STACY PALIOVAS: Stacy Paliovas, and I have property in Peconic on Route 48 and Paul's Lane. I
believe the area that I have the property is an industrial area. I am surrounded with business. That is how I

see it. Now, by changing the zoning on my property I am going to get stuck. It is an industrial area. All
day trucks go in and out in the area, loading and unloading. I am not complaining. When they are loading
and unloading it is not pleasant. What I am asking, please, don't change my zoning. I would like to open
a gift shop. I am not going to change the house. I will leave the house the way it is. I have been trying to
get the permit now for a long time. Because of the moratorium it has been delayed, and I never got them,
and now you are changing the zoning again, and I am stuck. I don't know which way I am going. Please,
don't change the zoning of my property. Thank you.

JOHN SATKOSKL John Satkoski. I am in opposition of having the zones changed, and that 055-5-6, and
I got a couple of questions I would like to ask you. One of them is we have been talking about open
corridors, and different things like that. Is this open corridor going to be for the whole town of Southold?
SUPERVISOR COCHRAN: I don't know what you mean by open corridor.
JOHN SATKOSKL What would change. In other words, open space, air space, whatever you want to
call it. We have called it all kinds of names. Is it going to be for the whole town?
SUPERVISOR COCHRAN: It affects the entire town. Yes, John.
JOHN SATKOSKL Okay, then I think that the whole town should pay for this.
SUPERVISOR COCHRAN: From Mattituck to Greenport.
JOHN SATKOSKL I think the whole town should pay for this, not just have one guy come in and say,

nothing is really changed as far as we go. I have a copy of the letter from last year. I also know that last
year I went, and I know a whole bunch of other business people went, and we had friends, and all kinds of
people in town, friends and neighbors, send all kinds of letters, and I remember you even stating that you
had a folder this thick of people saying that they had no objection to this, and I am not a pesky person so I
did not want to go bugging neighbors and friends again, but I am sure you still have them all in your file
from last year, so I didn't think you needed to accumulate another whole file for you. Nothing has
changed on my end, but I hoping that circumstances might have changed on your end as to how you feel
about this. My husband and I have had that business on the corner since 1964. It was a derelict building
when we purchased. We have added on to it three times. The Town took road frontage from us. We are
completely maxed out. It is impossible for us to add on anymore. About five or six years ago we
purchased a piece behind us, which is zoned LB. We did not buy it for speculation. We purchased
hopefully that maybe we could someday put up a new building and expand on it. As you know what is
allowed in Limited Business is very limited, and I really don't understand how if that is changed from

Limited Business to Agricultural it would do one bit of good for the town. If a structure is put up on that
piece of land, and it is an agricultural building, how is it going to be any better for the town's appearance
than if we put up a building that you can't even see, because we would have assess from Kenny's Road to
it? We have grown from one employee to ten employees, and it is not just our generation, but not just my
son but one employee his son has gone off to school for four years, and come back, and is now employed
with us for four or five years. It is a highly skilled business. In fact one of my neighbors said to me that
they thought the Town had requested a bond issue to attract small businesses. Is that correct very
recently? No. Okay, then I take that back. I thought I had heard something about that. Well, anyway we
are a small business, and we are here, and we would like to stay here, and we don't consider ourselves a
problem. We have all local people, and that is about all I can say. I don't see where the zoning would be
good for certain not us, certain not for any of our employees, and I certainly don't really think it would be
helpful to changing it Agricultural for the town. I also wanted to just say a few words on behalf of my
neighbor, Alice Surozenski, who has a small little parcel right adjacent to mine. It is .20. There is
absolutely nothing that can be done with that if it is changed to Agricultural, which again, if you put up a
farm stand, which you would be allowed to do, could certainly be much more detrimental in certainly
October and Christmastime with the traffic that could be drawn there instead of just probably adding on to
the little existing businesses that would be adjacent to it, and obviously I am opposed to your changing the
zone. Thank you.

CLEMENT CHARNEWS: My name is Clement Charnews. I live on 48. I object to the change. I have
been riding from Mattituck to Greenport for the last I don't know how long. I can't see one business that
is an eyesore, where there is any traffic problem, where people are causing a problem, and all these
businesses are nice and clean. Everything is kept nice. We have a four-lane highway. We can't go back to
the old days. Somebody at one of the last meetings said they would like to stop and pick something along
the road. No problem. If they are in Cutchogue just drive up to Oregon Road, and drive along there, and
pick what you want. You are not going to change this four-lane highway back to that. I really don't like
my property devaluated, because it is zoned for Light Business, and I think it should stay that way. I see
across the street that building there I think is one eyesore from my property. Now it is Agricultural. I
don't know what it is going to be. It is deteriorating all the time. I just hope that all the buildings along
48 don't end up like that someday. That is the only eyesore on 48, and I just hope that there will not be
anymore. I like 48 the way it is. It is four-lane highway. We can't change it. We are not going to change it
back to a two-lane highway, and it is not going to become the old days again. It is beautiful the way it is.
We have beautiful businesses. (tape change) Why should we change it? We have something great. That is
all I got to say.

