The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: 5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: b. protect surface and groundwater against contamination from pathogens and excessive nutrient loading by keeping septic effluent separated from groundwater and by providing adequate treatment of septic effluent, The sanitary system shown on the proposed site plan dated 812112013 appears to not meet current standards. It is recommended that the Board clarify if the system meets current standards. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Like the applicant's home they were built in the 1930s and 1940s as summer cottages when there were no setback regulations in place. Many owners have since converted their cottages into larger, more comfortable year round residences which is the applicant's wish as well. The existing cottage has four small bedrooms sharing only one small bathroom. The proposed alterations and additions will provide the owner with three more spacious bedrooms and baths while only modestly expanding the footprint and maintaining the cottage style architecture. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: due to the location of home and garage on the lot there is no other way to gain much needed floor area other than expanding off the living room and raising the attic roof partially to create a master bedroom suite.
