CHARLES CUDDY: Mr. Supervisor and members of the Town Board, I know that you at the last meeting struck the M2 from consideration in connection with the Plum Island zoning but I would point out to you in the version that I have of the agenda for tonight's meeting, in the purpose clause, in the second clause it reads `And to establish standards for certain uses in the M2 district to maintain access to the Island' I would think that should also be stricken otherwise you are going to cause confusion and there is just ambiguity. SUPERVISOR RUSSELL: We would agree. And we will make that part of the motion. That was an oversight. MR. CUDDY: Thank you. Krupski, Jr., Cutchogue ALBERT KRUPSKI, SUFFOLK COUNTY LEGISLATOR: Albert Krupski, Cutchogue. I just want to thank you again for having this on the agenda tonight, the zoning of Plum Island. It is really important legislation for the history of Southold Town, for the future of Southold Town. You are taking the right step and I realty appreciate it. Thank you. SUPERVISOR RUSSELL.: Thank You, Albert. Marie Domnici, Matituck MARIE DOMENICI: Marie Domenici, Mattituck. I am all on board with what you guys are doing and I appreciate your taking these efforts in making it come to fruition but 1 do have a question about the cleanup of the island. There is some brown fields on the island and I am requesting that the, does the Department of Homeland Security take responsibility for that or do we have to incur the cost of that cleanup? SUPERVISOR RUSSELL: Zoning would not convey ownership to the town, it merely would put a land use restriction on it for any subsequent future owner. Currently the liability for the cleanup lies with the federal government. I know there are two separate agencies right now that are I guess, battling the issue but I assure you, that is the sole responsibility for the federal government. MS. DOMENICL• Okay. BE IT ENACTED by the Town Board of the "fown of Southold as follows: L Purpose. The purpose of this local law is to create and establish zoning districts on Plum Island. The Plum Island Research District is intended to encourage the use of the island for research and educational opportunities and provide quality employment opportunities, and to preserve Plum Island's regionally significant natural historic and scenic resources. The purpose of the Plum Island Conservation District is intended to preserve the integrity of the regionally significant natural historic and scenic resources of Plum Island. 11. Chapter 280 of the Code of the Town of Southold is hereby amended as follows: §280-4. Definitions. IMPERVIOUS SURFACE - Impervious surfaces include all areas where the ground is covered by a surface that interrupts or prevents rain from falling directly to the ground and percolating into the groundwater, including but not limited to: roads, driveways parking lots other pavement, buildings, and concrete pads. §280-5. District designations. PIR Plum Island Research District PIC Plum Island Conservation District Article XXXI Plum Island Research District (PIR) &280-182. Purpose. The purpose of the Plum Island Research District is to encourage the use of land for research and educational opportunities, provide quality employment opportunities and to preserve Plum Island's regionally significant natural, historic, scenic and cultural resources. §280-183. Use regulations. In the PIR District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged intended or designed to be used in whole or in part for any purpose except the following: August 27. 2013 Pa~c 7 Southold town Board Meeting A. Permitted uses. the lollowing uses ure permitted uses and are subject to site plan approval by the Planning Board: (1) Research laboratories with multiple buildings allowed in a campus-style development, subject to the following conditions: (a) The use shall not involve the handling, storage or discharge of explosives. (b) No offensive noises, gases, fumes, smoke, odors, dust, effluent or vibrations shall emanate from such use and no waste products shall be discharged therefrom of a character to create a nuisance or to be injurious to health or to negatively impact surface or groundwater. (c) All sewage will be treated by a sewage treatment plant or similar sewage treatment. (2) Educational facilities, with multiple buildings allowed in a campus-stye development. All sewage will be treated by a sewage treatment plant or similar sewage treatment. (3) Museums housed in a designated historic landmark. All sewage will be treated by a sewage treatment plant or similar. B. Uses permitted by special exception of the Board of Appeals. The following, uses are permitted as a special exception by the Board of Appeals as hereinafter provided and subject to site plan approval by the Planning Board: (1) Solar energy generation in excess of that needed to provide power to permitted uses C. Accessory uses. The following uses are permitted as accessory uses: (1) Any customary structures or uses which are customarily incidental to the principal use, except those prohibited by this chapter; (2) Sleeping quarters, apartments or dormitories providing accommodations solely for personnel associated with permitted or special exception uses set forth in &280-183(A) and &280-183(B); (3) Cafeteria for personnel associated with permitted or special exception uses set forth in &280-183(A) and &280-183(B): (4) Infrastructure necessary to the operation of the permitted or special exception uses set forth in §280-183(A) and X280-183(B), limited to roads, sewer system, water storage and water pipelines and utility lines; (5) The existing harbor and ferry facility for transportation by boat to and from the Island. D. Additional Standards: All uses in this District shall be subject to the following Vegetation shall not be disturbed. Where noxious or invasive plants are overtaking native flora or where vegetation must be disturbed in conjunction with a permitted use, an application may be made to the Planning Board for an approval to remove vegetation. The application shall include: 1. a plan indicating he types of vegetation present, the vegetation to be removed and a revegetation plan (if any), using plant species listed in the Southold Town Planning Board's Native/Natural Buffer Plantings list of recommended native Ip ants; 2. an application fee of $100; \uIMust'7_'013 Paec S Southold town Lioard Nlccti11-1 the Planning Board shall render a mitten determination within 30 dins of receipt of a complete application stating the reason therefor and adv isim, the applicant of the right to appeal and 4. No building or premises shall be used and no building or part thereof