SUPERVISOR COCHRAN: Thank you. Anyone else on this side like to address the Town Board?
WALTER PHARR: I am Walter Pharr, and my property number is 59-9-30.4. My property is located on
the north side of Route 48 between the machine shops on Kenny's Road, and Sound Shore Excavation on
my west. My property is about one acre in size. It is currently zoned Limited Business. It has been zoned
Business in one form or another ever since zoning was implemented in Southold Town. On this property
sets 5,000 square foot cement building, which serves as a warehouse for my toy wholesale business. Mr.
Cramer is recommending that my property be upzoned from Limited Business to Agriculture. Within a
few years I will have lived in Southold Town for thirty years, and over that period of three decades I have
never seen any agricultural activity on this property. In fact when excavators dug my foundation they
unearthed boulders this big. So prime agricultural land it is not. When I look at my side of the road from
Kenny's Road west to my property I see three developed buildings, three houses, thirty foot trees, and no
agriculture. To have a vision of agriculture in this picture is truly a Disney fantasy. I have read the Cramer
Report, and I have read its predecessor reports, and I agree with the goals of these reports, the
preservation of farmland, enhancement of vista, management of traffic flow, enhancement of Hamlet
Business. The question is how is upzoning my little parcel of land make a contribution to the achievement
of these goals? I believe it does not. The situation here is quite bizarre. You have accepted the business
legitimacy of my business neighbors to my west. You voted six to nothing, and quite rightly so. To accept
the business legitimacy of Doroski Nursery, and Sound Shore Excavation, and to my east Mr. Cramer
accepts that business legitimacy of my two easterly business neighbors, S & L Irrigation, and Future
Machine Shop, but he does this in a most bizarre manner. He does not include them in the report. We only
know he accepts them by default. He does not provide us with the criteria by which we can know why
they are acceptable, and why I am not. This is not very scientific. I think Mr. Cramer can be best
understood as an artist. He looks at Route 48, and looks at a map, and says, there is too much business
property in Mattituck, let's change the map color. Down here in Peconic there is not enough business,
let's change the map color. Over here in Southold there is too much business, we will leave this guy but
the guy next to him, he is out of there. Now, let's look at our map. Isn't nicely colored, and don't the
business sections flow in a nice manner? The problem here is Nexus, or the lack of Nexus. Nexus is a
term used in matters of public policy and law to mean connection. There must be a connection between
the purpose of a policy, and the actual policy implemented to achieve those purposes. Without Nexus all
we are left with is subjectivity, irrationality, fanaticism, and the basis of many court victories for those
who must seek judicial relieve to right the wrongs of terrible upzonings. Now, I have heard you say to
people like me, well, you are going to be grandfathered in. You are not going to be hurt by this. This is
my answer to you. I wish you would live by example. I wish you would sacrifice something important to
you, and I think you would then come to feel in common with me that maybe there comes a time in your
life when you have to make a sacrifice for Southold Town, but if you do you want your sacrifice to be
crucial to the town. You want it to mean something. This sacrifice you are asking me to make is stupid. It
is irrelevant. It is meaningless to the town. If you upzone me to Agriculture, I will have a number of uses
that I can count on one hand. I can continue doing what I am doing, but I cannot live forever. I am too
small a lot to be a church or a school. I might become an agricultural storage building, but I have to an
accessory use to a farm, and I am not part of a farm. I might become a house. I could tear my building
down, and build a house. I might become a veterinary clinic. That's it. Those are the uses limited to me in
Agricultural, so you have extracted a tremendous amount of value from me. Consider this. If my building
burns down, and I lose fifty percent of my building, and I am upzoned, I cannot rebuild. I am finished. I
have lost it. Now, who in their right mind is going to buy my property with such a restriction in mind?
There is only one way such a person would buy such a property with such a restriction, and that is at a
huge discount to market price. So, again, you have extracted a huge amount of value from me. Are you
trying to tell me that the future of Southold requires that such value be extracted from a person like me?

Well, I can hear someone say, oh well, you can't make an omelet unless you break an egg. Well, that is
the language of the ends justify the means. That is not the language of America. The progress in Southold
should not be built on the broken backs of people like myself. Now, I can hear someone say, oh well, how
spot zoning? You are going to be spot zoned, Pharr, if we leave you alone. The reality that I see is that
you and Mr. Cramer are creating spot zoning by changing various zones around town. For example, let's
look at S & L Irrigation on the corner, on the northeast of Kenny's Road and Route 48. Why is that not
spotting zoning? Particularly since the land going all the way to Horton's is agriculture. Well, it is not my
purpose to attack S & L Irrigation. My purpose is to say, this stuff is subjective. It is not science. I believe
you should not change a property zoning unless there is a huge demonstrated need to make such a change,
and no such need has been represented here. The only need is that of an artistic planner, who is trying to
create a Disney like version of agriculture in Southold. There is one more thing I hear. This is, well, your
property might morph into something terrible to the Town of Southold. I do not understand that
comment. We are zoned Limited Business, and the Code of Southold, the Zoning Code, is quite specific
as to what can go into Limited Business. There is like a dozen different things, so you know, and I know
that you can control what goes into these sections. You do not have to sterilize properties like mine.
SUPERVISOR COCHRAN: Thank you. Yes, ma'am?
CATHERINE TSOUNIS: John Siolas, my husband and I, Catherine Tsounis, object to the zoning of our
property located on the south side of Route 48 east of Chapel Lane. The property contains 1.2 acres. I
have discussed our stand at previous Town meetings, and I have presented to you at previous Town
meetings petitions that amount to probably 100 signatures. I have presented to you articles from
newspapers. I have been getting phone calls from people all over Southold Town telling me I have a
legitimate case. It is impossible to build a Home Depot on 1.2 acres, when only three quarters of that acre
can be built on. A half an acre is swamp. A two-family house can be built there. By upzoning me I am
going to lose 50% of the value of my property. Today I have with me my elderly mother, Chloe P. Siolas,
who is sitting in the back row. She left an ill husband, and she is ill, too. She walks with a walker, but she
felt it was important for her to come here today. The reason why I bought this property was because of my
mother. She encouraged me to buy this property, because she bought similar parcels for her three sons, in
Captain Kidd Estates in Mattituck. She dreamt that in her old age her children will each have a home, or a
piece of land, and be near her the way she took care of her mother her dream is for her kids to take care of
her and her husband. My mother and grandmother believed in the value of land, and they believed in
Southold Town. All I would like to say is that now we have to question the values that have been handed
down to us from generation to generation is land a safe investment? We object to the upzoning of our
property as violating our property rights as Americans. Thank you for listening to me.
BILL PENNY: My name is Bill Penny. I am sorry I have to make this quick because I have to get back
to work. As I want to reiterate what I said before I own Tidy Car up on the North Road. I feel that small
businesses should be completely left out of this. I don't feel that we deserve this. I was told approximately
twenty years ago that's where I should be. That is why I bought the property. I was on the Main Road
originally, and I came down to the Town, and they said, that's great, that is where we want that sort of
business, and so we bought the property, and we paid the mortgage, and that is where we have been ever
since. You know, I think everybody in this town does not want to see Southold changed drastically. We
all love it the way it is, and I think everybody, especially the small businesspeople, will go out of their
way, and bend over backwards to keep it the way it is. However, I disagree with changing the zoning. We
bought our properties for what we bought them for. I feel that it is just not fair to us, and I guess the only
way I could put it to any of you is like somebody walked up to you and said, listen, we are going to take
half of your house away. That's okay, isn't it? I mean, you can live with that, can't you? That is basically

the way I feel. It was an investment for me for a long term. I think I was quoted in saying I ate beans for a
long time making the mortgage payments, and now I don't want to see my property devalued down to
something where I really don't even know what Limited Business is, or what I could really put there.
Again, I think that small businesses should have been just left out of this. I think that, you know, it is not
fair to us twenty years of working there. It shouldn't even have been brought up. That's it. I have got to
go back to work. Thanks.
EDWARD KOSTER: My name is Edward Koster. I have a small machine shop, and I echo what the
previous speakers said, but I will add my two cents. I would like to speak again to the fact of my property
being one third of an acre, too small to house anything overlarge or distasteful, also, too small to be of
value as an Agriculturally zoned piece. We are all citizens of Southold, and want the best for the town, but
you must remember in order for us to live here we have to be able, not only to make a living now, but to
know that our future living is safe from unwarranted, and constricting changes, which would jeopardize
the livelihoods of our employees, and ourselves. It is in the Town's interest rather to protect tax producing
business, which provides employment, and services for and to local people. Thank you. My number is

