WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 101h day of September, 2013, a Local Law entitled "A Local Law in
relation to Parking on Second Street in the Hamlet of New Suffolk" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Parking on Second Street in the Hamlet of New
Suffolk" reads as follows:

Southold Town Board Meeting
1. Purpose.
Parking on Second Street in the hamlet of New Suffolk has resulted in conditions that
impact the public health, safety and welfare in the surrounding community. These
conditions consist of undue congestion, restrictions on access and maneuverability as
well as dangerous traffic impacts. Accordingly, it is necessary to prohibit parking in this
area to protect the public and restrict the public's ability to block the ordinary flow of
traffic. Accordingly, an Amendment to Chapter 260 is warranted.
II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows:
$260-10. Parking prohibited during certain months.

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any

as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
b law.

Comment regarding resolution 745
COUNCILWOMAN DOHERTY: I have a little discussion, explanation. We want to look more
into parking in that whole area and we have, you know, until spring. So we will be re-noticing it
when we do re-visit it probably in the spring.

Financial Impact:
Police Department cost for event = $353.22
RESOLVED that the Town Board of the Town of Southold hereby grants permission to
Mattituck-Cutchogue Teachers' Association to use the following route for its 2013 Turkey Trot
in Mattituck, on Thursday, November 28, 2013: beginning at Mattituck High School, head
west to Pike Street, cross Route 25 to Reeve Avenue; head south, left on to New Suffolk
Avenue; proceed east, right onto Marratooka Road to end, head north on Marratooka;
cross New Suffolk Avenue onto Marratooka Lane, left on Route 25; head west, right onto
Wickham Avenue, proceed north, right onto Pike Street, finish at the school; provided they
follow all the conditions in the Town's Policy for Special Events on Town Properties. Failure to
comply with items 5 and 6 will result in a clean up charge.
Support is for this year only, as the Southold Town Board continues to evaluate the use of town
roads. The fees have been waived for this event.

County, New York, on the 6` day of November, 2013, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 245, Taxation, to Provide Assessment and Tax Relief to
Property Owners Impacted by Superstorm Sandy".
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
19`h day of November, 2013 at 4:36 p.m. at which time all interested persons will be given an
opportunity to be heard.

Superstorm Sandy" reads as follows:
LOCAL LAW NO. 2013
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 245, Taxation, to
Provide Assessment and Tax Relief to Property Owners Impacted by Superstorm Sandy".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
Superstorm Sandy caused catastrophic property damage in Suffolk County in the Fall of
2012. Many homes were either destroyed or severely damaged by the high winds, rains
and flooding associated with Superstorm Sandy. Superstorm Sandy struck the Town
after assessment rolls were prepared; as a result, property owners who experienced
substantial damage to their homes and businesses were required to pay their normal
property tax bill in 2013. The State of New York has enacted legislation which addresses
this inequity by authorizing local governments to grant assessment relief to Superstorm
Sandy victims whose properties were substantially damaged or destroyed. The Town of
Southold was included in the Federal Disaster Declaration of Superstorm Sandy and,
therefore, is eligible to extend assessment relief to its residents. As such, the Town Board
believes it is fair and equitable to provide relief to residents who saw their properties
damaged or destroyed and their lives upended by Superstorm Sandy.
Therefore, the purpose of this local law is to elect to provide assessment relief to persons
substantially impacted by Superstorm Sandy as authorized by the "Superstorm Sandy
Assessment Relief Act", enacted by the New York State Legislature as Chapter 424 of
the 2013 Laws of the State of New York.
IT. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
ARTICLE IX
Assessment and Tax Relief for Property Owners
Impacted by Superstorm Sandy
4245-20. Definitions.
Unless otherwise expressly stated, the following terms shall, for the purpose of this
Chapter, have the meanings as herein defined. Any word or term not noted below shall
be used with a meaning as defined in Webster's Third New International Dictionary of
the English Language, unabridged (or latest edition).
IMPACTED TAX ROLL - the final assessment roll which satisfies both of the following
conditions: the roll is based upon (a) a taxable status date occurring prior to October 28,

2012, and (b) taxes levied uon that roll were payable without interest on or after October
28, 2012.
IMPROVED VALUE - the market value of real property improvements excluding the
land.
PROPERTY - Real property, property or land as defined under paragraphs (a) through (g)
of subdivision 12 of New York Real Property Law.
RELIEF ACT - the Superstorm Sandy Assessment Relief Act as enacted by New York
State Legislature, Chapter 424 of 2013 Laws of the State of New York.
SUPERSTORM SANDY - the storms rains winds or floods which occurred within the
State of New York and the County of Suffolk during the period October 29, 2012 and
ending November 3, 2012.
TOTAL ASSESSED VALUE - the total assessed value of the property prior to any an

This law adopts and implements the provisions of the Sunerstorm Sandy Assessment
Relief Act, as enacted by the New York State Legislature, Chapter 424 of the 2013 Laws

4245-22. Eligibility criteria and relief granted.
Notwithstanding any provision of law to the contrary, the Town of Southold elects to
provide assessment relief for properties damaged by Sunerstorm Sandy, as authorized by

