This Indenture, made the I ith day of September, Two Thousand and Thirteen,
BETWEEN
BARBARA LEARY, residing at 780 East Road, Cutchogue, New York 11935,

and
PAUL LEARY and BARBARA LEARY, as tenants in common, both residing at 780 East Z
Road, Cutchogue, New York 11935,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever, in ALL that certain piece or parcel of real property, with the buildings
and improvements thereon erected, situate, lying and being at Fleet's Neck, near Cutchogue,
in the Town of Southold, County of Suffolk and State of New York, bounded and described
as follows:

BEGINNING at a point on the southwesterly corner of the premises hereby conveyed at
Dist: 1000 high water mark of Peconic Bay, running Northerly along land now or formerly of Howard
B. Robinson a distance of 200 feet more or less to land now or formerly of William R.
Sec.: 110.00 Mollineaux; thence running Easterly along land now or formerly of William R. Mollineaux
Elk: 07.00 a distance of 60 feet to a monument; thence Northerly along land now or formerly of
William R. Mollineaux a distance of 98 feet 4 inches to the Southerly side of East Road,
Lot: 021.000 thence Easterly along the Southerly side of East Road a distance of 22 feet to land now or
formerly of Valentine Bangert; thence running Southerly along the Westerly side of land
now or formerly of Valentine Bangert a distance of approximately 300 feet to high water
mark of Peconic Bay; thence Westerly along high water mark of Peconic Bay a distance of
80 feet, more or less, to the point or place of BEGINNING.
Together with all right, title and interest of the party of the first part in and to East Road in
front of and adjacent to said premises.
Together with all right, title and interest of the party of the first part in and to land under
water of Peconic Bay in front of and adjacent to said premises.
Premises known as 780 East Road, Cutchogue, New York.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by Deed dated March 14, 1979 and recorded in the Suffolk County Clerk's Office on March
22, 1979 in Liber 8600 at Page 40.
Together with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
To have and to hold the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be applied first for the purpose of
paying the cost of the improvement and will apply the same first to the payment of the cost
of the improvement before using any part of the total of the same for any other purpose.
In Witness Whereof, the party of the first part has duly executed this Deed the day and year