SUPERVISOR COCHRAN: Thank you.
KEVIN MOROSO: My name is Kevin Moroso. I represent Adrienne Solof, who could not be here
tonight. Her property is 045-2-10.5, and I think her basic concern is that the properties were purchased
with certain densities in mind, and this will drastically reduce densities, and it comes down to strictly a
financial issue with her, and they have thirty acres, and it is substantially affects. I would assume if you
did an appraisal based on this new upzoning it would be worth a lot less money than they have, and I am
not so sure the Town would want to pay them the difference, but then again, their purchase was based on
densities, and there is a certain value that they have established which would be reduced substantially, so
that is there complaint, and I just wanted to put it on record. Okay?
GEORGE PENNY: My name is George Penny. I am the President of Penny Lumber. The parcel, which I
am addressing, is 1000-141-03-38.1 in Mattituck, commonly known as Penny Lumber. It is about 3.89
acres, and made the Town Attorney aware of a discrepancy whereby, and I did this on the advice of my
attorney, whereby in this final mailing of what was about a two acre change turned into a 3.89 acre
change in Mattituck, which engulfed my entire business. We are one of the oldest businesses in Southold
Town. We are working on our fifth generation, and I am really not going to go back through all the
reasons that I went through last year because it would probably take me an hour or so to reiterate
everything, and if anyone wants to refresh themselves by the minutes, if they are so inclined I would be,
but I would like to read at this time an article which recently appeared in a lumber publication, The
Lumber Cooperator, which addresses Penny Lumber, and where it is at, and where it is going. With it's
founding in 1890 Penny Lumber of Mattituck and Greenport located on the northeastern peninsula of
Long Island, New York, certainly qualifies as one of the oldest independent retailer lumber dealers still
owned and operated by the founding family in the northeast. George Penny, that being my great-
grandfather, began his business with a lumberyard with feed and fertilizer to supply the need of equestrian
economy that flourished on Long Island at the turn of the century. The original structure that he built is
still in use at the Mattituck location although the current facilities dwarf and envelope that building.
George's son, George Jr., that being my grandfather, worked and expanded the single location. In 1961
George Penny III, that is my father naturally, opened a Greenport location on one and a quarter acres
through three separate acquisitions, the most recently by myself. My son, George V, also works in the
Greenport location. While no longer in the feed and fertilizer business Penny Lumber has developed it's

special niche in serving the small custom homebuilder and remodeling contractors, deck, alterations, trim,
kitchens, and flooring make up the void that was left when siding, roofing, and drywall installers removed
those products from the main stay of lumberyards. They left out carpeting. I don't know how they got
away with that. Penny provides design services, and will provide everything from the conceptual ideas to
the working blueprints for its customers. At it's Greenport facility and mill workshop assemble stairs,
angle bay windows, and bow windows, as well as custom trim detailing. The ad advertisement is over, I
will get back to the details. Penny Lumber has survived more than it's share of economic and cultural
factors, including the Spanish-American War, World War I, Word War II, the Korean War, the Vietnam
War, the Gulf War, the Cold War, the Great Depression, the recessions of the 70's and 90's, and Home
Depot. Penny was there for the Swing 20's, the Swing Kids, the Beatniks, the Beatles, the Hippies, and
the Yuppies. The latest recession saw Penny's volume cut nearly in half, going from 44, and that was
from `88 to '92, going from 44 employees down to 20. Today Penny employs approximately 40 people,
sales volume has fully recovered, and business is as good as it has ever been before. I would like to add
the list of the things that we have survived as the County Route 48 Study. We need four acres. I have
spent the better part of my life buying neighboring plots in Greenport to accomplish the goal of being able
to expand for the future. We already have that in Mattituck with our 3.9 acres. If we lose part of that 3.9
acres, it is not only my future, but the future of the forty employees, most of which are local residents of
Southold Town and pay taxes here at the Town Hall. Thank you.
SUPERVISOR COCHRAN: Thank you, George. Is there anyone else here in the center like to address
the Town Board? I will come back to this area.
HENRY SMITH: My name is Henry Smith. I am here on Kenny Dickerson's property on Peconic Lane.
You can't even see this property from Route 48 to start with. I don't know why it is even included, and
also, the Town of Peconic, I grew up there as a kid, and the town is a lot different than it was then. I mean
there are no stores there anymore. The only thing there is the post office with a Laundromat, and Kenny
has that business across the street from the post office that he is trying to fix up, and you know he can't
even put a decent building on there now to make the place look decent, if they downzone it. He can stay
there as long as he wants, but it is going to just look like it does now, and I don't think it does anything
for the beautification of Peconic, or trying to bring it back to what it was by doing the zone change there. I
just feel that it is the wrong thing to do for that piece of property. That is my opinion.
SUPERVISOR COCHRAN: Henry, you can say anything you want. You are entitled to your opinion. I
realize what you are saying.
HENRY SMITH: This town was made by small businesses. Small businesses made Peconic. Us
politicians didn't make Southold. It was the small business people, and the people that lived in it.
SUPERVISOR COCHRAN: Anyone else from the center?
ROBERT GUARRIELLO: Bob Guarriello, tax map #1000-55-4, listed as Linda Bertani and Others. I am
the other. I would like no change to that to that property zoning. Thank you.
RAYMOND SMILOVICH: My name is Raymond Smilovich, 140-1-4, Suffolk County Tax Map. It is off
the corner of Wickham Avenue. It is one parcel set behind Dinizio's Service Station. I bought that
property approximately four years ago, and I was looking more towards the future. I am a tradesman. I
own an auto body shop in Cutchogue, and I do have a son who is thirteen years old, and when I bought
that property it was General B, and General B can wholesale, retail, there is a few different things you can

run out of that. So, having three children it was not the location I would like to live with the North Road
right there, but I did take a sacrifice figuring is into landscaping, maybe he would run a landscaping
business out of one day. I run my tow truck through there. My wife does things with candles and stuff.
There was always an option that we could run a business out of there for our retirement or for our
children. That is why I bought the property, and I don't think it is fair to bring it down to residential
office. It is a very big depreciation of the property and my future. I feel you are taking my future away.

JOHN NICKLES, JR.: John Nickles, Jr. I don't own any property on Route 48, but I am opposed in
general to taking away business uses up on Route 48. I think that there are reasons why there are certain
types of businesses located up on 48, and on the hamlet. My main concern is that I don't see a big
business boom going on out here. I understand that the population is going to grow, and we are going to
need some more businesses to provide good and services for the population to be that mostly seasonal.
The thing that I fear the most is that I think if we continue to limit the expansion and growth of current
businesses or entrepreneurs for new businesses I think that when the next down turn in economy comes
maybe there is some businesses that are existing now that aren't going to survive because of what is going
on here today, and we may see us relying even more upon people from the west end, from Riverhead, and
having to bring our goods and services in the same way they do in the South Fork. Thank you.
JAMES HOMAN: I am speaking as a Director of the Southold Business Alliance, and I am sure that
there is going to be others speaking from the Alliance speaking on this matter. What I would like to do is
voice, a heavy voice of protest on the timeliness of these hearings. These are business properties, and
business properties relate to businesspeople. If you want to find a more inconvenient time for the business
community it is the last of summer. You have had a hard summer. You are tired. Your good summer help
has gone back to college, and now the Town Board is going to have a hearing where the businessmen to
protect their interests should participate in. This is very, very inconvenient. Why it couldn't have been put
off until after Labor Day to give the business community a breather, I don't know, but it would have been
better for the community, and certainly better for the businesspeople. The scope of these zone changes
that you are doing reflects a major change to the zoning map, and as such I question the timeliness of a
five o'clock hearing for these changes. It would seem when you are doing a major change to the zoning
map you would have it at seven or eight o'clock at night when it would be more convenient for the
population in general to come to it. I really think that both the time of the year, and the time of the day,
has made it inconvenient for a proper representation of the public and the business at this meeting. Thank

