COMMON DRIVEWAY EASEMENT
This agreement made the 24" day of September, 2013, hereby is a modification of an
existing easement between Edgewater I, LLC c/o George Cohen, Managing Member,
having an address at 27 West 96`h Street, New York, New York 10025, their successors
or assigns, Edgewater II, LLC cto George Cohen, Managing Member, having an
address at 27 West 96`h Street, New York, New York 10025, their successors or
assigns, and Edgewater III, LLC c/o George Cohen, Managing Member, having an
address at 27 West 96'h Street, New York, New York 10025, their successors or
assigns.
On November 20, 2001, an easement was executed between the above parties and
recorded at the office of the Suffolk County Clerk on February 7, 2002, in Liber 12168
page 71, and said easement was thereafter amended on September 30, 2003, and
recorded at the office of the Suffolk County Cleric on December 3, 2003, at Liber 12287
page 693.
Said easements were granted for the purpose of constructing and maintaining a
common driveway and utilities over the parcel owned by Edgewater I, LLC (SCTM#
1000-040-01-020.001) (Schedule A-1), Edgewater ll, LLC (SCTM# 1000-040-01-
020.002) (Schedule A-2) and Edgewater III, LLC (SCTM# 1000-040-01-021) (Schedule
A-3);
These easements were terminated as to the common driveway by a release recorded
contemporaneously herewith and are being replaced by this document.
The utility easements shall remain in full force and effect.
This easement shall consist of a common driveway entrance with three (3) separate
driveways. Said modification is depicted on the attached survey prepared by Nathan
Taft Corwin III, Land Surveyor, dated September 5, 2013, attached hereto as Schedule
B.
Each of the parcels shall share a common entrance and maintain three (3) separate
driveways. The modified easement of the driveway which burdens Edgewater Il, LLC
(SCTM# 1000-040-01-020.002) for the benefit of Edgewater I, LLC (SCTM# 1000-040-
01-021) is fully described as set forth as attached hereto in Schedule C-1. The modified
easement of the driveway which burdens Edgewater ll, LLC (SCTM# 1000-040-01-
020.002) for the benefit of Edgewater III, LLC (SCTM# 1000-040-01-020.002) is fully
described and set forth as attached hereto in Schedule C-2.
Being the further intention of the parties to maintain the privacy of the individual
driveways to the three houses and accessory structures, Edgewater II, LLC will plant
natural landscaping or maintain natural vegetation between the modified driveways such
that privacy is maintained.
Being further agreed that the easements are limited to the existing driveways, subject to
such improvements which the Town of Southold may require, and as shown on the
survey by Nathan Taft Corwin 111, Land Surveyor, dated September 5, 2013, attached
hereto as Schedule B.
To the extent not modified, the original agreement and easements above described,
including easements for utilities, are confirmed and continued.
