COMPUTATION OF PERMIT FEES: TOTAL FEES DUE: $ BY: James F. King, President Board of Trustees • i My name is Susan Rackett-Rossetti. I grew up on Shipyard Lane, in East Marion, in the house where my parents have lived for 63 years, and I currently live once again on Shipyard Lane. When I was little, the beach at the end of the road was a big beautiful sandy beach that extended out more than 500 yards from where the current beach is. In addition, there was also a wide area of beach grass between the end of the road and the sand of the beach, and the road itself extended out far beyond where it currently ends. After the old oyster plant put up bulkheads in the early 1940's, the beach began to erode, until there was nothing left except a narrow strip of stones and rocks. The oyster plant closed in 1986, and since then the bulkheads have deteriorated enough to allow the natural flow of sand along the beach to return. As a result, the beach has begun to rebuild itself. I have copies of several photos attached, taken 21 to 27 years ago, and another taken recently, illustrating the state of the beach. I also have several comments: • The Public Notice that was posted only contained information about work to be done between the west end of the existing rock revetment, and the dock. I do not have an objection to that. • I do object, however, to the other part of the project that was only noted on file in the Trustee's Office. This concerns rebuilding of the existing rock revetment. This was not posted as a Public Notice. t O CT 1 6 9 1' -I 0 The end of Shipyard Lane is a public beach. I am concerned that the height of the proposed rocks at the end of the road will restrict access to the beach for anyone who is not agile, such as seniors. And, why are two different types of remedies proposed for each of these two sections? The area between the existing rocks and the dock propose a berm, with plantings of native grasses and shrubs. The non-posted proposal regarding rebuilding of the existing rocks only talks about the rocks being built up higher. - _ t D 2: LCT s 2, ,J Soo haia Board Trust( r x ~a l 1 ~ _ _ r r a~ _.a.-.e., ~ , - - - ~ , - - i,. s I S: F - N" iy I - PYni'. Suathodiown' Subject: Proposed "Coastal Erosion Permit" for Cleaves Point Club and Marina Inc. To Whom It May Concern! 1. The Cleaves Point Club and Marina Inc. is requesting a "Coastal Erosion Permit." A notice of hearing was posted on 10/08/2013 by the entrance to the condominium complex as well as a copy of a notice was provided by Board of Trustees. Both notices are requesting a Coastal Erosion Permit for a construction situated: "...between existing rock revetment and dock, and landward...... (please see attached copies of both notices) I do not object to: "Construction in the westerly portion situated between existing rock revetment and dock.... 2. However, there appear additional request that is not explained by both notices mentioned above. There is a following statement that can be found on "A Partial Site Plan - Area of Work". It states the following: AREA OF HORK. RE-ESTABLISH TOP OF FXISTING REVETMENT TO EL 4 4' R THE P I RM APPROX. ±10 GU.Y05 OF PROP05EO 40-50 LB GORE STONE 5HALL BE PLACER OVER THE EX15TING REVETMENT 5TONE. PERIODIGLY, THE REVETMENT MILL BE INSPEGTED AND IF NEGE55ARY REWUR151-ED WITH STONE TO MAINTAIN THE TOP OF REVETMENT AT EL. 4.4'. • • Page 2 of 7 This additional plan proposal should not and cannot be permitted due to the fact that no appropriate information has been provided in acceptable due time for fair public review and project evaluation. Both notices, available for public review, do not mention this additional work, concerning re-establishing revetment. There are issues concerning this proposal: ¦ Public is not appropriately informed about this proposed major public beach re- construction. ¦ There is no beach errosion in the area proposed on the "Partial Site Plan - Area of Work" (see attached photos). ¦ This type of approach (revetment) would destabilize natural approaches to hydrological and ecological balance. ¦ There are other options that are environment friendly than re-establishing 4.4` revetment (see attached report: NATURAL SHORELINE STABILZATION)_ ¦ This public beach, as small as is, is recognized as a scenic site. ¦ Senior citizens, handicapped and children would be unable to access this public beach, because of revetment. ¦ Loss of public beach rights. Let it be on the record that I do object to this proposed additional work, found on "A Partial Site Plan - Area of Work", which states: "RE-ESTABLISHING TOP OF EXISTING REVETMENT TO EL 4.4 (please see attached copy of a PARTIAL SITE PLAN - AREA OF