CLIFFORD CORNELL: My name is Cliff Cornell. I just wanted to formally protest any change of
zoning that I have on a piece of real estate I have on a piece of real estate I have on the North Road. I
guess I can reiterate what a dozen people have said here. We all have the same problems, and we can all
cry. We know what the problems are. You are familiar with them, and we are, too. I hope that there is
some reconsideration of the zoning.
ABIGAIL WICKHAM: My name is Gail Wickham, and I am here on three separate pieces of property. I
would like to address them one at a time, if I may. The first is on Premium Wineholdings parcel, section
121-6-1. That proposal is to change a 3.6-acre parcel from Limited Business to R80 on the corner of Cox
Lane and Route 48 in Mattituck. First I would like to advise the Board that the owners have signed a
protest that I would like to file with you at the conclusion of this hearing. I would also like to ask the
Board if I may incorporate all of the comments on record from the prior public hearing on this matter, or
whether you would like me to repeat them all.

SUPERVISOR COCHRAN: No, I was going to enter all past comments and correspondence that we
received to date prior to today all incorporated into this hearing.
ABIGAIL WICKHAM: Thank you.
SUPERVISOR COCHRAN: Everything that has been said in the past will be a part of the deliberations.
ABIGAIL WICKHAM: I am sure the people after me will appreciate that. The first thing I would like to
state with respect on this property, and the basis for the objection is that we do not believe it is pursuant to
a comprehensive plan. The Cramer Study did go through a large number of reasons, and a large number of
properties, but there were specific properties that were targeted by that study. Not all were adopted the
first time around. Some are being revisited now and some are not, so there seems to be a very piecemeal
approach to the process. Moreover some commercial pieces are targeted. Some are not, and yet nothing
really addressed the extreme number of residential parcels that could be subdivided or developed along
the Route 48 corridor. Unless the entire picture is treated similarly than the purpose of the plan is
defeated, and the individual property vote that you are approaching is really inherently flawed in terms of
creating a comprehensive effect from your planning. Therefore I would argue that this is spot zoning type
of concern rather than a comprehensive rezoning. My second point is similar to that in that this is really
not pursuant to a rational plan in that the parcels are really not being targeted so to strengthen the hamlet
areas or the vistas. On Lieb parcel in particular it is not in a hamlet area, so you are not strengthening the
hamlets by changing this. The vista is not going to be protected in this particular place, and the R80
zoning is really an improper use for this area. It is a very busy intersection. It is were the highway narrows
down from four lanes to two lanes, it is next to a shopping center, it is across the street from Light
Industrial zoning, and more importantly since the last time this hearing occurred there have been permits
obtained on this property, and as you know a construction of a large winery, and storage facility, permits
having been obtained from virtually every agency that is involved with the town. That includes site plan
approval from the Planning Board, review by the Architectural Review Board, it went before the ZBA on
a question of frontage, it has received a permit from the Suffolk County Department of Health Services, it
has gone to the DOT, to the State Liquor Authority, to the Bureau of Alcohol and Firearms, and last by
not least our very own Southold Town Building Department has issued a Building Permit earlier this year
pursuant to which I would say about eighty percent of the building has been constructed. That building is
a commercial winery and storage facility, which is totally incompatible with R80 usage. That brings me to
my third point, which is the extreme value reduction. I think just looking at the property you can see that
there is a significant investment. I do have an appraisal I would like to submit from Mr. Celic, Robert
Celic at the conclusion of this hearing that indicates that the property as currently eighty percent complete
has a value of at least $1,700,000. If the property were rezoned to R80 the value he believes would be
approximately $90,000, and that is after you incur the expense of removing those two very large steel
structures. So, basically the property would be worthless. My next point is, I believe that the SEQRA
process was improper in that requisite environmental review was not addressed in the current revision to
the plan. There are different properties, different changes in the properties, and different changes in the
property usage themselves from then to now due to the passage of time. I would also like to mention as
my fifth point that I believe that your procedure is defective due to your failure to comply with Town
Code Chapter 58 and your Chapter 14 on the notices for public hearings. In summary I would ask that
you recognize that this is a totally inappropriate rezoning for this particular parcel. Thank you. On the
next parcel I will incorporate many of my comments so that I don't have to repeat them I will just refer to
them, and ask that they be incorporated. My next group of properties is actually three properties, which is
owned by Raymond Nine, who is here tonight, and he will be addressing you after me, or shortly after me,

and for reference those are parcels 141-3-22, 25. 1, and 28. Again, we would like to submit a protest at the
conclusion of this hearing, and incorporate the comments of the prior public hearing. I would like to
repeat my argument on the previous hearing, previous testimony that I believe it is not pursuant to a
comprehensive plan for the same reasons, and that it is not pursuant to a rational plan. On this particular
parcel, and also the adjoining parcel owned by John and Martin Sidor, Section 141-3-29.1, you are
proposing a change from Light Industrial to Limited Business, and as two of Mr. Nine's parcels, one
fronting on Route 48, and one fronting on Love Lane, a change from Light Industrial to Residential
Office, and as far as both Sidor and Nine parcels we would like to object. With respect to those parcels the
access to Love Lane, and to Route 48 on the Nine parcel can be controlled by the site plan. The vistas are
not going to be improved by this rezoning. You are going to render the property non-conforming, not only
respect to usage but also respect to area. Both of these properties have been owned by local families for
many, many years, and used in their businesses for many, many years. These are not properties that are
owned by speculators or developers waiting for the big bucks to roll over on a flip. They are not big
enough to accommodate a large warehouse type facility, like a Home Depot, and they have improved, and
used by these owners in their own businesses in conjunction with the light industrial type uses. On the
Nine parcel, Mr. Nine as you know is in the sand and gravel and excavation business. Many years ago
pursuant to Town permit he built a garage, which houses his vehicles, and he has used a large part of the
property as a grading operation for his materials. The Sidors have been in farming for years and years out
here, and their parents before them, and that facility has been used for many, many years as a potato
grading operation. Both of those uses would be rendered non-conforming in terms of use by the proposed
rezoning. That would devalue their property significantly. Both of those properties would be rendered
non-conforming in terms of the size of the property by the proposed re-zonings. The change from Light
Industrial to Limited Business renders your area requirements reduced from 80,000 square feet required
by a Limited Business up from only 40,000 required by a Light Industrial usage. In the case of Mr. Sidor,
who has one acre about 40,000 square feet this basically makes his property automatically non-
conforming in terms of area, and numbers of uses. In terms of Mr. Nine's property the property impact is
even more dramatic, and if you can give me a minute I would like to explain. On the Residential Office
pieces that you are proposing one of them is currently 14,000 square feet roughly, and one is
approximately 10,000 square feet. In order to comply with the 40,000 requirement of Residential Office
you would have to increase the size of those two parcels by moving into what you are proposing for
Limited Business, which is now zoned Light Industrial. That means you would have to create two 40,000
square foot parcels in order to properly use those even as Residential Office. That depreciates
significantly the size of the 2.6 acre Light Industrial piece that you are proposing to Limited Business. So,
even if you left the Light Industrial the way it is and just rezoned to Residential Office on the other two
pieces you are devaluing the property. Whether you change the zoning or not to Residential Office you
are reducing his effective usage on the Light Industrial from two uses down to one. So, either way you cut
it you are limited the 2.6 acre parcel to one use whereas now he has at least two and possibly three. That is
a huge reduction in value. The other reduction in value comes from the limitation on usage, and this
applies to both the Sidor and the Nine parcels. If I could move to the Code section that pertains to the
various uses even the agricultural operations that are permitted in Limited Business, such as Mr. Sidor is
now permitted in Light Industrial would not be permitted in Limited Business. So, he would not be able to
run the current grading operation that has been there forever. He would be a non-conforming use. You
would not be allowed in a Limited Business zone to have any type of wholesale business or warehouse,
and as I mentioned we are not talking about the big public warehouses. We are talking about small
business type of warehouses that might be usable for the property. You would not be allowed to use cold
storage plants, which have a very limited impact on traffic and visibility. The office uses, office building
uses, would be much more limited in Limited Business than they would in Light Industrial. You would
not be allowed to have an auto repair shop, a repair shop, or light industrial uses, and you would be able

