Wee House Partners is ready to comply with their permit which requires them to "remove the three pile cluster and remove the easterly wave break". (The seaward modifications to the dock must be accessed by barge and will be done at the same time. ) However, Mr. Kelly is very concerned about the loss of the wave break on the Wee House Partners dock. Mr. Kelly's dock which is smaller than most of the docks in Orient Harbor has no protection from wave action without the Wee House Partner's wave break. At the hearing on Wee House Partner's existing dock, the fact that the wave break extended into the Kelly's waterfront created an issue for the Board. The Board advised that their practice was to require a separate permit for any structures which extend into the adjacent owner's land. However, the Kelly's dock was not before the Board. In order to resolve that issue, both Mr. Kelly and Wee House Partners have submitted an application, jointly requesting that the Board consider allowing the restoration of the easterly wave break (rather than removal). At the time the Wee House Partners application was before the Board in February 2012, Mr. Kelly's ramp and float were not on the Wee House plans. In this application, Sea Level Mapping has prepared both plans and shows the location of the existing structures. Mr. Kelly's application shows the proximity of the existing dock and the protection provided by the existing wave break on the Wee House dock. Wee House similarly agrees that the wave break provides additional protection from wave action for their vessels and the dock. • • We respectfully request that you accept the applications and we be permitted to proceed to a public hearing. SCTM# 24-2-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policies 4.1 and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas.
