En-Consultants on behalf of VINCENT & LAURA MANETTI requests a Wetland Permit to reconstruct +/-4'x7'
wood steps off bulkhead to beach; remove and replace existing +/..4'x22' wood stairs with two +/-3'x4' landings
down embankment; and remove existing +/-12'x16' wood deck at top of bank. Located: 150 West Shore Drive,
Southold. SCTM# 80-5-5.1
It is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 (below) and
therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
In 2008 references were made to the unpermitted stair structures in Wetland Permit 6930, however, no
hermit was issued for the structures because they were not included in the application at the time. A
Suffer requirement was included in the permit.

A. INSTRUCTIONS

proposed actions that are subject to the Town of Southold W aterfrontConsistency Review Law. This
assessm eni is intended to supplem cot other inform ation used by a Town of Southold agency in
m a i in g a d e le r m in a t i o n o f c o n s i s t e n c y. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listine both supportine and non-
supportine facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office. !

All policies have been checked "Not Applicable" because it is our understanding pursuant to Town Code §268-5 ("Review of Actions")
and the corresponding definitions of "action" and "minor action" by §286-3 ("Definitions") that the project meets the following
definition of a minor action and is thus not subject to waterfront consistency review pursuant to chapter 268: "13. Replacement,
rehabilitation or reconstruction of a structure of facility, in kind, on the same site (in place) except for structures in areas designated
by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a
permit..."