to have none of the uses in 1000-14113, which are now permitted in the Light Industrial use pursuant to
site plan, and Special Exception. So you are really emasculating the types of uses that would be permitted
on these properties. Mr. Andrew Stype, as you know has been a real estate broker in Mattituck for many
years, has prepared a letter, which I would also like to introduce into the record, which indicates the
severe loss in value as a result of the changes to Mr. Nine's parcel. These changes apply equally to Mr.
Sidor's parcel, and I would like to submit this with leave to include in the record afterwards, if I may, a
further letter addressing specifically the Sidor parcel. Mr. Stype is out of town right now, and was unable
to me before the hearing. The comments that I made previously in the Lich matter with respect to the
SEQRA process, and notice procedures of the Code and the rationality apply equally to this particular
hearing. I don't believe that this particular proposal benefits the community as a whole as your zoning
should, and it is severely, severely punishes these individuals who have worked so hard to keep their
businesses going. Thank you.
RAYMOND F. NINE: My name is Raymond F. Nine. I am in the sand and gravel business. I am an
industrial type of business. I have owned this property since 1970. It is three separate parcels that join as
one parcel. Right now the entire parcel is Light Industrial, and I certainly would ask the Board to be kind
enough to leave it exactly the way it is. I don't have any intentions of expanding my business, but it does
give me the option of running my business there legally without any problems now. I try to keep the
operation very small. I try to keep it hidden. We don't have a smell problem or a traffic problem, and I am
a very small businessman, and by changing this there is absolutely positively no question about that it is
devaluating the property, and I mean I am not going to get compensated for the lose and the value of the
property, and I just feel that in the times when I watch the newspaper, and I see how many times the farms
are being sold, and the people come out and buy it, and then the development rights are sold, and they get
money for the development rights, and I actually feel here that I am asking to give up my development
rights, and pay for it myself, and I think it is very unfair, and I would like you all to consider leaving it the
way it is. I would appreciate it very much. Thank you very much.
CHARLES CUDDY: I am Charles Cuddy. I represent Mr. And Mrs. Soloff. Earlier Mr. Moroso spoke.
We just had a problem winding ourselves up to speak, but I would like to speak about the same parcel,
which is on Chapel Lane, and has a small part of it that fronts on Route 48. I would like to in deference to
Ms. Wickham, who I think said a lot about zoning, and if she will permit to adopt many of the remarks
that she made to shorten up my talk to the Board. I understand, I hope I understood correctly that all of the
remarks that we made at the hearing last year are being incorporated by reference in this hearing. Is that
correct?
SUPERVISOR COCHRAN: I am moving that, yes. Everything will be looked at from beginning to end,
everybody's comments, everybody's piece of paper.
CHARLES CUDDY: I just want to identify the parcel again for the Board. It is 45 to 10.005. It is a thirty-
one acres site. It is presently zoned LB down towards the Main Road, and it is zoned HD up towards
Route 48. As the study noted, the environmental impact study noted, this particular parcel is near a motel,
it is near a nursing home, and it has been zoned like this, Lord knows, for many years. Relying upon your
prior vote Mr. Solof went out, and hired consultants, one of whom appeared earlier here, has spent tens of
thousands of dollars, has consulted with the Building Department, has consulted with the Planning
Department, and has prepared to submit shortly a entire plan for senior housing at this site. It is hard to
believe that no one along the line, and I wasn't involved in it, but no one along the line said to him, don't
do that because we are going to change your zone. It doesn't make sense to me to go back to the Route 48
Study to talk about this parcel as having any particular effect on the vista of Route 48. But, if it is true

what Mr. Solof would offer it to this Board, and to the Planning Board, he said he would buffer the area
along Route 48, and you won't have a problem with that area. (Tape change) Actually use this parcel for
multiple type dwellings, and I would think that is significant to this Board, and I would think you would
want to encourage the type of thing that he is doing. I believe that the zoning is inappropriate for basically
all the reasons that Abigail Wickham stated to this Board. My client has recently conveyed the parcel to
an LLC Limited Liability Company called Greenport Group. He did that with the understanding that he
was just about going to submit and hopefully get approval for the senior housing that he has been
preparing for the last several months, so the notice went out to a Adrienne Solof, but the actual owner of
this parcel is Greenport Group LLC, and at the conclusion of the hearing I will hand up a notice that
pursuant to 265 of the Town Law. But, again, I urge you not certainly to change the parcel that has
promise, as this does, and I would hope that you would accept his offer to buffer the area on Route 48,
which I think would benefit the community and also achieve the purpose I think you are looking for.

