RELEASE OF EASEMENT
This agreement made the 24th day of September, 2013, hereby is a release of an
existing easement, between Edgewater I, LLC c/o George Cohen, Managing Member,
having an address at 27 West 96`h Street, New York, New York 10025, their successors
or assigns, Edgewater 11, LLC c/o George Cohen, Managing Member, having an
address at 27 West 96th Street, New York, New York 10025, their successors or
assigns, and Edgewater III, LLC c/o George Cohen, Managing Member, having an
address at 27 West 96th Street, New York, New York 10025, their successors or
assigns.
On November 20, 2001, an easement was executed between the above parties and
recorded at the office of the Suffolk County Clerk on February 7, 2002, in Liber 12168
page 71, and said easement was thereafter amended on September 30, 2003, and
recorded at the office of the Suffolk County Clerk on December 3, 2003, at Liber 12287
page 693.
Said easements were granted for the purpose of constructing and maintaining a
common driveway and utilities over the parcel owned by Edgewater I, LLC (SCTM#
1000-040-01-020.001) (Schedule A-1), Edgewater 11, LLC (SCTM# 1000-040-01-
020.002) (Schedule A-2) and Edgewater III, LLC (SCTM# 1000-040-01-021) (Schedule
A-3);
Whereas the parties to the agreement wish to release said easements as they relate to
the common driveway. The utility easements shall remain in full force and effect.
Now therefore, in consideration of the payment of one dollar and other good
consideration, receipt of which is acknowledged, Edgewater I, LLC, Edgewater 11, LLC
and Edgewater III, LLC, they hereby mutually release to Edgewater I, LLC, Edgewater
11, LLC and Edgewater III, LLC, the previous common driveway easement referenced
above, it being the intention of the parties to terminate the previous common driveway
easement.
A new common driveway easement is being recorded contemporaneously herewith.