4245-23. Other provisions.
A. To receive relief under this law, a property owner must submit a written request to
the Town Assessor's Office on a form approved by the Director of the New York
State Office of Real Property Tax Services and in accordance with the specific
requirements of the Relief Act. Such request shall attach any and all
determinations made by the Federal Emergency Management Agency, any and all
reports made by insurance adjusters, and describe in reasonable detail the damage
caused to the property by Superstorm Sandy and the condition of the property and
shall be accompanied by supporting documentation, if available.
B. The percentage of loss in improved value shall be adopted by the Assessor from a
written finding of the Federal Emergency Management Agency, or where no such
finding exists, shall be determined by the Assessor in a manner provided by the
Relief Act, subject to review by the Board of Assessment Review.
C. Where an Assessor determines a property has lost at least 10% of its improved
value due to Superstorm Sandy, the assessed value attributable to the
improvements on the property on the impacted assessment roll shall be reduced
by the appropriate percentage specified in &245-22 of this law, provided that any
exemptions which the property may be receiving shall be adjusted as necessary to
account for such reduction in the total assessed value. To the extent the total
assessed value of the property originally appearing on such roll exceeds the
amount to which it should be reduced pursuant to the Relief Act and this local
law, the excess shall be considered an error in essential fact as defined by
subdivision 3 of Section 550 of the Real Property Tax Law. If the error appears
on a tax roll, the tax roll shall be corrected in the manner provided by Section 554
of the Real Property Tax Law or a refund or credit of taxes shall be granted in the
manner provided by Sections 556 or 556-b of the Real property Tax Law. If the
error appears on a final assessment roll but not on a tax roll such final assessment
roll shall be corrected in the manner prescribed by Section 553 of the Real
Property Tax Law.
4245-24. Applicability.
This law shall apply to the impacted assessment roll, as that term is defined in the Relief
Act and this local law.
111. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 245, Taxation, to
Enact the Business Investment Exemption".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
New York State Real Property Tax Law §485-b establishes a framework for counties to
work with other local governments to encourage economic development that is consistent
with the master plans of their communities and crafted in conformity with the needs of
their residents, businesses and environment. Suffolk County has created the Industrial
Commercial Incentive Board to work with the Towns within the County to create a
Strategic Industries Property Tax Abatement Plan, which includes the
Industrial/Commercial Incentive Plan, Town of Southold, to attract and encourage
business growth, allowing the Town to target tax incentives to businesses that make
improvements to real property in areas identified by the Town. In accordance with the
Strategic Industries Property Tax Abatement Plan, the Town is enacting this exemption to
encourage targeted economic development, and the value of the exemption is justified by
the need to provide employment opportunities and broaden the tax base in designated
areas within the Town of Southold.
II. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:

4245-7. Exemption granted.
A. Real property constructed, altered installed or improved subsequent to the effective date
of this Article for the purpose of commercial, business or industrial activities that are set
forth in the Industrial/Commercial Incentive Plan Town of Southold permitted uses
pursuant to Chapter 280, Zoning and which are identified parcels in the
Industrial/Commercial Incentive Plan, Town of Southold shall be eligible for an
exemption from taxation and special ad valorem levies from each school district located
within the area within which said exemption shall apply unless such school district by
resolution, shall determine that such exemptions shall not be applicable to its tax and ad
valorem levies. For the purposes of this section the terms "construction," "alteration,"
"installation" and "improvement" shall not include ordinary maintenance and repair.
B. This exemption shall only apply to those proiects where the cost of such construction
alteration, installation or improvements exceeds the sum of $50,000. The amount of the
exemption shall be calculated by taking the increase in the assessed value of such real
property attributable to such construction, alteration installation or improvement and
reducing that increase in the assessed value of such real property, on a declining
percentage basis, pursuant to the following accelerated strategic exemption schedule:

C. No exemption shall be granted unless such construction alteration installation or
improvement is completed as may be evidenced by a certificate of occupancy or other
appropriate documentation as provided by the owner.
D. Application:
(1) Such exemption shall be granted only upon application by the owner of such real
property on a form prescribed by the New York State Department of Taxation and
Finance. Such application shall be filed with the Assessor of the Town having the
power to assess property for taxation on or before the appropriate taxable status
date of the Town or County and within one year from the date of completion of
such construction, alteration installation or improvement
(2) If the Assessor is satisfied that the applicant is entitled to an exemption pursuant
to this Article he or she shall approve the application and such real property shall
thereafter be exempt from taxation and special ad valorem levies except for
special ad valorem levies for school district purposes as herein provided
commencing with the assessment roll prepared after the taxable status date of
March 1 of each year. The assessed value of any exemption granted pursuant to
this Article shall be entered by the Assessor on the assessment roll with the
taxable property, with the amount of the exemption shown in a separate column
E. In the event the real property granted an exemption pursuant to this Article ceases to be
used primarily for eligible purposes as set forth in the Industrial/Commercial Incentive
Plan, Town of Southold, the exemption granted shall cease.
III. SEVERABILITY