JACK WEISKOTT: My name is Jack Weiskott. I have a parcel on the North Road on 48. I don't know
the exact number. It is a 059 parcel just west of Kenny's Road on the south side of Route 48. The
proposed zone change for my parcel is I believe the first 200 feet deep of the Route 48 frontage, which
amounts to about two acres. I would object to the zone change. I only recently purchased this land last
year probably two months before the first hearings of the proposed zone changes. As you can well
imagine that was a pretty bit surprise to me. Part of the reason the property was a attractive to me in the
first place was the LB zoning on the frontage, not from current usage, but just so that the value and
options for the future would still be there somewhere down the road. I feel that changing the small parcels
of this small businesses and small landowners is taking away some of what we were considering to be our
future plans, or our future nest egg so to speak, and it is almost like buying something, and then you get it
home and unwrap the package, and there is something else in the package. It is not the same parcel that I
bought if the zone is changed. I am just at the beginning of the struggle to pay for this parcel over the
long haul, and I am hoping that when I finish paying for it will actually still retain it's value rather than be
worthless than I expected it to be. My other thought and objection to this is that I also don't see that this
is a comprehensive plan. I see this as a plan where you are trying to change such a small number of
parcels. We are only talking about forty parcels, forty-two parcels here. It is such a huge change to the
people whose parcels are affected, and it will be such a minuscule change to the actual vista of the town,
and all the cost of this change will be borne by these forty or fifty people, and the town is basically not
paying a penny for it. The entire town is trying to benefit from forty people's property, which I think is
inherently unfair, and it is not the typical way that farmland was preserved generally speaking. We've got
a 2% land tax on the purchases that are paying for the purchasing of farm development rights. What do we
need that fund for if we can just change the zone whenever we feel like it? I feel that not only is it unfair
to the individual people, but I think it is a poor policy to continue unless you are talking comprehensively
over the entire town of making large changes that everyone can participate in the sacrifice of part of the
value of their property for the benefit of the future of the town. Thank you for listening.
MATTHEW SOLOF: I am Matthew Solof, and I am referring to property 045-2-010.5 that Mr. Cuddy
and Mr. Morosso spoke to you about earlier. I am a member of Greenport Group LLC, which is the
current owner of the property. All I wanted to add was that this particular property is unique in the fact
that right now there are already eight existing condo units on the property. In addition to that this
particular property has water and sewer already in the property at great expense. The last time that I came
to this Board and voted on the change of the zoning I obviously took that as a signal to go ahead, and
spent tens, tens, and tens thousands of dollars in environmental studies, engineering studies, surveyors,
lawyers, and everybody else that you could think of at a great expense, and got it pretty much a go ahead

from Town officials. They were happy to have a senior project in this area. What we were planning on
putting there were classy looking, middle income, senior housing rentals, which we feel is in tremendous
demand in the area. After polling neighbors, and speaking to Town officials we find out there is a waiting
list for this type of property in town, and there is a tremendous group of seniors that live in the town, that
would love to sell their houses and have a nice place to live. So, that is our intentions with the property.
We hope that you will be open minded, and consider not changing our zoning. Thank you very much.
MARIO VASSARIO: My name is Vassario, Mario J., and I am speaking for three different parcels, three
different owners The properties I don't have the tax map numbers, but they are a bit to the east of Cox
Lane. The property Mrs. Wickham was explaining, the winery building there. The owners are Principi,
Deloris and Dominick. Deloris apologizes. There was a death in the family. She couldn't make it, and
Stella Gentile. There are three of them. We have been here a number of times in the past, and I am
assured that you will bring up all the prior correspondence, and review that on this. What I did want to
bring up, in fact I will reiterate a bit was these properties there are two individual owners are one acre
each, and the third that Mrs. Principi is involved in is about 2 and 76 hundreds of an acre. When the
properties were purchased in the 60's they were zoned general business. Then sometime in the 80's
Deloris was handling the tax bills on these properties. She called us, and said, you know there is a change
it seems from GB to LB, and we called the Board, or the Town Assessors office, and they said to us, yeah,
something with the Planning, they were changing their plan. The Town Board had a right to change
zoning or whatever. We were not happy with it, but we were not that educated to know the ins and outs of
having to inquire about it, and fight it. So, we let it be, but we were unhappy with it because the..
SUPERVISOR COCHRAN: May interrupt you one moment. Before anymore leave you weren't here
earlier when I announced that the Town Board will be meeting, not only every two weeks for their Work
Sessions, but the Tuesday in between we will be having a Work Session from nine to twelve, because we
have a great deal of work, and we feel that we need more time to review and make these things happen. I
am scheduling the hearings from today, and past hearings for Tuesday, the 5t', to discuss the hearings. I
just want you to know, those that are leaving we are going to be discussing what we heard and all the
input from 9 to 12 on Tuesday, September 5u', because the Board is going to needing those weeks
between Board meetings. Just before you leave, so that you know. That is open to the public. The Board
will be doing its work session, you do not take part, but you are more than welcome to come and sit and
listen. I am sorry
MARIO VASSARIO: It is quite all right. At any rate, so we let it be as far as the change goes LB,
because we felt we were helpless to do anything about it. That was about roughly ten, twelve years ago.
Then we were informed last year about the moratorium, and they were looking to change our zoning to
R80, and we were down here a number of times. We drove in from Northport, Fort Salonga to argue, and
to give our point as to why it should not be changed, and we went through that whole spiel, and we
thought after the moratorium was lifted. We spoke to the several of the Board people, and seemed that it
was going to left as it was, LB. Then Mrs. Principi called, and said that she heard through one real estate
friend and through the newspapers, that they were having hearings on it, and that they were looking to
change it to R80 residential, and we were surprised about that, so she inquired about it, and we are here
bringing the same issue up, that we went through a year ago. Now, these parcels are adjacent on the east
to strip mall. You are aware of where that is. I feel, and I have been involved in real estate and building
close to thirty years, this I couldn't understand the Board's rationale, and why they would want residential
here. You are right on the main highway. Sometimes it is good, and sometimes it is hard. We get involved
in our own little niche, and we see things from our own viewpoint, you are there and I am here. If say I
would say this, Jean and Bill Moore, we will sell your home, I will sell them, I know real estate people

