SCTM#1000-36-1-1 PROPERTY LOCATION: 1410 Manhasset Avenue (adj. to Sterling Creek and Sterling Harbor), Greenport, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 23, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 28, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. The LWRP coordinator noted the consistent finding is based on the Zoning Board verifying that the sanitary system meets the Town setback requirements and the new building meets Chapter 236 Storm-water Management; Erosion and Sediment Control; and Illicit Discharge Law regulations. Based upon the information requested of the applicant by the Board about the existing sanitary system, received on 11/25/13, and the condition imposed herein the Board is satisfied that the proposed action is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION Subject parcel contains 9.92 acres and is located in a MII zone. It is improved with four framed buildings, metal boat storage building, a shed, a plastic building, an in-ground swimming pool, a restaurant and 145 boat slips with 6 large floating wood docks and associated parking area for this boat marina. It has 648.70 feet of frontage on Manhasset Avenue and a portion of the property is located in the Village of Greenport. As shown on the survey prepared by Peconic Surveyors dated June 15, 2000. BASIS of the APPLICATION: Request for Variance from Article XXII Code Section 280-116(B) and the Building Inspector's August 6, 2013 Notice of Disapproval based on an application for building permit to demolish and construct a new restroom building, at; 1) proposed structure at less than the code required bulkhead setback of 75 feet. Page 2 of 3 - December 6, 2013 ZBA 46699- Brewer Yacht Yard @ Greenport, Inc. SCTM# 1000-36-1-1 RELIEF REQUESTED: The applicant requests a variance to demolish and construct a new restroom building with a bulkhead setback of 0 feet where the code requires 75 feet. ADDITIONAL INFORMATION: At the Public Hearing the Zoning Board of Appeals requested; 1) copy of DEC permit, 2) location of sanitary system. On November 25, 2013 the Board received a letter from High Point Engineering responding to the LWRP concerns, a copy of the Notice of Intent to the NYSDEC under the existing permit, site plan of the bulkhead/dock/restroom replacement plan with the existing septic system shown and a site plan of the storm-water prevention plan. The Zoning Board requested comments from the Planning Board on this application. In a memo dated October 23, 2013 the Planning Board states, "they have no objection so long as the use of the proposed building remains the same and no additional parking is required or proposed. The subject parcel is zoned M-II and is located in Greenport where the proposed uses of a marina are consistent with the Town Code and the Town's Comprehensive Plan. The proposed restroom and shower building appears to not cause concern since this proposed area has historically been used for restrooms and showers accessory to the existing marina. The above-referenced proposals would further the goal of the Town's Comprehensive Plan to enhance the Town's waterfront while maintaining its fundamental characteristics." Additionally, this applicant was granted a prior variance file #6581 in 2012 for the demolition and construction of boat storage and office building noting 3 feet from the bulkhead. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wants to update the restrooms and laundry room which is made up of three separate rooms which is at "0" feet from the bulkhead. The building has been in existence for more than 45 years with no apparent adverse impact on the neighborhood and no change in location, footprint or use is proposed. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although the applicant could conceivably relocate the new up to date restroom building elsewhere on the subject property, in reality the actual buildable area within the marina compound is extremely tight and does not lend itself for new additional waterfront or inland buildings. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial based upon 100% setback relief from a bulkhead. However, the applicant is proposing only to replace the building within the same footprint. In addition there does not appear to be another location on this property that could accommodate a building of this size. 4. Town Law 4267-b(3)(b)(4) No Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations in the use of the parcel under the Zoning Code prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary to enable the applicant to enjoy the benefit of a new restroom building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. SCTM# 1000-36-1-1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Schneider, and duly carried, to GRANT, the variance as applied for, and shown on the Site Plan, Details page prepared by High Point Engineering Dated 7/23/13 and 7/12/13 and the Bulkhead/Dock/Restroom Bldg. replacement site plan dated 7/23/13 last revised 11/15/13 and site plan labeled Storm-water Pollution Prevention Plan dated 1/25/13 and the construction plans prepared by JH Rich dated 5/7/13 page 1, and page 2 and 6/7/13 page 3. Subject to the following condition; CONDITION: 1. All roof runoff must conform to Chapter 236 of the Storm-water Management Code. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application andpublic hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. We have provided the above referenced items in response to a letter from the LWRP Coordinator dated October 28, 2013 (copy enclosed), and comments received at our meeting with the Board on November 7, 2013. Specifically, the comments have been addressed as follows: 1. In response to concerns regarding location of the existing sanitary system in relation to existing bulkheads, the plans have been revised to depict the location of existing sanitary structures taken from an SCDHS record plan and a survey of the property. Dimensions have been added to the plan indicating separation of the existing sanitary structures from the existing bulkheads. As indicated, three of the existing pools are setback 78'-81' from the existing bulkhead to the north, while the fourth is setback 101'. It is worth noting that the setbacks indicated by