BARGAINAND SALE DEED with Covenant against Grantor's Acts
THIS INDENTURE, made the 18`h day of October in the year 2013 BETWEEN
THOMAS L. GATZ and DIANE K. GATZ, his wife, residing at 933 New
Suffolk Avenue, Cutchogue, NY 11935, party of the €irst partand
STEVEN H. BERMAN and DEBORAH A. BERMAN, as husband and wife,
residing at 8 Ronnie Lane, Bethpage, NY 11714,
WITNESSETH, that the party.of the first part in consideration of ten dollars and
other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part, forever,
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the
(see attached schedule "A").
BEING AND INTENTED TO BE THE SAME PREMISES AS DESCRIBED
IN DEED MADE BY Stuart A. Rachin and Karen S. Rachin, his wife dted February
14, 2000 recorded February 23„ 2000 in Liber 12022 page 638.
TOGETHER with all right, title and interest, if any, of the party of the first part
of, in and to any streets and roads abutting the above described premises to the center
lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of Suffolk and
State of New York, known and designated as Lot 8 on a certain map entitled "Map of Golden View Estates" and filed in
the Office of the Clerk of the County of Suffolk on August 30, 1984 as Map No. 7770; said lot being bounded and
described as follows;
BEGINNING at a stake on the northwesterly side of Eagle Nest Court distant northeasterly 426.27 feet from the extreme
easterly end of the curve which connects the northeasterly side of White Eagle Drive and the northwesterly side of Eagle
Nest Court;
RUNNING THENCE North 32 degrees 33 minutes 42 seconds West, 263.31 feet to a stake;
THENCE North 57 degrees 26 minutes 18 seconds East, 165.65 feet to a stake and land now or formerly of Nicolo and
Caroline Debartoio;
