Fraser to Thelma Diefendorf by deed recorded in the Office of the f?Va Clerk of Suffolk County in Liber 6389 page 138, and running thence from said point of beginning southerly along an irregular curve marking the westerly line of Nassau Point Road, a tie-line along said curve bearing S. 20 39' 18" E. for a distance of 30.30 feet; thence N. 840 29' 35" W. through the land of the party of the first part 289.04 feet to a point.in the easterly line of Goldfish Pond Road; thence northerly along an irregular curve marking the easterly line of Goldfish Pond Road, tie-lines along said curve: (1) bearing N. 250 50' 50" I E. for a distance of 44.04 feet, (2) bearing N. 410 24' 02" E. for a distance of 74.04 feet to the land of the party of the second part; thence southerly and easterly along the land of the party of the second part the following courses and distances: (1) S. 40 52' 30" W. 80.00 feet, (2) S. 860 42' 40" E. 225.31 feet to the point or place of beginning. The above described parcel of land being parts of Lots 127 and 128 as shown on a certain realty subdivision map entitled "Amended Map A of Nassau Point" filed in the office of the Clerk of Suffolk County on August 16, 1922 as Map No. 156. VK TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and 14 roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND thepparty of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been ineumbered in any way whatever,except as aforesaid. AND the party of the first part, in compliance with Sectien 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word,"party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