the LWRP Reviewer appear to be applicable only to operations on residential property per Chapter 275 of the Town Code. Chapter 275 does not appear to prescribe requires setbacks for commercial activities. Regardless, the location of the aforementioned structures was approved by SCDHS & the Town of Southold upon the installation of the existing system circa 1974. The subject application does not propose any modifications that will alter the sanitary flow to the existing system/ nor cause the need to modify it in any way. Specifically, the project does not propose any change in area, footprint, or use of the existing shower/restroom building. As such, given no modifications are proposed affecting the existing sanitary system, the project has no adverse impact to physical or environmental conditions. Therefore, it can be concluded that the application is consistent with the LWRP Standards with respect to existing sanitary system concerns. i, Brewer Sterling Harbor Marina - 1410 Manhasset Avenue, Greenport, NY November 21, 2013 2. In response to concerns regarding stormwater runoff from the subject restroom building, we have provided a copy of the SWPPP Site Plan prepared by Triton Environmental, as well as a copy of the Notice of Intent for coverage under the SPDES MSGP. The Plan indicates the areas tributary to the approved stormwater outfalls as approved by NYSDEC and covered under General Permit #0-12- 001. As indicated by the drainage area boundary line, the building which is the subject of this application lies fully within the tributary area of Outfall 003, located approximately 50' north of the subject building. Therefore, the stormwater runoff from this building is approved to discharge to the Eastern Basin under GP-0-2-001, and a subsurface stormwater detention system is not required. As such, it can be concluded that the proposed project is consistent with LWRP Standards in regards to Stormwater Management. Please review the enclosed documents and above responses. Chapter 275, Wetlands and Shorelines requires that the septic tanks are setback 75' and leaching pools 100' from a wetland. The marine wetland in this case is located at the bulkhead. A tank was observed with PVC pipe running under the parking area during the site visit, however, the purpose of the tank was not identified. This situation is similar to the Dockmaster building proposed at Mill Creek Inn/Marina and an alternative sanitary system is warranted due to proximity to the surface waters. 2. Require that the action/property meets Chapter 236 "Stormwater Management; Erosion and Sediment Control; and Illicit Discharges Law" regulations. Gutters/leaders were not observed on the current building adjacent to the marine wetlands. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 17, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 24, 2012. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject parcel contains 9.92 acres and is located in a MII zone. It is improved with four framed buildings, metal boat storage building, a shed, a plastic building, an in-ground swimming pool, a restaurant and 145 boat slips with 6 large floating wood docks and associated parking area for this boat marina. It has 648.70 feet of frontage on Manhasset Avenue and a portion of the property is located in the Village of Greenport. BASIS OF APPLICATION: Request for Variance from Article XXIi Code Section 280-116(6) based on an application for building permit and the Building Inspector's May 24, 2012 Notice of Disapproval concerning a building permit to demolish and construct a boat storage and office/storage building, at; 1) proposed structures at less than the code required bulkhead setback of 75 feet. RELIEF REOUESTED: The applicant requests variances to demolish existing boat storage building, and two other accessory building and construct in place and in kind a new boat storage and office/storage building with setbacks of 48.5 feet and 3 feet from the existing bulkhead where the code requires a 75 foot bulkhead setback. ADDITIONAL INFORMATION: This Board requested comments from the Planning Board. In a memo dated July 24, 2012, the Planning Board states, they generally have no objection as this property has historically been used for boat storage and a marina. Additionally, this proposal would further the goal of the Town's Comprehensive Plan to enhance the Town's waterfront while maintaining its fundamental characteristics. CTM: 1000-36.1-1 FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 2, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the applicant proposes to replace the existing structure with a new more code compliant building of similar size utilizing the same footprint. Additionally, the applicant is proposing to replace the existing docks and bulkhead while the existing building is being replaced. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The building location was chosen many years ago to allow for travel lifts to maneuver about the property, in order to conduct the business of storage and maintenance of large boats. The benefit of the variance would allow the applicant to continue to do business. 3. Town Law 6267-b(3)(b)(3). The variance granted herein it mathematically substantial, representing nearly 100% relief from the code. However, the applicant is proposing, only, to replace the build within the same footprint. In addition there does not appear to be another location on this property that could accommodate a building of this size without the need for even more severe relief from the code. 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The neighborhood consist of mixed uses including residential, another boat yard, two restaurants and two cemeteries all of which have co-existed for many years. The parcel in question is zoned Marine II and the structure proposed is an allowable use within the MII Zone. As noted in the LWRP report, the improvement of the boat storage building with attached two story office/storage building (water enhanced use) supports policy number 10.1 (b) which entails improving the economic viability of water dependent uses. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new boat storage and office/storage building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