WORK) I am objecting to it for the reasons mentioned above. Yours truly, J Kent Incl. For further information, please see attachments. ¦ NATURAL SHORELINE STABILIZATION Report ¦ Current beach photos ¦ Copies of notices ¦ Copy of a PARTIAL SITE PLAN - AREA OF WORK • • Page 3 of 7 NATURAL SHORELINE STABILZATION (NATURAL SHORELINE STABILZATION AND OTHER OPTIONS RATHERTHAN RE-ESTABLISHING 4.4' REVETMENT) The public beach, located on Gardiners Bay, at the end of Shipyard Lane and adjacent to the Cleaves Point Condominium Complex, is a small beach used by general public as well as it is recognized as a scenic site. However, it appears that there is a proposal to re- establish revetment on this beach for the purpose of limiting storm drainage volume from the Cleaves Point Condominium Complex. Re-establishing 4.4` revetment for the purpose of limiting storm drainage volume, would only destabilize natural approaches to hydrological and ecological balance. This beach is not erodins. On the contrary, this beach is recovering through natural process (see attached photos). Placing revetment (loose rocks or stones) would only destabilize the shoreline condition and trigger erosion. It is recognized by DEC that these types of structures (e.g. rip rap - loose rocks and stones) reflect wave energy rather than absorb it, thereby worsening turbulence and increasing erosion. Perhaps other methods, soft methods recommended by DEC, should be explored in order to prevent erosion and improve drainage of excess water. For example, planting native, deep-rooting vegetation or planting the trees and shrubs along the shoreline. The condominium grounds are not level. On the contrary, the grounds along the shoreline are sloping downward-inward, creating basin. This area is usually flooded. Leveling these grounds and using soft methods recommended by DEC would be environment friendly approach, improve drainage and stabilize the shoreline. All these methods should be explored rather than using revetment method. This small beach is an important part of our community, preserving it should be our priority. Residents of East Marion, whether senior citizens, handicapped or children, are using this public beach. This beach is recognized as a scenic site as well. This proposed re-established 4.4` reventment would deny access to the beach and exclude the rest of the community from their beach rights. There is no beach errosion. However, implementation of the 4.4` revetment would only destabilize natural approaches to hydrological and ecological balance and trigger erosion. This would be man-made erosion. J. Kent i ~ . Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Box 1179 aout~ a:c'w i tr ;rt, Southold, NY 11971 Board ` Re: Cleaves Point Club and Marina, Inc., 2820 Shipyard Lane, East Marion Dear Mr. King: We recently submitted an application on behalf of Cleaves Point Club and Marina, Inc. requesting permission from the Trustees to implement projects designed to address chronic erosion and drainage issues that were exacerbated during Hurricane Sandy last year. Since submission of the application, two additional features of the drainage plan were developed by Jeffrey Butler, the project engineer, which we would like to add to the project design. The first is the addition of two additional infiltration basins and the second is the addition of some stone to raise the top of the easterly portion of the existing rock revetment, which has slumped over the years such that the top elevation of that portion of structure has fallen between 6 and 12 inches lower than the rest of the structure. The design concept for the raising of the end of the revetment is depicted on the attached sketch, "SK-1," from Jeffrey Butler, which we wanted you to have in hand during your upcoming field inspections. If this plan addition is acceptable to the Board, we would submit a site plan revised accordingly to reflect this design and the two additional infiltration basins. Should you have any questions regarding any aspects of the project, please feel free to contact me at your convenience. Res fully yours, Robert E. