during their regular meeting held on February 28, 1989 as follows:
WHEREAS the Town Trustees have conducted an on site inspection
of the subject property.
RESOLVED that the Town Trustees approve the request made by
Arnold Blair for a waiver to construct a single family dwelling on
property located on Pine Place, East Marion, N.Y., identified on
Suffolk County Tax Map as 1000-37-7-10.2.
Please return to the Building Department for a determination on

Dear Mr. Krupski:
In response to John Holzapfel's concern that the western fence at the above premises extends
below the spring high tide mark, Mr. Blair consulted Charles F. Vachris, P.E., and was
informed that the federal government records and publishes figures for tidal variations.
Please see the attached correspondence from Mr. Vachris which indicates that the difference
between the mean high tide and mean spring tide is .30 feet at the closest tidal station
available to East Marion.
On December 14, 1995, Mr. Blair asked Colin Van Tuyl to stake the spring high water
elevation at the western fence (see attached copy of fax). Yesterday, Mr. Van Tuyl assured
Mr. Blair that this elevation would be marked in the very near future.
As soon as the spring high water elevation has been marked, Mr. Blair or I will be in contact
with the Trustees. However, in the interim, my clients respectfully request that the fence
remain intact.

Jill asked me to review the Certificate of Abandonment filed by the Blairs in
order to get a permit to construct a fence over the road designated as Beach
Court on the map for Gardiners Bay Estates.
Real Property Law Section 335 provides a mechanism in which streets which are
not used by the public and not necessary for use, can be abandoned by the
surrounding parcel owners, After the abandonment, the parcels are considered
a single tract of land,
The certificate shows that the Blairs are the owners of the parcels surrounding
the abandoned road. An abstract of tltle must be submitted with the certificate
which would confirm this. I don[t see a copy of this in the file, but it was
accepted by the County Clerk for filing, so it was probably submitted to them.
Based on the information presented to me, it would appear that Beach Court
has been abandoned. If you want to be more thorough, you~sh~ld~g~t~ceJ~
of t~b~ts~~tle, and confirm via a site visit that Beach Co~-t is not
opened to the pu~)hc.

abandoning and canceling the subdivision of a certain tract of land
owned by them and hereinafter described, pursuant to New York Real
Property Law § 353(3), do hereby certify as follows:
1. A certain map dividing such tract of land and Other land
situate in the Town of Southold, County of Suffolk, State of New
York, into lots, plots, blocks or sites, with opened and proposed
roads, entitled "Map of Section 2, Gardiners Bay Estates,, was filed
in the Suffolk County clerk's Office on September 23, 1927 as Map
No. 275;
2. More than twenty (20) years have lapsed since the filing
of said map;
3. The tract of land owned by the undersigned which is to be
abandoned and canceled, is situate in the Town of Southold, County
of Suffolk, New York State and is a portion of the street known as
Beach Court, more particularly described in "Schedule A" which is
annexed as Exhibit A, and made a part hereof;
4. The undersigned owns the property on both sides of the
portion of said street to be abandoned, being the same premises
conveyed to the undersigned by deed dated 7/25/83 and recorded in
the.office of the Suffolk County Clerk on 8/2/83 in Liber 9398 Page
202, a copy .of which is annexed as Exhibit B, and made a part
hereof.
5. The portion of'said street to be abandoned is 'entirely
within the bounds of the property to be abandoned, and such portion
thereof is neither opened, nor public highway, nor used by the
public, nor necessary for the use of owners, occupants or any other
persons having a~ interest in any part of the subdivision;
6. The undersigned does hereby A~ANDON and CANCEL the
subdivision of such tract of land described in "Schedule A",
including a portion o~ said street known as Beach Court which shall

Dear Mr. Krupski:
At your regular meeting of June 30, 1995, the Board of Trustees
approved a waiver to construcn a 6' split rail fence to mark the
boundary lines of my clients' property to the edge of Beach Court
and to post no trespassing signs.
At this time, the Blairs request an amendment to the waiver which
would allow them to extend the fence across the abandoned portion
of Beach Court which was merged with the Blairs' upland and
underwater lots, pursuant to the enclosed Certificate of
Abandonment (3637 CTF), approved by the Southold Town Assessors and
filed with the Suffolk County Clerk's office on July 7, 1995.
In addition, I have include a copy of the property survey which
identifies the location of the fence subject to your approval.
If you or the other trustees have any questions, please do not
hesitate to contact me.

202, a copy of which is annexed as Exhibit B, and made a part
hereof.
5. The portion of'said street to be abandoned is entirely
within the bounds of the property to be abandoned, and such portion
thereof is neither opened, nor public highway, nor used by the
public, nor necessary for the use of owners, occupants or any other
persons having a~ interest in any part of the subdivision;
6. The undersigned does hereby 2tBANDON and CANCEL the
subdivision of such tract of land described in "Schedule A",
including a portion of said street known as Beach Court which shall
no longer exist upon the approval and recording of this
certificate.

lines of applicant's property as shown on survey.
The CAC recommends disapproval because the fence would deny access to the
beach and it appears from the survey provided that the fence is going across
Beach Court which does not appear to be the applicant's property. Also the
proposed fence could possibly destroy beach vegetation.

66-3-9 to 1) construct single family residence, 2)timber bulkhead along
westerly bank of Pettys Pond, 3) catwalk and dock as per submitted plans.
1) The CAC recommends APPROVAL OF THE SINGLE FAMILY DWELLING.
2) The CAC recommends DISAPPROVAL OF THE BULKHEAD. There is no
demonstrated need for the bulkhead. The area is well stabilized; there is no
erosion problem; and the house is far enough back so that it is not in danger.
Since there is no need for the bulkhead then there is also no need for bring in
clean fill and/or sand to backfill.
3) The CAC recommends APPROVAL OF THE DOCK AND THE CATWALK IF
OF AN APPROPRIATE LENGTH TO REACH UPLAND.

We have revised the location of the proposed develop-
ment as shown on the attached site plan.
Note that the setback from the water remains the
same. The relocation is proposed in order to allow
a maximum number of trees to remain and to take
better advantage Of available vistas. You will note
that the new location places the house ~ithin what
appears to be an old spoil site, now vegetated by
Phragmites.
Stakes will be placed by April 12, 1989, and the
property may be inspected at your convenience.

Trustees, who have issued a letter of no jurisdiction.
