SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 11, 2013 stating that this application is considered a matter for local determination as th appears to be no significant county-wide or inter-community impact. ere LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated September 22, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT fro Review. in Coastal Consistency PROPERTY FACTS/DESCRIPTION The parcel is 18,217.38 square feet in an R-40 district. The parcel fronts Willow Point Road for 148.92 feet,the eastern boundary is 127.44 feet,the western boundary is 148.73 feet and the northern boundary,which is bulk-headed at a canal, for 110.04 feet. The parcel is improved with a one story frame- stone-vinyl residence,an in-ground swimming pool and floating docks with metal landing and ramps. All as shown on the survey of the parcel prepared by Elizabeth G.McQuilkin, L.S., dated January 31, 2011, last revised July 31, 2013 and August 21,2013 to add Proposed additions and Lot Coverage. BASIS OF APPLICATION: Request for Variances from Article XXII Code Section 280-116(B)and Article XXIII Code Section 124B and the Building Inspector's August 14,2013,amended August 23,2013 Notice of Disapproval based on an application for building permit for additions and alterations to existing single family dwelling: 1 proposed construction at less than the code required bulkhead setback of 75 feet, 2)more than the ) maximum code permitted lot coverage of 20%. I RELIEF REQUESTED: The applicant requests a variance to construct alterations and a second story addition to the existing dwelling at 39.6 feet from a bulkhead where the Code requires a minimum distance of 75 feet. Page 2 of 3—October 17,2013 ZBA#66g9—Donadic SCTM#1000-56-5-26 ADDITIONAL INFORMATION: This parcel was granted a variance for lot coverage not to exceed 23.6% in Appeal # 4602 dated 10/8/1998. In this Appeal before us (#6689), the applicant proposes additions and alterations at 22.969% of lot coverage which is less than the 23.6% granted in Appeal #4602, therefore the Board finds the i request for a variance for lot coverage of 22.969% is not necessary. At the hearing, the applicant's agent submitted an aerial showing the two story dwellings in the neighborhood. Additionally, four letters of support were submitted from neighbors. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3,2013,at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed two story addition is in character of this neighborhood because this neighborhood consists of a majority of two story residences. The proposed additions will not be a detriment to nearby properties because they will be within the code conforming side yard setbacks. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The majority of the existing residence exists within a non- conforming bulkhead setback and any proposed second story addition to this residence will require a bulkhead setback variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 47%relief from the code. However, the proposed second story addition is within the existing foot print of the residence and is characteristic of this neighborhood. 4. Town Law &267-b(3Nb)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-6(3)(6)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing alterations and a second story addition to the existing residence at a 39.6 foot Bulkhead setback, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Dames, and duly carried,to GRANT, the variance for a 39.6 foot Bulkhead setback as applied for, and shown on the survey of the parcel prepared by Elizabeth G. McQuilkin, L.S., dated January 31, 2011, last revised July 31, 2013 and August 21, 2013 to add Proposed and Lot Coverage, and the architectural plans prepared by James Curtiss, R.A., sheets A.01 thru A.07 inclusive,dated 5.1.13. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