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project will be located entirely landward of the spring high water line and unvegetated tidal wetlands area along the subject shoreline. The proposed protective dune structure will be reinforced intemally with buried armor stone but during normal, non-storm conditions will act and serve as a vegetated, sandy dune that will provide a source of habitat and food supply for the adjacent ecosystem. Thus, the project will have no significant adverse impacts on the adjacent, unvegetated tidal wetlands area or tidal waters of Gardiners Bay. or oard of Trustees ApplicaWn COASTAL EROSION APPLICATION DATA Purposes of proposed activity. To provide shoreline stabilization and flood and erosion control in westerly and only portion of subject shoreline not presently stabilized by the existing stone revetment. Are wetlands present within 100 feet of the proposed activity? No X Yes Does the project involve excavation or filling? No X Yes If Yes, how much material will be excavated? +/-389 (cubic yards) How much material will be filled? +/-489 (cubic yards) Manner in which material will be removed or deposited: See attached plans. Describe the nature and extent of the environmental impacts reasonably anticipated resulting from implementation of the project as proposed. (Use attachments if necessary) The construction of the proposed reinforced dune entails the placement of armor stone partially below and approximately 3 feet above existing beach grade, which will then be completely buried with an approximately 23' wide, 4' high dune feature to be planted with native vegetation. During normal and mild storm conditions, the resulting dune structure will provide habitat and food supply for the adjacent ecosystem while providing flood and erosion control for the upland property. During severe storms when the sand may be severely enough eroded to compromise the integrity of the dune, the buried armor stone will serve to stabilize the shoreline and mitigate against unabated shoreline erosion. The stone will also maintain a "line in the sand" around which the sand dune may be reconstructed and revegetated after such a storm event or storm season. Consistent with Policy 4 of the LWRP, as evidenced by a previously failed installation of bio-logs and plantings (see Figure 4), the reinforced dune is proposed where non-structural, vegetative erosion control methods alone have proven to be insufficient at stemming erosion of this only remaining unprotected portion of the subject shoreline to the west of the existing rock revetment and where a naturally protective feature is otherwise absent. Thus, while sand renourishment and vegetation in the form of a constructed dune that is intended to recreate a natural protective feature will serve as the effective source of erosion protection during normal conditions as noted above, the proposed armor stone must be included in the design to provide a last resort method of shoreline stabilization during an avulsive storm event. But further consistent with Policy 4 and with Chapter 111-15, the armor stone will be buried inside the sandy, vegetated dune feature, which will be constructed with a naturally sloping face and will be located entirely landward of spring high water and tidal wetlands to ensure that it does not adversely impact the adjacent tidal wetlands or tidal waters; does not cause a measurable increase in erosion at the site or adjacent properties; and does not interfere with natural coastal processes. Moreover, the reinforced dune structure has been designed to the minimum scale necessary and in accordance with sound engineering practices to ensure the long term success of the structure at controlling erosion. As part of the long term maintenance of the structure, the success of the vegetation will be monitored and ensured, and the sand dune will be replaced as needed. • 617.20 SEQR PROJECT ID NUMBER APPENDIX C STATE ENVIRONMENTAL QUALI REVIEW SHORT ENVIRONMENTAL ASSESSMENT FORM for UNLISTED ACTIONS Only PART 1- PROJECT INFORMATION ( To be completed by A plicant or Project Sponsor) 1. In easterly portion of property along inside of easterly property line and landward of the Coastal Erosion Hazard Area boundary, construct partially within Chapter 275 jurisdiction a +9'- 15' wide x +197' long x +1' high earthen berm consisting of approximately 36 cubic yards of topsoil; and install 8' diameter x 3' deep infiltration basin west of the +12' wide portion of berm. All work is to be done in accordance with the "Shoreline Stabilization Plan" prepared by Jeffrey T. Butler, P.E., P.C., last dated September 16, 2013. The project will be located entirely land*f the spring high water line and unvegetatedl wetlands area along the subject shoreline. The proposed protective dune structure will be reinforced internally with buried armor stone but during normal, non-storm conditions will act and serve as a vegetated, sandy dune that will provide a source of habitat and food supply for the adjacent ecosystem. Thus, the project will have no significant adverse impacts on the adjacent, unvegetated tidal wetlands area or tidal waters of Gardiners Bay. Attach additional sheets if necessary Policy 7.
