Gagen Appellant Pine Neck Road Southold, New York at a meeting of the Zoning Board of Appeals on January 25, 1973 the appeal was considered and the action indicated below was taken on your ( ) Request for variance due to lack of access to property ( ) Request for a apeclel exception under the Zoning Ordinance ( n Request for a variance to the Zoning Ordinance 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be delved pursuant to Article Section Subsection paragraph of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be confirmed bananas 8:30 P.M. (E.S.T.), upon application of Charles A. Gagen, Pine Neck Road, Southold, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 301, for permission to get off lotswith less than required area and frontage. Location of property: south side of Clearview Avenue, Southold, bounded north by Clearview Avenue; east by Gagen's Landing Road; south by John Gagen; west by Schoof. Correction as per minutes of 1/25/73: south by Goose Creek, west by Hassler. 2. VARIANCE. By resolution of the Board (t was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (Is) (is not) unique and (would) (would not) be shared by all properties alike In the Immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be dented and that the previous decisions of the Brnuildin Inspector ( ) be confirmed ( ) be merged. SEE RE'ORfpMED _ r2NO BOARD OF APPEAIBFORM ZB{ e man of osal arjori?e/ McDermott, Secretary After investigation and inspection the Hoard finds that applicant requests permission to set off lots with less than required area and frontage. The findings of the Hoard are that the majority of the lots in the area are smaller in size, and that the proposed lots have Planning Hoard approval. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be sh ared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED Charles A. Gagen, Pine Neck Road, Southold, New York, be GRANTED permission to set off lots with less than required area and frontage on premises located on the south side of Clearview Avenue, Southold, New York, as applied for.
