of the public view and in the rear of the premises. No part of said premises shall be used or occupied injuriously to effect the use, occupation or value of the adjoining or adjacent premises for residence purposes, or the neighborhood wherein said premises are situated.