shall be erected or altered in the Plum Island Research District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full. PIR Bulk Schedule: (to be placed in new Appendix) Minimum Lot Size: 125 acres Uses: Multiple uses and buildings are allowed on a single parcel, the number of which are limited only by lot coverage Lot Coverage: 20% of buildable land, except that solar cnergl' installations may exceed this limit up to a total of 50% lot coverage. Building Height (ft.): 35 Number of Stories: 2 Setback from property line (ft.): 30 Landscape area: 30% 4280-185. Setbacks. New structures and impervious surfaces shall be set back at least 300' from the shoreline, bluff or dune crest, or wetlands edge, whichever is more protective. Article XXXII Plum Island Conservation District (PIC) 4280-186. Purpose. The purpose of the Plum Island Conservation District is to preserve the integrity of the re ig onally significant natural, scenic and historic resources of Plum Island for the benefit of the residents of the Town of Southold. §280-187. Use regulations. In the Plum Island Conservation District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used in whole or in part, for any purpose except the following: A. Permitted uses. The following uses are permitted uses and are subject to site plan approval by the Planning Board: (1) Nature preserve (2) Public park (3) Educational facility related to the study of natural resources conservation. Based upon the Town Board's consideration of the recommendation of the Town's Planning Board, the SEQRA review, the Plum Island Planning Study and the public comments taken at the public hearing or otherwise, the Town Board of the Town of Southold hereby amends the Official Zoning Map of the Town of Southold as adopted by §280-6 of the Town Code to create the Plum Island Research District (PIR) and the Plum Island Conservation District (PIC), as depicted on the attached map. IV. SEVERABILITV If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. And three months would go by and he goes, you know we really ought to do this. And he pushed a little harder and we started but the process, which has taken a fair amount of time and as it should have because there are a lot of details involved. I would just like to extend thanks to our Planning Department. That the, in the midst of doing a comprehensive plan and trying to keep it on schedule, that were able to address this particular issue which some people felt was very sticky and some people felt was very straightforward, 1 think in the end what has come forward is something that is certainly workable for all the parties that are involved and I think that as you look forward. we really don't know what the future holds but we have certainly taken a step in the right direction and I vote aye. 2013-634 CATEGORY. I have a notice that it was posted in the Suffolk Times on August 15 2013 and that it was posted on the Town Clerk's bulletin board on August 2, 2013. I have a letter from Suffolk County "Pursuant to the requirements of section A 14-14 to A 14-25 of the Suffolk County administrative code, the above referenced application which has been submitted to the Suffolk County Planning Commission is considered to be a matter for local determination as there is no apparent significant county wide or inter community impact and a decision of local determination should not be considered either an approval or a disapproval." That is from Sara Lansdale, director of planning and Andrew Freleng, chief planner. A letter from Mark Terry, LWRP coordinator, `the proposed local action is consistent with the LWRP, it is also in conformance with chapter 130 of the environmental quality review of the Southold Town code'. From Donald Wilcenski, chairman of the Planning Board, 'Thank you for the opportunity to provide comments. The Planning Board supports the legislation as previously stated. As previously stated in our memo of July 11, 2013, the Planning Board along with the Transportation Commission is recommending that signs stating no parking or standing be installed as soon as possible at this location. Numerous safety issues related to parking and standing issues on this section of the road has been documented. We consulted with Suffolk County Department of Public Works at this site where their traffic engineer informed us that the shoulders in this area are not adequate for safe parking or standing. Suffolk county Department of Public Works is in favor of these signs. The signs should be located along County Route 48 from Depot Lane west to private road known as Road B on the south side and from the same distance approximately 1420 feet on the north side. I just want to publicly thank Supervisor Russell and principal planner Mark 'herry for holding the holding the Goldsmiths Inlet community meeting this past Saturday. It was a level of outreach that I think is quite extraordinary in today's environment from any level of government. To take a portion of your Saturday on a beautiful August weekend and spend a couple of hours, taking away from your personal time to be with the community and share with them the results of some studies that were recently done, I think deserves a lot of applause. So I thank you for that. SUPERVISOR RUSSELL: It was time well spent. It was a very productive meeting with a lot of very thoughtful comments from many smart people. MR. TERRANOVA: Regarding the content of the meeting, I have some thoughts that 1 put down on paper. I know all the Town Board members were not there so I would like to give this to Betty and if she would, distribute them to the Town Board. SUPERVISOR RUSSELL: Please do, Peter. MR. TERRANOVA: The last item I just want to mention is, could you shed some light on the new sign that was just posted down at Goldsmiths Inlet that says no swimming permitted? Just showed up. SUPERVISOR RUSSELL: Actually, we had gotten a complaint that there was a sign down there that had misspelled Goldsmiths. We didn't put that sign up but for some reason, we were asked to correct it. At the same time, that is not a designated swimming beach (tape change) TOWN ATTORNEY FINNEGAN: Are you talking about the sign that is on thejetty? MR. TERRANOVA: No, there is a sign that was just put up yesterday I believe, according to someone from the town. It was just put up yesterday. I just noticed it today, it says no swimming permitted. SUPERVISOR RUSSELL: We have a company that evaluates our risk in order for us to reduce our insurance costs and it was a recommendation of this particular agency that we post the beaches that swimming isn't permitted, to simply post them that no swimming is permitted.
