WITNESSETH, that the party of the first part, in consideration of TEN and 00/100 ($10.00) dollars and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the
SEE SCHEDULE "A" ATTACHED.
SUBJECT to a life estate in the party of the first part as and for the tens of their natural life.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

SCHEDULE "A"
PARCEL A
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town
of Southold, County of Suffolk and State of New York, being known and designated as Plot "L"
on a certain map entitled "Map of Shore Acres", and filed in the Office of the Clerk of the
County of Suffolk on January 3, 1914 as Map No. 41, which said plot is bounded and described
as follows:
BEGINNING at a point on the Easterly line of North Drive at the division line between Plots
"K" and "L" on said map;
RUNNING THENCE North 8 degrees 08 minutes 45 seconds East, along the Easterly line of
North Drive, 89.90 feet to the division line between Plots "L" and "M" on said map;
THENCE South 89 degrees 42 minutes 10 seconds East along said last mentioned division line,
598.98 feet to the Westerly shore of Mattituck Creek (Bay) as shown on said map;
THENCE Southerly along said shore line 90 feet, more or less, to the division line between Plots
"K" and "L" on said map;
THENCE North 89 degrees 46 minutes 00 seconds West along last mentioned division line,
566.04 feet to the point or place of BEGINNING.
TOGETHER with any land lying between the shore line of Mattituck Creek (Bay) as shown on
said map and the present high water mark of Mattituck Creek lying in front of and adjoining the
foregoing described premises.
TOGETHER with an easement, for ingress and egress over an existing 15 foot blacktop right of
way, westerly to North Drive, a private road, as shown on" survey of Van Tuyl dated May 6,
1985. However, grantors reserve the right to relocate, at their own cost and expense, such
easement on the property adjoining subject premises on the west providing it continues to
provide access as aforesaid and providing further that it is not less than 15 feet in width and the
surface consists of a macadam or similar substance.
TOGETHER with a right of way over North Drive and Bay View Avenue as shown on said map

ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town
of Southold, County of Suffolk and State of New York, which said plot is bounded and described
as follows:
BEGINNING at a point which is the following courses and distances from the true point or place
of beginning:
BEGINNING at a point on the Easterly line of North Drive at the division line between Plots "L"
and "M" on a certain map entitled "Map of Shore Acres" and filed in the Office of the Clerk of
the County of Suffolk on January 3, 1914, as Map No. 41;
RUNNING THENCE South 89 degrees 42 minutes 10 seconds East along said last mentioned
division line, 598.98 feet to a point on the Westerly shore of Mattituck Creek (Bay) as shown on
the aforesaid map, which said point is the true point or place of beginning;
RUNNING THENCE South 89 degrees 42 minutes 10 seconds East, 35 feet, plus or minus to the
present, ordinary high water mark of Mattituck Creek;
THENCE in a Southerly direction along the present, ordinary high water mark to a point formed
by the intersection of the said present, ordinary high water mark and the extension of the division
line between Plots "K" and "L" on the aforesaid map;
THENCE North 39 degrees 46 minutes 00 seconds West, 75 feet, plus or minus, to the Westerly
Shore of Mattituck Creek (or Bay) as shown on the aforesaid map;
THENCE in a general Northeasterly direction along the ordinary high water mark of Mattituck
Creek (or Bay) as shown on the aforesaid map, 90 feet, more or less, to the division line between
Plots "L" and "M" the true point or place of BEGINNING.
