Pundyk PROPERTY LOCATION: 1185 West Mill Road, Mattituck, NY S.C.T.M. # 1000-106-9-8.4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application does not fall under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION The parcel is a developed 139,657 square foot lot. The lot has 164.40 feet of frontage on Mill Road, 329 feet on the South side, 271.61 feet on the West side, and 647.5 feet on the North side. There are two structures on the parcel. One structure is a two-story farm house and the second structure is a one story frame garage. The total percentage of lot coverage by building area is 1.98%. The existing square footage of buildings on the property is 2,770 square feet. The north side of the property is shaded with a four-foot hedge. The rear half of the property is a fallow field. All is shown on a survey by John C. Ehlers L.L.S. dated February 7, 2013 and listed on the ZBA "Applicant's Project Description" form under section N filled out by applicant's agent Andrew Berman Architect on September 18, 2013. BASIS OF APPLICATION: Request for Variances from previous ZBA Grant #5498, conditions #1 and 2 and the Building Inspector's September 6, 2013 Notice of Disapproval based on an application for building permit alterations to an existing non-conforming building with a conforming use (garage) at: 1) change in use from accessory storage garage, 2) addition of utilities other than electric and cold water. RELIEF REQUESTED: The applicant requests a variance on this conforming 139,657 square foot parcel in the residential R-80 district to repeal the conditions restricting the use of the garage listed in ZBA Decision # 5498. ZBA Decision # 5498 granted a variance for the garage's side yard location with the conditions that 1) the garage be used only for accessory storage as authorized by code and 2) the utility of electric and cold water shall be permitted, and that other plumbing and heat is not permitted in the garage. ADDITIONAL INFORMATION: During hearing testimony was taken that the applicant wishes to turn the garage into a workshop. The applicant wishes to finish off the existing space as well as add radiant heat and a sink to the proposed work shop. The applicant's agent stated there would be no loud noise from the proposed activity or any viewing or sales of artwork to the public. Page 2 of 3 - November 21, 2013 ZBA#6694 - Pundyk SCTM#1000-106-9-8.4 FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing structures have certificates of occupancy and there will be no change in the foot print of the existing structure. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the applicant is not requesting relief from the current building code, but is requesting relief from conditions placed on the property by ZBA decision # 5498. The proposed action conforms to current building codes. The non-conformity is the proposed workshop's side yard location for which the ZBA previously granted relief. 3. Town Law 4267-b(3)(b)(3). The variance(s) granted herein is not mathematically substantial, representing 0% relief from the code. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after ZBA decision # 5498 was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a work shop while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dames, seconded by Member Goehringer, and duly carried, to GRANT, the variances as applied for, and shown on the site plan by Andrew Berman Architect dated September 16, 2013 labeled A-000; 001;100; 101; 110; 111; 200; 201; 300; E-110; and the survey prepared by John C. Ehlers L.L.S. and dated February 7, 2013. CONDITIONS: 1.) The workshop is not an Accessory Apartment and therefore may not be used as sleeping/living quarters. 2.) The work shop may not have a kitchen or a shower or bathtub. 3). Public viewing of art work is prohibited. 4). There shall be no commercial or private sales of artwork from the accessory structure. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The property is improved with a two-story frame house, accessory garage, and accessory storage trailer BASIS OF APPLICATION: Building Department's February 5, 2004 Notice of Disapproval, citing Code Sections 100-33 and 100-242A in its denial of a building permit application concerning an accessory garage, which will become more nonconforming in its existing side yard location, after construction of proposed additions to the dwelling. The code requires an accessory building to be located in a rear yard. The new construction is at the side of the existing detached garage, and the April 18. 2002 Building Permit (#28291-Z) required a relocation of the accessory garage to the rear yard location, as applied for. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on Parch 18, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant AREA VARIANCE RELIEF REQUESTED: Applicants recently constructed new additions to the existing dwelling, as shown on the March 29, 2002 amended survey prepared by John C. Ehlers. L.S The porch at the rear of the dwelling places more of the existing garage in a side yard location. The existing garage replaced the former garage destroyed by fire (BP#11980-Z), and has remained in its present location since 1982, with setbacks 25 feet from the south side line and at least 115 feet from the easterly (front) lot line. REASONS FOR BOARD ACTION.
