(631) 765-1809 • Fax (631) 765-9064 - /7 5o thold Tto(wn CI FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 21, 2013 ZBA FILE No.: 6695 NAME OF APPLICANT: True Light Church (Keith Benson) SCTM41000-102-2-24.1 PROPERTY LOCATION: 31095 Main Road (aka State Route 25) Cutchogue, NY SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 8, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The granting of the Special Exception permit should not interfere or create a future impediment to any agricultural operations on the protected farmland adjacent to the subject parcel. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION Subject property is located on the North side of Main Road on the west corner of Sterling Lane as shown on partial site plan dated October 20, 2000 prepared by Cronin and Condon, consulting engineers. It is located in a B Zone and the proposed church is a permitted use. It is an improved parcel consisting of two commercial buildings and associated parking. It received site plan approval October 31, 1988. BASIS OF APPLICATION: Request for Special Exception per Code Section 280-48B1, the applicant is requesting permission to convert existing office space to a church. ADDITIONAL INFORMATION: The Zoning Board requested comments from the Planning Board on this application. In a memo dated October 23, 2013, the Planning Board stated, "The proposed special exception use of a church at this location is consistent with the Town Code and the Town's Comprehensive Plan. The Planning board recommends that an expiration date of one year be set for the special exception to be able to monitor the parking situation in the future and to Page 2 of 3 -November 21, 2013 ZBA#6695 - True Light Church SCTM#1000-102-2-24.1 be able to deal with potential growth that exceeds the current parking lot." When this issue was discussed at the public hearing, the Pastor indicated that he would create an early and later worship service if the existing onsite parking becomes insufficient to accommodate all the members of the congregation at once. The subject parcel is zoned B1, and the building have existed since prior to zoning. The property has received several variances and the last was a Special Exception Permit granted to a pre-school under permit #6397 in 2010. The pre-school has vacated the premises and the proposed church is intending to utilize the space. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. The hours of use are limited to weekends and occasional evening meetings during the week. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. The proposed church use is a permitted use in this zone. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. Religious uses are inherently beneficial, and the proposed church will promote rather than detract from the welfare of the community. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The proposed use will occupy an existing but currently vacant structure. There are no additions or exterior alterations being proposed. The size and operation of the church is modest and the applicant is proposing additional worship times if the congregation exceeds the parking lot. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. G. That the proposal shall comply with the requirements of Chapter 236, Storm Water Management. BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried to Page 3 of 3 -November 21, 2013 ZBAH6695 - True Light Church SCTM41000-102-2 -24.1 GRANT, the Special Exception Permit, as applied for, and shown on the floor plan prepared by True Light Church dated 9/25/13. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Special Exception Permit granted herein may involve a change in occupancy or a change in use or a change within a classification of the occupancy. Therefore, as a condition of approval, the applicant must contact the Building Department to make the determination whether or not a Building Permit is required and that changes will be NYS Code compliant. 2. This Special Exception Permit requires an operating permit and inspection by a Code Enforcement Officer from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department on an annual basis to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: This Special Exception permit cannot be transferred. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. It received site plan approval October 31, 1988. BASIS OF APPLICATION: Request for Special Exception per Code Section 280-13B(4), the applicant is requesting permission to convert existing office space to operate a nursery school. ADDITIONAL INFORMATION: According to the code, site plan approval is also required by the Planning Board.
