WITNESSETH,that the party of the first,part,in consideration of ten dollars and other valuable consideration `
paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in,the at Mattituck, Town of Southold, County of
Suffolk, State of New York, bounded and described as follows:
r-FSEGININING--ac a point--on the. northwesterly line of a twenty foot -
right of way leading to Westphalia Road at the southwest corner of
the premises herein described a4adjoining land of Fitzpatrick on
the West; Running Thence along said land of Fitzpatrick, North 1
degree 07 minutes 30 seconds East 206 .50 feet to the ordinary high
water mark -of Mattituck Creek; Thence along said ordinary high
water mark of Mattituck Creek measured by a tie line North 87
degrees 27 minutes 20 'seconds East 213 . 12 feet to land of Avignon;
Thence along said land South 17 degrees 00 minutes 00 seconds West
153 .04 feet to the northwesterly line of said twenty foot right of
way; Thence along said right of way two courses and distances as
follows: (1) South 82 degrees 37 minutes 30 seconds West 69 .26 '
feet; (2;) ' South '59 degrees 37 minutes 30 seconds West 120 feet to

TOGETHER with a twenty foot right of way in common with others `'
from the southeast corner of the premises described to Westphalia
0- , Ob Road, said right of way becoming thirty feet in width as it nears
Westphalia Road for access between said premises and Westphalia

equipment.
SUBJECT to a ten foot easement along the westerly line of said
premises from the said private road to Mattituck Creek.
r. BEING and intended to be the same premises as conveyed to the
w party of the first part by deed dated January 21, 1981 recorded

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second'part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
i whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration,for this conveyance and will hold the right to receive such consid-
eration as a trust 'fund to be applied first for the purpose of paying the cost of the improvement and will apply
`.\z_ the same first to the payment of the cost of,the improvement'before using any part of the total of the same for
any other purpose.
