Fairweather & Brown Associates on behalf of VASILIOS FRANGOS requests an Amendment to Wetland Permit #7388 & Coastal Erosion Permit #7388C to replace the 809 square foot decking on the seaward side of the dwelling. Located: 55755 County Road 48, Southold. SCTM# 44-1-15 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Subject parcel ,l Policy Standards 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposed use is residential and therefore is not a "water dependent use". The deck in not a permissible structure in the CEHA. Since the proposed 809 square foot deck could not be located outside of the FEMA flood zone VE (Velocity Hazard) and Coastal Erosion Hazard Area it is recommended that the Board consider requiring alternative natural materials (stone patio) to prevent adverse effects on the water body (these types of structures become debris and navigational hazards in the water body during and after storm events). It is recommended that the Board amend the application to meet and/or further the above policy to the greatest extent practicable and minimize the potential of future structural loss. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local I Waterfront Revitalization Program. A proposed action will be evaluated as to its significant j beneficial and adverse effects unon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail listinc both supporting and non supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. The current owner , Vasilios Frangos, purchased the property in January from the previous owner's Estate and came to us this in July with request to acquire a building permit to try and get the work done immediately. Believing he had all the required permits he had the storm damaged deck removed before being told by us that the permitting needed to be transferred to his name. It is our hope that he will be able to replace the deck as applied for and as would probably have been granted if the remnants of the damaged deck were in place. The DEC permit has been previously submitted with our attempt to file this as an administrative amendment.
