INSPECTED BY: '714 COMMENTS- 6, -�- CERTIFICAT AgeF COMPLIANCE: /� John M.Bredemeyer III,President ��q SO&P Town Hall Annex Michael J.Domino,Vice-President �O l0 54375 Route 25 P.O.Box 1179 Glenn Goldsmith Southold,New York 11971 A.Nicholas Krupski COO ® Telephone(631) 765-1892 Charles J.Sanders 'ro Fax(631) 765-6641 BOARD OF TOWN TRUSTEES September 21, 2016 TOWN OF SOUTHOLD Jeffrey Patanjo 106 Hewitt Blvd. Center Moriches, NY 11934 RE: JOSEPH GENTILE 530 SCHOONER DRIVE, SOUTHOLD SCTM# 1000-71-2-8 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, September 21, 2016 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of JOSEPH GENTILE applied to the Southold Town Trustees for an Amendment to Wetland Permit#8317 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 18, 2016, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the lowering of the groin to 18" above mean low water; and the issuance of a permit for the structures that were built beyond the scope of the permit; WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 23, 2016, and September 21, 2016, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit #8317 for the as-built location of the bulkhead alignment and length to be a total of 96 linear feet with a 20 linear foot return; a 3'x12' aluminum ramp to be installed in lieu of a 32"x14' ramp; and for the as-built 12 linear foot long low-sill bulkhead/groin extending seaward off of the bulkhead; with the condition that.low-sill bulkhead/groin be a maximum of 18" above mean low water; and as depicted on the site plan prepared by Jeffrey Patanjo received on October 3, 2016, and stamped approved on October 5, 2016. The check in amount of$200.00 will be sent to your attention directly from applicant. 2. The proposed modification includes the re-orientation of the proposed bulkhead alignment at the north end of the project in addition to the height adjustment of the proposed groin (low sill bulkhead). The original permitted plans were incorrect with regard to the dimension stating the top elevation to be 18" above the existing sand bottom and have been corrected on the most recent submission to represent 18" above the MLW elevation. The groin is proposed to act as a separation device between the proposed floating dock and the existing wetland area which will protect from sedimentation of the area under the proposed floating dock and thereby not require subsequent dredging in order to maintain the required 30" separation at MLW. In addition, the groin will provide for an area on the north side to develop wetlands with the benefit of an area better protected from boating activities. The proposed location of the bulkhead return at the north end of the property was placed at a greater angle to avoid disruption with wetlands and better protect the property. New Bulkhead Landward of Existing Structure The new 8 foot and 20 foot sections of bulkhead shall be constructed landward of the existing structure. The existing sheathing shall not be removed until the landward sheathing is securely in place. Once the new sheathing has been appropriately installed, the old sheathing shall be cut to grade or removed in its entirety. 10. Backfilling All peripheral berms, cofferdams,rock revetments,seawalls, gabions,bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures. 11. Bulkhead Height The new bulkhead height shall not exceed the height of the adjacent bulkheads. 12. No Structures on Bulkhead No permanent structures shall be installed on the authorized bulkhead without first obtaining written department approval (permit, modification, amendment). 13. No Runoff Over or Through Bulkhead or into Wetland There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization structure or into any tidal wetland or protected buffer area. 14. Bulkhead Decking No portion of the decking or boardwalk shall extend seaward of the bulkhead sheathing. 15. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition debris). 16. No Permanent Structures on Dock No permanent structures shall be installed on dock/catwalk/float without first obtaining written Department approval (permit, modification, or amendment). 27. Pilings at Property Lines Pilings shall not: a. extend laterally beyond property lines, b. interfere with navigation, or c. interfere with other landowners riparian rights. 28. No Structures on Pilings No structures, other than structures specifically authorized by this permit, shall be constructed on pilings without further authorization from the department(permit, modification or amendment). 29. Use of Treated Wood The use of wood treated with Pentachlorophenol or other wood treatment not specifically approved by the Department for use in wetlands and/or marine waters, is strictly -_ prohibited in the construction of structures that will be in contact with tidal waters. 30. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 31. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 32. No Interference With Navigation There shall be no unreasonable interference with navigation by the work herein authorized. 33. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State,the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if,upon the expiration or revocation of this permit, the structure,fill, excavation, or other modification of the watercourse hereby authorized shall not be completed,the owners, shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse.