here, and I will build you a home next to one another, so you can be together here and there, right on
County Road 48 on an acre parcel right on this road, and you would have to deal with all the traffic,
perhaps grandchildren, children running around. You have the high tension wires, and it is not very well
for home building. To me I can't understand the rationale in this. I don't want to take too much time here,
but just say that we are very much against, and very unhappy, if you people will allow this change. We
would implore you people to, please, leave it as LB for the reasons that have been stated in the past, and I
have stated now. By the time we took a hit from GB to LB, and to get a buyer here, yes, you could get a
buyer, but price wise we have a definite lose in what the value would be, and we don't want to take
anymore loses. We really don't, and we would appreciate it if you would leave it the way it is. That's it.
SUPERVISOR COCHRAN: Thank you. Who would like to address the Town Board?
KEN DICKERSON: Ladies and gentlemen of Southold Town Board, and Supervisor Cochran. I am
Kenneth Dickerson, Jr. This is Suffolk County Tax Map #1000-074-3-19.001. I reside on Skunk Lane in
Cutchogue. My branch of the Dickerson family have been life long residents of Southold for more than
200 years. A long time ago my grandfather, Kenneth Dickerson, used to do land clearing and excavating
with a team of horses. It was only natural that my father, also named Kenneth, or more commonly know
as Soup, also took up the profession. My father was at one time employed by the Southold Town
Highway Department for about twelve years. He and his wife, Shirley, my mother, made a very
monumental decision and embarked upon an independent venture by deciding to go into business for
themselves. In 1966 the company started with the use of space at Corazzini's in Greenport. In 1969 the
business relocated to the west side of Peconic Lane bordered by the Long Island Railroad tracks to the
north. The location is also where the U.S. Postal Service is now. The property and the building were
rented from Henry Smith. My father also had storage space on the east side of Peconic Lane opposite the
post office. The parcel on the east side of Peconic Lane was, also owned by Mr. Smith. Mr. Smith
operated a fuel oil distribution center, a storage to store his equipment there. My father serviced, repaired,
and stored his machinery and trucks at the site on the west side. I am one of three children who helped my
parents at one time or another through formative and school years. I served an enlistment in the U.S.
Army, and was discharged in January 1980. It was then that I joined my father in the family business. In
more recent years my brother, Tom, also joined part of the firm. Our business has expanded with the
gradual growth of our town. My father and I saw the need to relocate our base from the west side of
Peconic Lane to the east side. Through hard work and putting aside every dollar we could we were able to
negotiate satisfactory purchase of the land from Mr. Smith. In December 1998 we purchased a one acre
whose location was more ideal for operation. We could now work from one location with a more suitable
space and building. Furthermore the parcel was zoned Light Industrial, which is exactly what we needed.
After the years this parcel and other parcels in the nearby area as well as other locations have been zoned
Light Industrial. It is only sudden designated to be changed to Hamlet Business. We hear and all we have
read in the media and all the legal descriptions are accurate our business future is not promising. We don't
have the financial resources to relocate and start all over again. Every dollar we earn goes into supporting
our father, my brother and my wife, and my two children, in addition we must reinvest our earnings to
rebuild our equipment or replace our old equipment, taxes, liability insurance, health insurance, and to
repair and improve our shop. We are not General Motors, or General Electric, or large real estate
investment firm. I ask, what is right about changing the zone of our small parcel. Is offending someone's
sense of tidiness? We make every effort to maintain a tidy area, and we are in the process of making
improvements. This also takes time and money. Earlier in my statement I indicated that we are lifelong
residents, and over the years have made every effort to be good citizens, contributing time and money so
that we give something back to our town. My parents have always stressed that we work hard, and give a
day's work for a day's pay, and be honest and forthright. I have also mentioned how my father, brother

and sister have been part of our business. I would also like to add that my wife is involved, and even more
importantly we have a daughter and a son, which we must be concerned about. We want them to be able
to live our community, attend our schools, churches, and become good citizens also. I would respectfully
ask the Board to consider that the decision to change the zoning of a parcel would be devastating to our
family's future. The cost to relocate would be prohibitive. Our ability to earn a more decent living would
be more severely threatened. Our ability to sell the property in the event that the zoning past would be
limited, and the value be lessened. Must my father, my brother, or my family relocate to another area of
the state, or the country, in order to survive. It is very evident to me that there are others here tonight who
similarly affected by these changes, and wish to address you. I, again, ask you, the members of the Board,
to take a good hard look at each of the changes that are proposed, and ask yourself, does this really have
to be changed? Consider also how your individualism will affect the destiny and the livelihood of our
family businesses and it's dependence. I appreciate your patience and attention. Thank you.
HOWARD MEINKE: I am Howard Meinke, President of the North Fork Environmental Council. I just
think that we have heard from a lot of citizens, and they all have good points. I think it is proper that
someone should speak for Southold Town, and speak for the Cramer Report, and get back to the
overriding logic of how we got where we are today. It always appears at hearings like this where person,
after person, after person stands up and they each have their story, and I am not going to criticize their
stories. They are good stories. They all believe what they are saying, and there is a lot of truth there, and it
is very nervous time for everybody, but we did get here, and I heard Mr. Cramer present his report a
number of times. There is a overriding logic there. I think the Town Board is pursuing it because it's
logical. The general philosophy of not having Route 48 steal business from the hamlets and compete with
the hamlets, that was one of the objectives, and I think that was an important concept, and I think the
concept of not allowing strip malls, or the advent of big box retailing on Route 48, I think that was very
important, so I think the theory of controlling 48 to keep it as rural as possible and maintain the views,
vistas, and etc., and is certainly a Southold-wide objective, and Southold-wide objectives at some point go
head to head with individual personal objectives, and that is why hearings like this are difficult, but it was
stated that this is silly. You are just working with forty property owners, but there is a potential of 800
houses, but I think the Town Board is working with the Nelson, Pope, Voorhis Report, and with the Water
Company Health Department on the water map, and they are working on implementation, so that housing
development, and proper control of where growth happens is on the agenda of the Town Board, so I don't
think it is fair to say, we are picking on forty property owners on Route 48, and letting some other
problems go untouched. I don't think the problems are being untouched. I think there is a
misunderstanding. I believe, and I think I have been told that the current usage of a piece of property can
be maintained, and if the zoning is changed, and the usage becomes non-conforming you can still
maintain that use. You can sell that use, so there is not this instantaneous loss of value this kick in the
slats that people are imagining. It isn't quite like that. Current usage can be continued, and I just think it
is necessary that people understand that. I think this puts the owners on the Board. They have to do a lot
of thinking. We have always supported philosophically the Cramer Plan, and what you are trying to do,
and maintain what we have here in Southold, but clearly each individual argument is very compelling, and
I am glad I am out here, and not up there. Thank you very much.
PAULINE PHARR: I am Pauline Pharr, Walter's wife, and I just would like to address some of the things
that Mr. Meinke said. I think I have read every study that you put in the library. I have spent a lot of time
there, and in none of those studies so far have I seen until the Cramer Report a recommendation that
developed land be upzoned. There was recommendation that undeveloped land be looked at, but nobody
up until this point recommended that, so this is a big step forward and I don't think it was a good step
forward because you see the number of small business owners here who are feeling like second-class

