THIS INDENTURE, made the 4th day of September, Two Thousand Thirteen
BETWEEN
STANLEY J. ZUREK, residing at 250 Carroll Avenue, Peconic, New York 11958,
party of the first part, and
STANLEY J. ZUREK, JR., residing at 216 Knapp Place, Greenport, New York 11944,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being on the southerly side of Carroll Avenue, at Peconic, Town of Southold, Suffolk
County, and State of New York, more particularly bounded and described as follows:
BEGINNING at an iron pipe located on the southerly side of Carroll Avenue and the northeast
corner of land now or formerly of Smith;
THENCE RUNNING in an easterly direction along the southerly line of Carroll Avenue, North
52 degrees 37 minutes 20 seconds East, 154.50 feet to an iron pipe;
THENCE RUNNING in a southerly direction along the westerly line of land now or formerly of
Murphy, South 30 degrees 31 minutes 50 seconds East, 206.14 feet to an iron pipe and the
northerly line of the land of the Peconic School;
THENCE RUNNING in a westerly direction along the land of the Peconic School, South 51
degrees 05 minutes 00 seconds West, 155.93 feet to a concrete monument located on the easterly
line of the land now or formerly of Smith;
THENCE RUNNING in a northerly direction along the easterly line of land now or formerly of
Smith, North 30 degrees 17 minutes 40 seconds West, 210.44 feet to the iron pipe and the point
or place of BEGINNING.
TOGETHER with all the right, title and interest of the party of the first part in and to Carroll
Avenue, the center line thereof.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated October 4, 1999, and recorded in the Suffolk County Clerk's Office on October 20,
1999, in Liber 11995, Page 945.
~y RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
~F and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, to change their remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may direct
and appoint during her lifetime by properly written and acknowledged instrument, and recorded
prior to death, making specific reference to this power of appointment. The party of the first part
may not appoint themselves, their estate, their creditors or the creditors of their estate, under any
circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
