SCTM# 128-2-11 &24 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. A II applicants for perm its' including Tow n of Southold agencies, shall com plete this C C A F for proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law. This assessm cot is intended to supplem ent other inform ation used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listine both supportine and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ? No ? Not Applicable The project seeks to replace a storm damaged bulkhead that is located between an existing bulkhead to the west and an similarly stone damaged bulkhead to the east (permitted for reconstruction by Southold Wetlands Permit 48064), as well as a landward retaining wall, upon which the bulkhead is structurally dependent, as the retaining wall provides containment of the backfill needed to support the bulkhead. The existing site has been improved with and supported and protected from flooding and erosion by the bulkhead and retaining wall to be replaced since prior to 1977, and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property from potential flooding and erosion damage. Without replacement and maintenance of the bulkhead and retaining wall, the subject and adjacent properties, both of which are bulkheaded, would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. Not Applicable Other than the ecological benefit of replacing the treated timber bulkhead with untreated vinyl sheathing and replacing the previously existing treated deck with an on-grade bluestone patio, the project will effectively maintain the historically preexisting conditions along this bulkheaded shoreline without any change in or significant adverse impact on the adjacent unvegetated wetlands area or tidal waters of the Town.