citizens, and you can sat that is not right, but let me tell you I also read in all those reports that you are not
going to force anything on anyone. You are not going to use zoning to hurt a farmer by upzoning his land
by making it agriculture only, that you are going to buy his development rights through a Town purchase,
but nobody is talking that way about the business owners. You are not saying, we are not going to force
you to change. You are saying, we are going to change your zoning and that is it. You are just going to
have to live with it, and if you are building berms you won't be able to rebuild it because Mr. Cramer
said, the reason you change somebody's zoning is because you really decided it is urgent for the town that
no business of this type be allowed on that spot, that it go to the new zoning. Okay, look at my piece of
property. You want to see agriculture of some kind. You want to see a house there, so I have to knock
down my building to take it away. You want to see a farm stand there. I don't think I can have a farm
stand. It is too big. You want to see a barn, my building used as a barn. Well, I don't think I can use it as a
barn. That is an accessory use to a farm, and there is no farm, so what do you envision there that I must be
changed, that I am such a problem to the town? If I am not such a problem, and you say, you are allowing
me to stay, why don't you allow me to stay as a permitted use in a zone where I have always been? Why
must my zone be changed and I become a non-conforming use? That doesn't make sense to me, and I am
sorry it doesn't make sense, and it is not logical, and it is corrosive. I have heard people say some people
will suffer, but the People, with a capital P, will benefit. Well, that is what they said my grandparents in
Czechoslovakia, when they took the farm away from them. They said, the People will benefit. I am the
People. If you step on one individual citizen, you are stepping on this town, and I am one of those little
people, little people that you shouldn't step on.
SUPERVISOR COCHRAN: We are taking all this input.
DAVID CICHANOWICZ: Good evening. Dave Chichanowicz, President of the Southold Business
Alliance, and I speak for the Business Alliance, which is growing quite large these days, and maybe
because of the 48, maybe because the businesspeople feel like they are not being heard anymore. When
the Town decides they want to change upzone, and not even have one conversation with any of the
business owners as to how they feel about it what else can we do but try to band together and try to show
some mutual support. You have taken the advice of Cramer, who is a resident of, I guess, Brookhaven
Town, and again, I kind of question the advice to listening someone who is living in Brookhaven, and the
disaster that they have there, and having them tell us what is best for our town. I mean, most of the people
that are going to be affected were born and raised here, as I am. You want to change all these things. Why
not get the input of the people who are directly affected? I am sure that every one of these business
owners that are being affected would be more than willing to sit down with the Town Board, and work
out while this isn't a pleasing property to what they are looking at, well, maybe there is something that
can be done. You know, maybe a plant here, maybe this, a different facade on the building. These are all,
I think, simple solutions to maybe the grand scale of this problem, and again, before you go to vote on this
the business community as a whole will be more than happy to sit down with the Town Board, and talk
about different possibilities as compared with just throwing this to a vote and say, ye and nah, and it is a
done deal. I think we can all benefit from working together. We all live in the town, and it will make a
happier town to live in. Thank you very much.
ANDREAS MARKAKIS: Good evening, I am Andreas Markakis of Southold. I am not here to defend
any rights or benefits of myself, but I am in pain to hear all these things and complaints by people who
live the daily agony of what is going to happen to their property. I scratch my head and wonder what
happened to the United States Constitution. The pursuit of life, liberty and happiness is being threatened,
and the spirit that is a hallmark of the American dream is being set from the soul's of the business owners
in Southold. Unfortunately I was not allowed to do anything to feed my family and fortunately I am still

here, and I did feed my family and product two children, a credit to the society. Unfortunately they can
not live here. One is in Staten Island, a teacher. The young one, Carmen, is an Assistant District Attorney
in Queens. It pains me, because I am a concerned citizen. I love this town. I live down the road on
Founders Path, where I bought my little house in 1966. I love the quietness, the nice people, hospitable
people, and that is why I decided. I buried my son here at 26, and bought my own burial grounds, and
wife's in the town that I love. Again, I live the agony of these people, and I wish I could do something. As
a Board Chairman of the Hellenic-American Taxpayers Association I requested to defend some of the
cases. I prefer not to, and instead to stress the importance of the vote of the citizens. We have 1,000
families on the North Fork, and they can have a very strong voice in the affairs of the town. I avoid
thinking of details, although details sometimes are very important. Once I tried to sleep in a small room,
and a little fly was flying around. That fly was a detail on how important it was. I like to appeal to the
Board in your deliberations at one point, in a few minutes put your feet in the shoes of the agonizing
people, and consider their cases. It would be remembered. It will not distort the environment, but it will
save lives, who will contribute to the community. Thank you.
SUPERVISOR COCHRAN: Anyone else like to address the Town Board?
TOM MCCARTHY: Good evening, my name is Tom McCarthy. My wife Susan and I own property on
Route 48, and I just want to check for the record to make sure you have our appropriate paperwork filed. I
am in opposition of the zone change on my property.
SUPERVISOR COCHRAN: The Town Clerk said, yes.
TOM MCCARTHY: Just without going through everything that the other speakers before me have said, I
think the one thing you ought to consider as you look to change some of the properties on Route 48 as I
think you are going to wind up with some spot zoning by default with properties that you are not able to
change. It is not really going to be a consistent flavor up on Route 48. You are going to have businesses.
You are going to have open property. You are going to have business. You are going to have property.
There won't be a consistent thread running through Route 48 when you get done with your voting, and I
think that the businesses on 48 benefit from a certain synergy from some of the traffic that is up there, and
I know that a lot of people don't like traffic and businesses on 48, and that is why we are here. But, a lot
of the businesses that are there benefit from other businesses, so I don't think we are doing something that
is going to help the existing businesses on 48, because their neighbors to the left and to the right may not
be developed, they may changed, and they maybe have a dissimilar use, so you are affecting the parcels
that you aren't targeting as well as the ones that you are targeting. I would just like to ask a question. I
don't know who on Board may be able to respond. I feel as though on Route 48 it is double jeopardy. This
is the second time we have been voted on. Will this come up again? Will the Board be able to give the
residents and the owners any sort of assurances that if the Board doesn't like the outcome of this
particular vote, whenever it comes up, are we going to bring this up again, or we going to consider this a
closed issue? I would open that up to anyone who would like to respond to it. What sort of assurances do
people have?
SUPERVISOR COCHRAN: I don't see it. I personally don't see it coming up again.
TOM MCCARTHY: Did you see it coming up this time?

SUPERVISOR COCHRAN: Yes, yes, I did, so we will be debating everything we hear. We will take all
your input, Tom, and do everything, and then I know there is different feelings from different Board
members, and that will all be discussed, and then we will try to come up with the best solution.
TOM MCCARTHY: It could cause some more building permit applications, and site plan applications
for people who do have vacant land, that want to preserve their right by getting some permits, and getting
buildings up on Route 48 that might not be the case otherwise if they had certain assurances that it wasn't
going to come up again when we leave the neat round of voting.
SUPERVISOR COCHRAN: I am only one vote.
TOWN MCCARTHY: I understand that, and I am addressing the Board in total.
COUNCILMAN MURPHY: Tom, the other thing is as gentleman over here pointed out, they changed
zoning sometime in '88, whenever it was. I don't anticipate after this vote coming up again in the near
future, but who is to say ten years from now another whole Board does.
TOM MCCARTHY: I understand that, and I appreciate the job that you have to do. It is a difficult one,
and I assume that you are looking at the neat five, ten years, or whatever that foreseeable future is for the
Town and take that into consideration so that we are not looking it at a year, two years, or three years
down the road, and say, hey maybe we should have looked at it differently. We are just asking you for
your best shot for all the individual owners on Route 48, and it affects the people that are not on the
agenda to be voted with all the other businesses and their livelihoods as well. Thank you.
SUPERVISOR COCHRAN: Anyone else like to address the Town Board? (No response.) I would like to

on Tuesday, September 5u', 9 to 12, and it will be after that point once the Board has thoroughly reviewed
the entire map, they have minutes, and other information in relation to past hearings, which will be given
